Min 05/11/1953 . . 285 Wichita Falls, Texas Memorial Auditorium Building May 11, 1953 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date, in the Council Room of the Memorial Auditorium Building, at 8:00 o'clock P.M., with the following members present:- Kindel Faulk Mayor R. Walter Friberg City Attorney Moved by Alderman Mason that the Minutes of the regular meeting held April 27, 1953, be approved. Motion seconded by Alderman Willis and carried. Honorable Mayor &Board of Aldermen Wichita Falls, Texas The members of the Citizens Safety Council meeting in regular monthly session Tuesday, May 5, unanimously adopted the following resolution: "That the City Council of Wichita Falls be urged to adopt immediately the proposed ordinance prepared by City Attorney J. Walter Friberg regulating traffic upon the public streets'of the City of Wichita Falls, Texas and repealing all other ordinances and sections of ordinances in conflict therewith." Members of the Citizens Safety Council, the Police Department and other civic leaders have had the opportunity to assist in the study of this proposed ordinance, and the members of the Citizens Safety Council believe that it is a definite step in the right direction to eliminate confusion on the part of out-of-town motorists . and to provide an easily read and understandable ordinance governing vehicular traffic in our city. The above and foregoing report of the Citizens Safety Council was read to the Board of Aldermen, whereupon the following motion was had: ORDINANCE NO. 1641 AN ORDINANCE REIUTATING TRAFFIC UFON THE PUBLIC STREETS OF THE CITY OF WICHITA FALLS, TEXAS, AND REPEALING ALL OTHER ORDINANCES AND SECTIONS OF ORDINANCES IN CONFLICT HEREWITH. Moved by Alderman Mason that Ordinance No. 1641 be approved and passed as read. Motion seconded by Alderman Cox and carried by the following vote: Yeas: Aldermen Willis, Hammond, Cox, Montgomery and Mason. Nays: None. Motion seconded by Alderman Willis and carried. 286 Moved by Alderman Mason that the Board of Aldermen authorize the issuance of ,5 a permit to the Chamber of Commerce to'install to safety signs approximately 7' x 4 9' at the following locations, providing the same are installed in accordance with re- quirements of the City Engineer, with further provision that erection of the said signs meets with approval of the State Highway Departments 5th & Taylor, at the Intersection of Seymour Highway At the Intersection of Iowa Park Highway and the Old Iowa Park Road on the South side. Motion seconded by Alderman Hammond and carried. Moved by Alderman Cox that the Moor be and he is hereby authorized to limit debate or discussion upon any subject by any person or parsons speaking for the public at any meeting of the Hoard of Aldermen held in the Council Chamber of the Memorial Auditorium Building. Moved by Alderman Montgomery that the Board of Aldermen authorize the Cc issuance of a permit to the First Presbyterian Church to erect a basket ball goal ?> post in the alley adjacent to their parking lot on llth St. Motion seconded by Alderman Willis and carried. Moved by Alderman Montgomery that the Board of Aldermen authorize the issuance 4 of a permit to Tru Vu Appliance Company to erect a sign on the outer edge of the canopy °? in front of their building located at-1104 - llth St., providing the same is installed in accordance with requirements of the City Engineer. Motion seconded by Alderman Mason and carried. City Attorney, J. Walter Friberg, Chairman of the City Traffic Committee, gave a verbal report to the effect that the Traffic Committee had requested that the v practice of the public in leaving a coin partir.11y inserted in parking meters for policemen to register an additional hour of parking, and other similar'practices, be discontinued, thereupon the following motion was had: Moved by Alderman Mason that the Board of Aldermen endorse the recommendation of the City Traffic Committee aforesaid and direct that the Police Department be notified to enforce the parking meter ordinances. ORDINANCE NO. 1642 AN ORDINANCE REGULATING AND RESTRICTING THE STORAGE, HANDLING, TRANSPORTATION, SALE, DIS PENS ING AND USING OF LIQUEFIED PETROLEUM GAS; DEFINING TERNS; PRESCRIBING STANDARDS FOR THE INSTALLATION OF EQUIPMENT AND MATERIALS AND FOR HANDLING LIQUEFIED PETROLEUM GAS; LIMITING THE AREAS IN WHICH IT MAY BE TRANSPORTED OR USED; PROHIBITING I15 USE FOR DOMESTIC, COMMERCIAL OR INDUSTRIAL PURPOSES ON PREMISES, ANY PART OF WHICH IS WITHIN ONE HUNDRED (100) FEET OF A NATURAL GAS DISTRIBUTION LINE; PROVIDIG FOR THE ABATEMENT OF NUISANCES RESULTING FROM DEFECTIVE EQUIPMENT OR MATERIALS OR FROM IMPROPER METHOIS OF HANDLING LIQUEFIED PETROLEUM GAS; REQUIRING LICENSES, PERMITS, INSPECTIONS AND TESTS; REPEALING PROVISIONS IN CONFLICT; RESERVING A SAVINGS CLAUSE; AND PROVIDING PENALTIES FOR VIOLATIONS. I,. 287 ORDINANCE NO. 1643 AN ORDINANCE REGULATING SOLICITORS, PEDDLERS, HAWKERS, ITENERANT MERCHANTS OR TRANSIENT VENDORS OF MERCHANDISE IN THE CITY OF WICHITA FALLS, TEXAS, AND DECLARING IT TO BE A NUISANCE FOR THCSE ENGAGING IN SUCH PURSUITS TO GO IN OR UPON PRIVATE RESIDENCES WITHIN THE CITY OF WICHITA FALLS, TEXAS, WITHOUT HAVING BEEN REQUESTED OR INVITID TO DO SO, FOR THE PORDCSE OF SOLICITING ORDERS OR THE SALE OF GOODS OR MER- CHANDISE; PROVIDING PENALTIES FOR THE VIOLATION HEREOF, AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH. ORDINANCE NO.16111 AN ORDINANCE PROHIBITING DANCE HALL PERMIT WITHIN THE CORPORATE LIMITS OF THE CITY OF WICHITA FALLS ON ANY PREMISES AT WHICH A LICENSE TO SELL INTOXICATING BEVERAGES bF ANY KIND OR CHARACTER IS HELD UNDER THE TEXAS CONTROL ACT, AND CANCRT.i.TNG ANY PRESENT DANCE HALL PERMIT ISSUED UNDER ORDINANCE 427, AS AMENDED; IN THE EVENT THAT EITHER WHISKEY, WINE OR BEER IS SOLD ON SUCH PREMISES EITHER LEGALLY OR ILLEGALLY, WITH OR WITHOUT A PERMIT UNDER THE TEXAS LIQUOR CONTROL ACT. Moved by Alderman Willis that the Board of Aldermen authorize payment to Hairston-Best Lumber Co. the sum of $1527.94, being payment due May 1, 1953, on a • water main contract entered into by and between Hairston-Best Lumber Co. and the City of Wichita Falls, August 2, 1951, and direct the City Clerk to draw a check for the same. Motion seconded by Alderman Montgomery and carried. Moved by Alderman Willis that the Board of Aldermen authorize payment to W Mrs C. A. Gillespie the sum of 8251.67, being payment due May 1, 1953, on a water main contract entered into by and between Mrs C. A. Gillespie and the City of Wichita Falls August 13, 1953, and direct the City Clerk to draw a check for the same. Motion seconded by Alderman Cox and carried. Moved by Alderman Mason that the Board of Aldermen authorize the issuance , of Certificate of Convenience and Necessity to Wichita Rent-A-Van Company Inc. of Wichita Falls, Texas, to operate two driverless rent vans upon the streets of the City of Wichita Falls, Texas, when and at such time as the necessary bonds or insur- ance policies lecrequired by the terms of the Ordinance governing driverless motor vehicles have been furnished to the City Clerk. Motion seconded by Alderman Cox and carried. Moved by Alderman Mason that the Board of Aldermen authorize the execution 1 /of a contract by and between the City of Wichita Falls and the State of Texas, acting by and through the Board of Texas-State Hospitals and Special Schools, for the sale of water from Lake Kickapoo to the State of Texas for the Wichita State Hospital, upon the terms and conditions stated In said contract, and to authorize and empower Mayor f'\11 �c4 288 Kindel Faulk to execute the same for and on behalf of the City of Wichita Falls, Texas. Motion seconded by Alderman Willis and carried. Moved by Alderman Hammond that the Board of Aldermen authorize a tax refund to S/Sgt Paul J. Dehner the sum of $4.80 for personal taxes paid in 1952, which was collected contrary to recent Supreme Court ruling; further to direct the City Tax Assessor and Collector to refund the same. Motion seconded by Alderman Montgomery and carried. Moved by Alderman Willis that the application of Glynn L. Harris to purchase a city-owned small triangle of land at Ave A&Tyler for a consideration of $500.00, or a tract located at 10th &Hayes for a consideration of $700.00, be refused and denied. Motion seconded by Alderman Hammond and carried. Moved by Alderman Mason that the City Attorney be authorized and directed to advertise for bids for the sale of a tract of land between Brook and Holliday Streets, south of Fifth Street Highway; a small tract of land at Tyler and Ave A in Lot 1, Block 34, Floral Heights Addition; also a small triangle of laid at 10th & Hayes St., providing the City Attorney, upon investigation, finds the City can legally dispose of the same; with further provision that sale of the above described meets with approval of the Park Board. Motion seconded by Alderman Willis and carried. AMENDMENT TO PERSONNEL RULES: Section 10, Sick Leave, as published in the Personnel Rules is hereby rescinded and the following substituted therefore. Section 10, Sick Leave (Issuance date of amendment: May // , 1953). 1) Employees shall be allowed a total of sick leave with full pay computed upon a basis of 1 full working day allowed for each full month employed in a calendar year, with an extra day added for each 4 months, so as to ,total 15 working days to an employee's credit each 12 months. 2) Sick Leave Cumulative. Employees shall be allowed to accumulate 15 working days of sick leave.with pay in 1 calendar year. Sick leave with pay may be accumulated to a total not exceeding 90 days with the privilege of an ex- tension of sick leave in case of exhaustion of time, providing that the em- ployee can conclusively prove that such illness was incurred while in the performance of his duties. Sick leave may be granted only for absence from duty because of personal illness. 3) In the event that an employee for any reason leaves the service, he shall remain on the payroll until his accumulated sick leave is all used. 4) Employees who are absent from work because of illness must be responsible for having their absenteeism reported to their Department Head by 9:00 A.M. on the day of absence. Any employee who fails to make such report in accord- ance with this provision may be penalized by having the leave charged to leave without pay. The absenteeism because of illness of employees shall be spot checked from time to time. 5) The provisions of this section shall be retroactive to the date of current employment, or to April 1, 1948, whichever date is closer. These provisions shall apply only to those who are in the employ of the City on the date of issuance of this amendment and shall not, in any manner, apply to those who save terminated their services with the City prior to the issuance date of this amendment. Moved by Alderman Mason that the above and foregoi.88 Amendment to Personnel rules be approved and adopted in its entirety. 0C Motion seconded by AldermanWillis and carried. ip 289 RESOLUTION NO. 236 STATE OF TEXAS WICHITA COUNTY WHEREAS, in 1940, the Young Women's Christian Association began the building of certain improvements upon its property at 801 Burnett Street, Wichita Falls, Wichita County, Texas, being all of Lots Nos. Twelve (12), Thirteen (13), and Fourteen (14) in Block No. One Hundred Seventy-one (171) of the Original Town of Wichita Falls, Wichita County, Texas, raising funds therefor by private subscription, and lacking enough money to complete said building, applied to the Federal Government for a WFA grant, in order to complete same, and in order to comply with the regulations of the Federal Government it became necessary to convey the legal title to said property to the City of Wichita Falls, Texas, which was done by deed dated February 1, 1940, recorded in Volume 372, page 615, Deed Records of Wichita County, Texas, and said improve- ments were completed and accepted; and, WHEREAS, since the completion and acceptance of the improvements on the above described property the Young Women's Christian Association has been in possession of and operating said property as a Young Women's Christian Association; and, WHEREAS, the City of Wichita Falls, Texas, has determined that the project for which Federal assistance was granted has served the purpose for which Federal assistance was granted, viz., the relief of unemployment, and that there is no longer any necessity for the title to said property to remain in the City of Wichita Falls, and that the title to said property should be vested in the Trustees of the Young Women's Christian Association: NOW, THEREFORE, BE IT RESOLVED, by the Board of Aldermen of the City of Wichita Falls, Texas, that the project for which Federal assistance was granted has served its purpose, and that there is no longer any necessity for the title to said property to remain in the City of Wichita Falls, the Mayor is hereby instructed to convey the title to said property to the Trustees of the Young Women's Christian Association, and that he is fully authorized and empowered to execute such instruments • as may be necessary to convey the title to said property from the City of Wichita Falls to the Trustees of the Young Women's Christian Association. Moved by Alderman Mason that a letter be written to the Chairman of the Medical Board of the General Hospital, expressing thanks and appreciation to the Medical staff, the resident Physicians, and all others who assisted in the prepara- f tion of the splendid and informative comparative report for the years 1951-1952 and 1953,'together with other valuable information recently furnished the council; such letter to be written when the report has been released for publication.
