November 23, 1953 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session, on the above date, in the Council Room of the Memorial Auditorium Building, at 8:00 o'clock P.M., with the following members present: Kindel Paulk Mayor R. Walter Friberg City Attorney Moved by Alderman Willis that the Minutes of the regular meeting held November 9, 1953, be approved. Motion seconded by AldermanCox and carried. Moved by Alderman Hammond that the Board of Aldermen approve the Burns Amended Plat of Blocks 8-9-10 & 11, of Park Place Subdivision of a portion of J.A. Scott Surveys 8 & 9, Wichita County, Texas, copy of which is attached hereto and made a part of the records hereof. Motion seconded by Alderman Mason and carried. Moved by Alderman Mason that the Board of Aldermen adopt the recommendation of the City Traffic Commission, as set forth in Paragraph 6 of report dated Nov. 13, 1953, copy of which is attached hereto; and that the Board of Aldermen authorize and direct that parking be eliminated on the North side of 9th St. and 11th St., from Lamar to Bluff Streets, between the hours of 4 P.M. to 6 P.M. Motion seconded by Alderman Hammond and carried. Moved by Alderman Mason that the Board of Aldermen approve and grant tax exemption for the year 1953, to the First Church of Christ Scientist, on Lot 1, Block ' 13, Country Club Estates, upon which a church building is proposed to be erected. Motion seconded by Alderman Hammond and carried. A petition, bearing approximately 11 signatures, was presented to the Council, asking that a new trailer camp ordinance be passed. Moved by Alderman Hammond that the proposed ordinance, regulating the operation of trailer camps, be set down for public discussion at the regular meeting to be held January 11, 1954. Motion seconded by Alderman Mason and carried. Moved by Alderman Cox that the Board of Aldermen authorize the issuance of a building permit, free gratis, to the State Highway Department, to construct a ware- house on their property locathd on East Scott St. Motion seconded by Alderman Willis and carried. 4 a 347 Moved by Alderman Cox that the request of the Sacred Heart Church for the City to construct aid lay water and sewer mains to the new school building, located on York Street, without cost to them, be denied; further that the same procedure be followed for water and sewer mains for this school building that has been followed for all other school buildings. Motion seconded by Alderman Hammond and carried. RESOLUTION NO. 244 BE IT RESOLVED BY THE BOARD OF AT,TIFRMEN OF THE•CITY OF WICHITA FAZES, TEXAS: THAT WHEREAS, the City of Wichita Falls, Texas, a municipal corporation, bought at tax sale by City of Wichita Falls, Texas, Tax Collector C. M. Bryan, on April 18, 189e. all of Block 109 of the Original Townsite of the City of Wichita Falls, Texas, which said Block 109, has a lot in it numbered 13, and WHEREAS, the City of Wichita Falls, Texas, a municipal corporation, bought at tax sale by City of Wichita Falls, Texas, Tax Collector A. D. Anderson, on the 8th day of July 1893, Lot Number 13 in Block 109 of the Original Townsite of the City of Wichita Falls, Wichita County, Texas, and other lots and Blocks which are herein omitted, and WHEREAS, the City of Wichita Falls, Texas, a municipal corporation, bought at tax sale by City of Wichita Falls, Texas, Tax Collector, A. D. Anderson, on June li, 1894, lot number 13 in Block Number 109 of the Original Townsite of the City of Wichita Falls, Wichita County, Texas, and other lots and blocks which are herein omitted, and WHEREAS, the City of Wichita Falls, Texas, has apparently abandoned owner- ship of said Lot Number 13 in Block 109 of the Original Townsite of the City of Wichita Falls, Texas, and has collected taxes on the same since, and the taxes are certified to by the said City of Wichita Falls Tax Collector as paid for 1953 and all prior years, and WHEREAS, the present owner and holder of said Lot No. 13 in said Block Number 109 of the Original Townsite of the City of Wichita Falls, Texas, in Wichita County, towits Mrs Mildred Stout, desires a Quit Claim Deed to said Lot 13 of said Block 109, to cure objections to the title; NOW, THEREFORE, be it resolved by the Board of Aldermen of the City of Wichita Falls, Texas, a municipal corporation, in regular meeting assembled, that the Honorable Kindel Faulk, Mayor, in conjunction with the City Secretary, Gee. T. Henderson, of the City of Wichita Falls, Texas, a municipal corporation, be and is hereby authorized to execute a Quit Claim Deed to the above described property, to the owner, Mrs Mildred Stout. Moved by Alderman Willis that the Board of Aldermen authorize the issuance of a permit to the Sinclair Oil Company to install 3 - 3M gal. and 1 - 550 gal. under- ground gasoline storage tanks at their proposed service station located on the Jacksboro Highway and Hampstead Lane, providing that same is installed in accoAjdance with require- ments of the City Engineer. Motion seconded by Alderman Cox and carried. ,) 3146 Moved by Alderman Mason that the request of Wichita Coca-Cola Bottling' Company, to remove the restrictions prohibiting the movement of trucks over Kell Blvd. in excess of 7000 gross pounds, in the area between Holliday Street and Kemp B&vd., be denied, and the present restrictions remain in effect and be enforced. Motion seconded by Alderman Hammond and carried. Moved by Alderman Thomas that the Board of Aldermen approve and authorize tax refunds, both personal and real, for the amounts and reasons, as follows: To G. C. McGuire, the sum of $5.32, a/c error in taxes on Lots 14 & 15, Blk 149A, Highland, and Lot 15, Blk 232, Original, all for year 1951. 4 To IFaymond Parvin, the sum of $14.814, a/c error in taxes on Lot 5, Blk 21, Sibley Taylor Addn. for year 1951. To Frank J. Harbin, the sum of $14.614, a/c error in tax payment on personal property for year 1953. To First Federal Savings & Loan Assn. the sum of $114.08 a/c error tax payment on Lot 8, Blk 145A Highland, for year 1953. To Mrs R. E. Hilburn, the sum of $57.92 a/c double tax payment on Lot 6, Blk 66, Floral Heights Addn. and Lot 14, Blk 1, Truehart, for year 1953. To First Federal Savings & Loan Assn..the sum of $1414.16, a/c double tax payment on N 1/3 of Lots 21& 22, Blk 258, Original, for year 1953. Motion seconded by Alderman Cox and carried. a Moved by Alderman Mason that the Board of Aldermen authorize the construction =nd laying of a sanitary sewer line to the Armory Building, at the County Farm, connecting 'o the State Hospital sewer line at a point north of the 4-H Club Bldg., thence following ore or less the natural contour of the area to the Armory; the approximate cost to be 17,188.00. Motion seconded by Alderman Willis and carried. 1 The natter of die-annexation of the Nelson-Stone Addition was discussed, where- ./ pon, the City Attorney was instructed to proceed to prepare the necessary ordinance and submit the same to the Board of Aldermen for further consideration. • Moved by Alderman Willis that the Board of Aldermen proceed to exercise the City's option to obtain right and title to the 20 inch water line to Sheppard Field Air Force Base, x as mentioned in the original Contract W-257-Eng-392, by and between the City of Wichita Falls, Texas, and the United States of America, and to authorize and direct John P. Ruhmann, Director of Utilities, to proceed in the manner necessary to acquire such right and title. Motion seconded by Alderman Thomas and carried. 0�°' 1 RESOLUTION NO. 2145 THE STATE OF TEXAS ) COUNTY OF WICHITA ) WHEREAS, the City of Wichita Falls has heretofore abandoned the alley across Block 30-A of Highland Addition to the City of Wichita Falls, Wichita County, Texas, and in such resolution abandoning such alley easements were retained for utilities; and WHEREAS, W. L. Sullivan, the present owner of said Block 30-A has deposited with the City of Wichita Falls and with each of the other utilities utilizing such easement sufficient funds to remove the utilities now utilizing such easement, and the City has no further use for such easement; NOW, THEREFORE, BE IT RESOLVED that the Mayor and Secretary, on behalf of the City of Wichita Falls, execute in favor of W. L. Sullivan a quit-claim deed as to any utility easement rights which it may hold in and to said Block 30-A of Highland Addition to the City of Wichita Falls, Texas. 1 31;9 ' t . Jasper Survey Abstract 168, copy of which is attached hereto and made a part of the records hereof. Motion seconded by Alderman Willis.and carried. Moved by Alderman Thomas that the Board of.Aldermen authorize payment to N. H. Downing the sum of $108.53 being payment due Oct. 1, 1953, on a water main contract entered into by and between the City and N..H. Downing dated June 6, 1953, covering First Supplemental Addition to Park Place.Addition; further to direct the City Clerk to draw a check for the same. Motion seconded by Alderman Cox and carried. As advertised, the public hearing on Ordinance No. 1671 was, in all respects duly held. Attorney Woodward Bass, representing Tschabold Jewelry Co. opposed passage of the same. Both proponents and opponents were given ample opportunity to express their views, thereupon the following motion was had: Moved by Alderman Hammond that the Public Hearing on Ordinance No. 1671 be closed. Motion seconded by Alderman Cox and carried by the following vote: Yeas: Aldermen Willis, Thomas, Hammond, Cox and Mason. Nays: None. (Auctioneers Ordinance) Moved by Alderman Cox that the Board of Aldermen authorize a refund to McAlester Fuel Co. the sum of $207.00 for lease rental paid to the City in error Oct. 29, 1953, covering an oil and gas lease at Lake Kickapoo; further to direct the City Clerk to draw a check for the same. Motion seconded by Alderman Hammond and carried. S i The claim for damages against the City as alleged by Sarah M. Adams, was r presented to the Board of Aldermen by the City Clerk, whereupon the matter was referred to the City Attorney for investigation. 1 Moved by Alderman Thomas that the Board of Aldermen accept the resignation ' of City Manager Bill N. Taylor, effective December 1, 1953. Motion seconded by Alderman Mason and carried. 3 Mayor Kindel Faulk appointed H. A. Thomason to the office of City Manager of the City of Wichita Falls, Texas, effective December 1, 1953. Moved by Alderman Mason that the Board of Aldermen approve and ratify the appointment, made by Mayor Kindel Faulk, of H. A. Thomason as City Manager, effective Dec. 1, 1953. Motion seconded by Alderman Thomas and carri.hd. I 350 Moved by Alderman Mason that the Board of Aldermen accept, with regret, the resignation of Alderman J. Paul Montgomery, and that the City Attorney be directed to write a letter of appreciation to Alderman Montgomery, and that a copy of the same be spread upon the Minutes. Motion seconded by Alderman Hammond and carried. BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: WHEREAS, J. A.UL MONTGOMERY has served the City of Wichita Falls as a member of the Board of Aldermen with fidelity and distinction, and WHEREAS, Mr. Montgomery has tendered his resignation as such member of the Board of Aldermen, finding it necessary to resign for personal reasons, and WHEREAS, it is with deep regret that the Board must accept such resignation, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, that the resignation of Mr. Montgomery as a member of such Board of Aldermen of said City be accepted with the regrets of the remaining members of such Board that it is necessary that the same be accepted, and that as representatives of the people of Wichita Falls, this City Council, extend to Mr. Montgomery their sin- cere good wishes for his happiness and success in the future and the thanks of the people of Wichita Falls for his services as a member of such Board of Aldermen. BE IT FURTHER RESOLVED that the members of the Board of Aldermen personally extend to Mr. Montgomery their appreciation for his counsel and advice as a member of this Board and particularly commend him for the manner in which he has conducted himself in this office, and further, that a copy of this Resolution be spread upon the Minutes and an exemplified copy be sent Mr. Montgomery.
