Min 08/24/1953 323 Wichita Falls, Texas Memorial Auditorium Building August 24, 1953 The Board of Aldermen of the City of Wichita Falls, Texas, met in regnlat session on the aboYe date, in the Council Room of the Memorial Auditorium Building, at 8:00 o&block P.M., with the following members present: Kindel Faulk Mayor R. ,P. Willis Lloyd C. Thomas • Jack L. Hammond Aldermen Dr. E. Aubrey Cox J. Paul Montgomery Henry D. Mason Geo. T. Henderson City Clerk Bill N. Taylor City Manager J. Walter Friberg City Attorney Moved by Alderman Thomas that the Minutes of the regular meeting held July 27, 1953, and the called meeting held August 17, 1953, be approved. Motion seconded by Alderman Hammond and carried. A. J. Hollis presented a petition containing approximately 30 signatures, ✓ requesting the City to close Railroad Ave. from Baylor Street west to Van Buren St. The matter was discussed with City Engineer, F. M. Rugeley, whereupon the following motion was had: ' £v _lt. Moved by Alderman Thomas that Railroad Ave. from Baylor St. west to Van Buren be temporarily barricaded, but riot to be abandoned under any consideration. Motion seconded by Alderman Montgomery and carried. Q� D. A. Carter requested the City to pave the 100, 200 and 300 blocks on �ndiana Ave. for safety measures. The matter was referred to_City Engineer, F. M. Rugeley. L. L. Groves presented a petition, bearing approximately 70 signatures, g.S.equesting the City to make arrangements for public transportation for school children in Sunnyside Heights Addition, beginning with this school term. The matter was referred to the City Attorney and the Bus Company. As advertised, the public hearing was held on Ordinance No. 1653, at which time,Attorneys Bernard Martin and Ben G. O'Neal, and others, expressed opposi- tion,to the passage of the said Ordinance No. 1653. After both proponents and opponents were given ample time to express their views, the following motion was had: Moved by Alderman Montgomery that the Public Hearing of Ordinance No. 1653 ' be closed for this meeting. Motion seconded by Alderman Thomas and Niro' Mayor Kindel Faulk stated the Board of Aldermen would hold a second Ga"-Public Hearing on Ordinance No. 1653, at the next regular meeting to be held September 14, 1953. 324 A public discussion of the application of the Southwestern Bell Telephone Company for an increase in rates was conducted, whereupon, Attorneys Bernard Martin, Ben G. O'Neal, Edgar M. Mann, and various other citizens opposed the increase, and propounded numerous questions to representatives of the Telephone Company. Both proponents and opponents were permitted to consume considerable time in expressing their views. No further action was taken. City Clerk, Geo. T. Henderson, certified to the Board of Aldermen, in writing, the referendum and amended petitions filed in the office of the City Clark July 15th and July 25th, 1953, to contain a sufficient number of electors, the same being attached hereto and made a part of the records hereof. Immediately upon presentation to the Council of the above and foregoing Certificate, Mayor Kindel Faulk read to the Council an opinion by City Attorney J. Walter Friberg pertaining to the referendum petition, a copy of which is attached hereto and made a part of the records hereof. Moved by Alderman Cox that the referendum petition filed in the Office of the City Clerk July 15th and 25th, respectively, be refused and denied. Motion seconded by Alderman Montgomery and carried, with Alderman Willis voting No. Moved by Alderman Thomas that the Board of Aldermen authorize payment to r, the Wichita General Hospital the sum of $8376.65 for charity patients for the month of July, and direct the City Clerk to draw a check for the same. Motion seconded by Alderman Cox and carried. Moved by Alderman Thomas that the Board of Aldermen authorize water main payments to the following person, persons, or firms, amounts and reasons as stated: E. E. Clair, the sum of $929.43, being amount due 8-1-53 on wat.main cont. with the City in Wichita Manor dated 1-9-50. C. L. Rogers, the sum of $96.08, due 8-1-53 on wat.main cont. in Rivera Parkway Addb. dated 2-25-52. Sunnyside Development Co. the sum of $3113.50, due 8-1-53, on wat.main cont. Sunnyside Heights Addn. dated 2-25-52 Morningside Estates Inc. the sum of $803.97, due 8-1-53, on wat.main cont.in East Morningside Addn. dated 10-10-f9; further, to direct the City Clerk to draw check for each of the above. Motion seconded by Alderman Hammond and carried. Moved by-Alderman Thomas that the Board of Aldermen approve and authorize the execution of a water main contract brand between Hamilton Investment Co. and the City of Wichita Falls for water mains on Mockingbird Lane in 6th Supplemental Addn. to Country Club Estates Addition, in the amount of $3192.53, upon the terms and con- ditions therein stated, and to authorize and empower Mayor Kindel Faulk to execute the same for and on behalf of the City of Wichita Falls, Texas. Motion seconded by Alderman Montgomery and carried: Moved by Alderman Cox that the Board of Aldermen authorize the execution of a supplemental contract with Hughes Development Co. Inc. covering water main installs- if tiers in Faith Village, Unit#1, in the amount of $81,253.17; also a supplemental con- tract with Hughes Development Co. Inc. covering sewer main installation in Faith Village, Unit#1, in the amount of $31,463.88; and to authorize and empower Mayor Kindel Faulk to execute the said contracts for and on behalf of the City of Wichita Falls. Motion seconded by Alderman Thomas and carried. 325 Moved by Alderman Mason that the Board of Aldermen authorize payment to Hughes Development Co. the sum of $8057.46 on a water main contract in Faith Village, Unit#1, from Oct. 1, 1951, to Sept. 30, 1952, and likewise pay Hughes Development Co. the sum of $1247.81 on a sewer main contract in Faith Village, Unit#1, from Oct. 1, 1951 to Sept. 30, 1952; and direct the City Clerk to draw checks for the same. Motion seconded by Alderman Montgomery and carried. „a. Moved bg Alderman Thomas that the Board of Aldermen authorize a transfer from. the regular Water Department cash, the sum of $662.72, to the Water Bond Improvement cash, and direct the City Clerk to make such transfer. Motion seconded by Alderman Hammond and carried. ORDINANCE NO. 1657 AN ORDINANCE PROVIDING FOR THE CONSTRUCTION AND MAINTENANCE OF THE PORTION OF U. S. HIGHWAY NO. 281 IN THE CITY OF WICHITA FAT.TS, HEREINABOVE REFERRED TO AS "THE STREET PROJECT" AND AUTHORIZING THE MAYOR OF THE CITY TO EXECUTE AND THE CITY SECRETARY TO AFFIX THE CORPORATE SEAL AND ATTEST THE SAME, A CERTAIN CONTRACT BETWEEN y THE CITY AND THE STATE OF-TEXAS PROVIDING FOR THE INSTALLATION, ReCONSTRUCTION, MAINTENANCE, EXISTENCE AND USE OF THE SAID STREET PROJECT; FOR THE INDEMNIFICATION OF THE STATE OF TEXAS, BY THE CITY AGAINST ALL DAMAGES TO ADJOINING, ABUTTING AND OTHER PROPERTY, AND FOR EXPENSES IN CONNECTION WITH ANY CLAIM OR SUIT THEREOF; AND DECLARING AN EMERGENCY AND PROVIDING THAT THIS ORDINANCE SHALL BE EFFECTIVE FROM AND AFTER ITS PASSAGE. Nays: None. to Martin Properties Moved by Alderman Willis that the Board of Aldermen authorize the sale kf a portionof Lot 3, Block 11, Sunset Heights Addition, being that portion of Lot'3 lying adjacent to Lot 4 upon which is located a building now occupied by Texas Department of Public Safety, for a consideration of $800.00, and to authorize and empower Mayor Kindel Faulk to execute a deed to the same for and on behalf of the City of Wichita Falls. Motion seconded by Alderman Montgomery and carried. 1,, Moved by Alderman Mason that the Board of Aldermen grant permission to White's Auto Stores to temporarily retain a stairway on the side of the old Miller &Miller Building, on the corner of 5th & Indiana St., said stairway located on the 5th St. side. It is distinctly understood that this is a temporary permit only and the City may cause removal of same when and at such time as the City may deem necessary. Motion seconded by Alderman Hammond and carried. 4 Moved by Alderman Thomas that the Board of Aldermen authorize a tax refund to Ora Marshall the sum of $9.67 on account of double payment on S 1/2 of 9, 10 & 11, S 1/2 of E 14.7' of 12, Blk 87, Original, for years 1946, 1947 and 1948; further to direct the City Clerk to draw a check for the same. Motion seconded by Alderman Hammond and carried. City Manager, Bill N. Taylor, presented a citation to B. F. VanFtlt, Fire Marshal, for an extra-ordinary achievement in the apprehension of the person involved (in recent arson cases. 326 1 Moved by Alderman Willis that the City Attorney be authorized and directed ',04 °, to advertise for bids for the sale of an oil and gas lease on a tract of land out of the J. A'. Scott Survey#18, Abstract 300, containing 6.14 acres more or less'. Motion seconded by Alderman Hammond and carried. A Moved by Alderman Mason that the application of Mr. Harwell for acceptance of the plat of the Harwell Addition adjacent to the Continental Oil Co. plant be deferred until the next regular meeting to be held September 14, 1953. Motion seconded by Alderhitn Thomas and carried. Moved by Alderman Hammond that the meeting be adjourned. Motion seconded by Alderman Montgomery and carried. The Board of Aldermen then/// adjourned. Said ordinance, providing, in effect, a substantial raise in the gas rates of Wichita Falls, Texas being charged by Lone Star Gas Company, the said ordinance being passed and approved on the 15th day of June, A.D. 1953.
