Min 06/15/1953 299 Wichita Falls, Texas Memorial Auditorium Building June 15, 1953 The Board of Aldermen of the City of Wichita Falls, Texas, met in called session on the above date, in the Council Room of the Memorial Auditorium Building, ' at 8:00 o&clock P.M., with the following members present: Kindel 'Faulk " Mayor R. P. Willis 0 Lloyd C. Thomas 1 Aldermen Jack L. Hammond Henry D. Mason 0 • Geo. T. Henderson City Clerk Bill N. Taylor City Manager J. Walter Fi•iberg City Attorney Mayor Faulk stated the purpose of this meeting to be,among other things, the holding of public hearings on Ordinances Nos. 1646 and 1647. In accordance with terms of the Charter, a second public hearing was held on Ordinance No. 161:6, at which time Messrs 0. R. Hart mad Bob Cole expressed their objections to the said Ordinance No. 1646. Mayor Kindel Faulk stated that, in his opinion, the Gas Company was not entitled to the full amount of increase asked for, therefore he would not vote. After both proponents and opponents had been given an opportunity to voice their opinions; the following motion was had: Moved by Alderman Mason that public hearing on Ordinance No. 1646 be closed. Motion seconded by Alderman Hammond and carried by the following vote: Yeas: Aldermen Willis, Thomas, Hammond and Mason. Nays: None. ORDINANCE NO.16146 AN ORDINANCE FIXING AND DETERMINING RATES AND CHARGES TO BE CHARGED FOR SALES OF NATURAL GAS TO RESIDENTIAL AND COMMERCIAL CONSUMERS WITHIN THE CITY LIMITS OF WICHITA FALLS, WICHITA COUNTY, TEXAS, PROVIDING FOR THE MANNER IN WHICH SUCH RATES AND CHARGES MAY BE CHANGED AND AMENDED, AND REPEALING ALL ORDINANCES OF THE CITY OF WICHITA FALLS WHICH ARE IN CONFLICT WITH THE PROVISIONS OF THIS ORRDINANCE. Moved by Alderman Mason that Ordinance No. 1646 be approved and passed as read. As advertised, the public hearing was held on Ordinance No. 1647. ORDINANCE No.1647 � I l 300 ORDINANCE NO. 161:7 AN ORDINANCE AMENDING ORDINANCE NO. 1533 WHICH AMENDED SECTION 14-707 OF THE CODIFICATION OF ORDINANCES OF THE CITY OF WICHITA FALLS, TEXAS, 19141 EDITION, ADOPTED ' BY ORDINANCE NO. 1315, PASSED AND APPROVED ON JANUARY 6, 1914]., AS AMENDED BY ORDINANCE NO. 1377, PASSED and APPROVED ON DECEMBER 29, 191i3, AS AMENDED BY ORDINANCE NO. 11462 PASSED AND APPROVED ON MAY 10, 1948, AND AS AMENDED BY ORDINANCE NO. 1533 PASSED AND APPROVED ON AUGUST 28, 1950, PROVIDING FOR THE CLOSING OF ALL PUBLIC DANCE HALLS FROM 1100 O'CLOCK A.M. Moved by Alderman Thomas that the Bbard of Aldermen approve and authorize payment to J. R. Farabee the sum of $22.65, being amount due June 1, 1953, on a sewer ./ main contract previously entered into by and between J. R. Farabee and the City for sewer mains in Farabee Addition; further to direct the City Clerk to draw a check for the same. Motion seconded by Alderman Willis and-carried. Moved by Alderman Thomas that the Board of Aldermen grant a 12 month extension• ` to J. R. Parkey Sc Son to that certain grass lease contract dated Aug. lj, 1951, coverings' 156 acres at Lake Kickapoo in the J.C. Philon Survey, Abst. 236, Archer Cbtay;:,Tex3s ' d for a consideration of $1.25 per acre; said lease being extended to August 14, 1954. Motion seconded by Alderman Willis and carried. • Moved by Alderman Hammond that the Board of Aldermen approve and ratify the C action of the City Manager, Bill N. Taylor, for the execution of a contract dated a� ej- June 10, 1953, by and between C. W. Taylor and the City for the construction of a fir r station in Southmoor Addition, upon the terms and conditions therein stated. Motion seconded by Alderman Thomas and carried. ORDINANCE NO.1651 AN ORDINANCE AMENDING SECTION 1 OF ARTICLE 1 OF ORDINANCE NO. 1456 DEFINING THE CHIEF EXECUTIVE UNDER THE CIVIL SERVICE SYSTEM FOR FIREMEN AND POLICEMEN OF THE CITY OF WICHITA FALLS, TEXAS. ' RESOLUTION NO. 239 BE IT RESOLVED BY THE BOARD OE ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: WHEREAS, the City of Wichita Falls is a participant under the Texas Municipal Retirement System; and WHEREAS, such participation is intended to take care of the physically handicapped employee who becomes permanently disabled in the course of his employment, or after ten years service, for any reason; and WHEREAS such retirement was entered into for the purpose of obtaining better and more qualified employees for theCity of Wichita Falls;' 301 IT IS THEREFORE RESOLVED that all physically handicapped employees who are eli- gible for retirement under the provisions of the Texas Municipal Retirement System shall, and they are hereby required to take a physical examination, and in the event such physical examination determines a total disability that is compensable under the terms of the City's contract with the Texas Municipal Retirement System, then such employee is hereby required to apply for such benefits in order that said employee may be replaced by a physically competent person. RESOLUTION NO.240 BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEAS: THAT it is hereby added to Section 5, Termination of Service, of the Temporary Regulations Concerning Personnel of the City of WichitaFalls, dated December 10, 1951, the following additional cause for termination of service, the same to be added as 4) to said section: Physical Incapacity. (By physical incapacity is meant any partial or total disability, either mental or physical, that retards the employee in the per- formance of all the duties pertaining to the position for which he has been hired.) A lderman Mason that the Board of Aldermen authorize the issuance of a permit to Magnolia Petroleum Co. to install 2 - 3M gal underground gasoline storage tanks at 1001 Filmore St., providing the eerie are installed in accordance with require- ments of the City Engineer. Motion seconded by Alderman Hammond and carried. 2' Moved by Alderman Willis that the Board of Aldermen authorize the issuance of a permit to Roy Hyatt to install one 13000 CFM airconditioner at 925 Scott Ave., providing the same is installed in accordance with requirements of the City Engineer. It is expressly understood and agreed that this permit shall expire October 1, 1953. Motion seconded by Alderman Thomas and carried. that Mr. J. T. Stephen came before the Council to request/the City furnish some 65 houses in Lake Wichita area with water from Lake Mckapoo, through a special arrangement with the State Hospital. Mr. Stephen stated their supply from Lake Wichita is completely exhausted and that citizens of that area would comply 100% with water restrictions, whereupon Mayor Paulk stated the matter would be given careful consideration and requested John Ruhmann to investigate the situation and make such recommendations as he deemed advisable and possible. I • By common consent of the Council, a public hearing will be held at the next egnlar council meeting, June 22nd, to consider one-way traffic on Austin and Travis Streets from 5th to 11th. 302 Moved by Alderman Thomas that the meeting be adjourned.
