Min 10/12/1953 335 Wichita Falls, Texas Memorial Auditorium Building October 12, 1953 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date, in the Council Room of the Memorial Auditorium Building, at 8:00 o'clock' P.M., with the following members present: Kindel Faulk Mayor Nifty R. Walter Friberg City Attorney Moved by Alderman Cox that the Minutes of the regular meeting held September 28 and the called meeting held September 3Oth, 1953, be approved. Motion seconded by Alderman Hammond and carried. ORDINANCE NO.1663 AN ORDINANCE REGULATING THE FINANCING OF WATER AND SEWER EXTEPS IOIS AND CONTROLLING SUBDIVISIONS ADJACENT TO OR WITHIN THE CORPORATE LIMITS OF THE CITY OF WICHITA FALLS, TEXAS. The public hearing of Ordinance No. 1663 was held, whereupon Russell Willis, representative of Wichita County Home Builders Association, vigorously opposed passage of Ordinance No. 1663, thereupon the following motion was had: Moved by Alderman Willis that further consideration of Ordinance No. 1663 be postponed until some future date. Motion seconded by Alderman Hammond and carried.by the following vote: Yeas: Aldermen Willis, Hammond, Cox and Mason. Nays: None. Mrs John Akin, representing the Organ Guild, requested free use of the Municipal Auditorium Sunday December 6, 1953, for presentation of The Messiah, whereupon the following motion was had: Moved by Alderman Mason that the local Organ Guild be granted use of the Municipal Auditorium (free gratis) Sunday afternoon, December 6, 1953, for presenta- tion of the Messiah free to the public. Motion seconded by Alderman Willis and carried. Moved by Alderman Mason that the Fire Department be granted use of a plot of ground at 10th& Polk St. for a park site. Motion seconded by Alderman Cox and carried. ORDINANCE NO.1662 AN ORDINANCE ADOPTING A BUDGET FOR THE ENSUING FISCAL YEAR, BEGINNING t OCTOBER 1, 1953, AND ENDING SEPTEMBER 30,'1954, IN ACCORDANCE WITH THE CHARTER AND ORDINANCES OF THE CITY OF WICHITA FALLS, TEXAS. Moved by Alderman Mason that Ordinance No. 1662, after having been duly advertised and a public hearing held thereon, be approved and passed as read. Motion seconded by Alderman Hammond and carried by the following vote: Yeas: Aldermen Willis, Vox, Hammond and Mason. Nays: None. 336 ORDINANCE NO. 1665 AN ORDINANCE PROHIBITING THE ABANDONMENT OR DANGEROLS EXPOSURE OF ICE- BOXES OR REFRIGERATORS IN CONDITION WHERE THEY MAY BECOME MENACES TO THE LIVES OF CHILDREN; PROVIDING PENALTIES; AND DECLARING AN EMERGENCY. Moved by Alderman Willis that Ordinance No. 1665 be introduced and set down for a public hearing at the next regular meeting to be held at 8:00 o'clock P.M. October 26, 1953. ORDINANCE NO.1670 AN ORDINANCE PROVIDING FOR CLASSIFICATION OF ALL FIREMEN UNDER CIVIL SERVICE EMPLOYED BY THE CITY OF WICHITA FALLS; DECLARING AN EMERGENCY; AND REPEAL- ING ALL PRIOR ORDINANCES INCONSISTENT HEREWITH. Nays: None. 1,4 Moved by Alderman Cox that the Board of Aldermen authorize the issuance ( of a permit to Mrs Idell B. McCauley to erect a sign in the sidewalk space at 1500 Harrison St., provided the same is erected in accordance with requirements of the City Engineer; with further provisions that the permit is issued for a period of one year only from date hereof, and the City reserves the right to cause removal of the said sign at expiration date, by giving 30 days notice in writing. Motion seconded by Alderman Willis and carried. Moved by Alderman Cox that the Board of Aldermen accept the bid of D &F / Motor Co. Inc. for motor vehicle rent service, which reads as follows: Kindel Ptulk, Mayor City of Wichita Falls. We hereby submit a least proposal on the following basis: All phases of the Lease Agreement that now exist between our company and the City of Wichita Falls to be exactly the same with one exception and that is, The City to guarantee to us a mini- mum of 350.00 per month for each vehicle in operation. Said Lease Agreement if approved by the City to be for one year from date of expiration of the existing contract. D &F Motor Co. Inc. Wichita Falls, Tex. J. 0. Moved by Alderman Mason that the Board of Aldermen approve and authorize / the execution of a Modification of Lease N0y(R)-b0902, by and between the United States of America, represented by the Chief of Bureau of Yards &Docks, and the City of Wichita Falls, covering the following tract of land: Beginning at the northwest corner of Block 7, Bellvue Addition to the City of Wichita Falls, Texas, being also the intersection of the east line of Denver Street with the south line of Fifth Street; thence south along the east line of Denver Street 250 feet to a point; thence east 320 feet to a point; thence north 135 feet to a point; thence west 20 feet to a point; thence north 115 feet to a point in the south line of Fifth Street; thence west 300 feet along the south line of Fifth Street to the place of beginning, containing within these metes and bounds 2.010 acres of land, more or less, as shown on the attached map marked Exhibit "A", to be used exclusively for military purposes. Moved by Alderman Cox that all Receipts from the sale of Cemetery Lots in Riverside Cemetery be temporarily set aside in a separate fund, to be known as a Special Cemetery Fund, until such time as permanent arrangements can be perfected for a perpetual cemetery maintenance fund; said fund to be retroactive as of October 1, 1953. Motion seconded by Alderman Hammond and carried. Moved by Alderman Willis that the Board of Aldermen authorize refund to 0. L. Dillard the sum of $5.00 for chauffeur's license, for reason the said 0. L. Dillard was disqualified; further to direct the City Clerk to draw a check for the same. Motion seconded by Alderman Hammond and carried. Moved by Alderman Mason that the Board of Aldermen authorize and direct the1;5! City to pay one-half of the expense of constructing sidewalks and other things necessary, in connection therewith, for Harrell Public School; and further to direct the City Manager and City Clerk to transfer the sum of $5000.00 from the Contingent appropriation to the Street appropriation, Account No. 31-Y-5. Motion seconded by Alderman Willis and carried. Moved by Alderman Mason that the Board of Aldermen approve and authorize the e issuance of a permit to English Pharmacy to use for parking purposes that portion of ?h4. the parkway from the property line to a point 6 ft. West of the curb on Filmore Street J u of Lots 15 & 16, Block 24, Floral Heights Addition, as shown on the plat attached'hereto and dads a pert'-of the records hereof. Motion seconded by Alderman Willis and carried. Moved by Alderman Hammond that the Board of Aldermen approve the Tax Roll for the City of Wichita Falls, Texas, for the year 1953. as certified to by City Tax Assessor and Collector, Ben C. Armstrong, copies of which are attached hereto and made a part of the records hereof. Motion seconded by Alderman Willis and carried. Moved by Alderman Mason that the Board of Aldermen approve and adopt the Flat of Lakewood Subdivision, Lots 2 to 8, inclusive, Block 6, Inglewood Place (Amended Plat) to the City of Wichita Falls, copy of which is attached hereto and made a part of the records hereof.
