Min 10/13/1952 ♦, a 219 Wichita Falls, Texas Memorial Auditorium Building October 13, 1952 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date, in the Council Room of the Memorial Auditorium Building, at 7-30 o'clock P.M., with the following members presents Kindel Faulk Mayor Lloyd Thomas Francis L. Harvey Dr. E. Aubrey Cox 1 Aldermen Henry D. Mason Geo. T. Henderson City Clerk Bill N. Taylor City Manager J. Walter Friberg City Attorney Moved by Alderman Harvey that the Minutes of the regular meeting held September 22, 1952, be approved. Motion seconded by Alderman Thomas and carried. Moved by Alderman Harvey that the plat of Hilltop Estates Addition be adopted and approved, a copy of which is attached hereto and made a part of the records hereof. Motion seconded by Alderman Mason and carried. ORDINANCE NO.1628 AN ORDINANCE AMENDING AN ORDINANCE PASSED THE FOURTEENTH DAY OF MAY, 1951, BY THE CITY COUNCIL OF THE CITY OF WICHITA FATJS, REGULATING RATES FOR TELEPHONE SERVICE IN SAID CITY. The Public Hearing on Ordinance No. 1628, set for this date, was not held and no action taken. Moved by Alderman Cox that the Board of Aldermen authorize the issuance of a permit to the Texas Company to install 1-3000 and 1-4000 gal. underground gasoline storage tanks at 3015 Grant St., provided the above installations are made in accord- ance with requirements of the City Engineer. Motion seconded by Alderman Thomas and carried. Moved by Alderman Thomas that the Board of Aldermen authorize the issuance of a permit to the Continental Supply Co. to erect a sign on a pole between the curb and sidewalk at their place of business 402 - 7th St., provided the same is installed in accordance with requirements of the City Engineer. It is distinctly understood and agreed that this permit shall expire one year from date hereof and the City may cause removal of the said sign after a period of one year by giving notice in writing 30 days in advance of request for removal. Motion seconded by Alderman Cox and carried. Moved by Alderman Mason that the Board of Aldermen authorize the issuance of a permit to 7th St. laundry to erect a sign on a pole, between the curb and sidewalk, at 1007 - 7th St., providing the same is installed in accordance with requirements of the City Engineer. It is distinctly understood and agreed that this permit shall expire one year from date hereof, and the City may cause removal Et of the said sign after a period of one year by giving 30 days notice in writing prior to request for removal. Motion seconded by Alderman Cox and carried. 220 • - Moved by Alderman Thomas that in accordance with the recommendation of the e Traffic Commission, a permit be issued to Downing Floral Company to widen the pavement in front of their place of business at 2236 Brook Street for parallel parking, and to construct a sidewalk immediately adjacent to the curb instead of its normal place, provided all of the above construction is done in accordance with requirements of the City Engineer. Motion seconded by Alderman Mason and carried. The request of the Northwest Texas Field &Stream Association et al for the City to take immediate action to construct a place at Lake Wichita where young boys and girls could fish from the bank, was read to the Council by Mayor Kindel . Paulk, thereupon by common consent of the Council the matter was referred to Alderman Cox to confer jointly with the Park Department and so advise the Committee. Moved by Alderman Mason that necessary steps be taken to consolidate theI' city and county Health offices. Seconded by Alderman Cox, whereupon after further consideration, Alderman Mason, with consent of the second, withdrew the motion. Moved by Alderman Harvey that the Mayor be authorized to appoint a Committee to confer with the County Commissioners Court for the purpose of formulating plane to care for convalescent patients at the County Farm. Motion seconded by Alderman Thomas and carried. Mayor Kindel Faulk appointed Aldermen Cox and Harvey to serve on the above mentioned committee. Moved by Alderman Mason that the Board of Aldermen authorize payment to Morningside Estates, Inc. the sum of $781.95, being payment due August 1, 1952, by virtue of a water main contract in East Morningside Addition entered into by and between Morningside Estates Inc. and the,City of Wichita Falls, October 10, 1949J further to direct the City Clerk to draw a warrant for the,same. Motion seconded by Alderman Thomas and carried. Moved by Alderman Thomas that the Board of Aldermen approve and authorize payment to Southmoor Manor, Inc. the sum of $1571.73, being payment due September 1, 1952, on a Water Main Contract in Southmoor Manor Addition, by virtue of a water main contract entered into by and between Southmoor Manor, Inc. and the City of Wichita Falls August 28, 1950j further to direct the City Clerk to draw a warrant for the same. Motion seconded by Alderman Cox and carried. As advertised, bids were opened for the sale by the City of Wichita Falls of an oil and gas lease covering approximately 207 acres of land adjacent to Lake Kickapoo. The bids were as follows: G. E. Kadane &Sons, Wich&taFalls, Texas, $2,500400, upon the terms and conditions as follower City Clerk, City of Wichita Falls, Tex. Please accept this letter as the bid of the firm of G. E. Kadane &Sons as the bonus consideration for an oil and gas lease for a term of five years from the date of your execution and delivery of the said lease covering approximately 207 acres of land in Archer County, Texas, and being part of the Lake Kickapoo tracts. This bid is made with the presumption that the form of the oil and gas lease to be executed and delivered to the successful bidder by the City of Wichita Falls will be the same form as originally prepared and delivered to the City of Wichita Falls by the firm of Kilgore and Kilgore, Dallas, Texas. , 221 The consideration which this firm agrees to pay to the City of Wichita Falls in cash upon the execution and delivery of an oil and gas lease of the above land and on the form as described herein shall be $2,500.00. In the event that this bid is not accepted by the City of Wichita Falls on the opening of the bid as described in the ad- vertisement on October 13, 1952, then this firm shall have the right to withdraw the bid at any time thereafter and this firm shall be under no further obligation. In the event we are the successful bidder on October 13, 1952, we will appreciate it if you will notify us promptly. Yours very truly, G. E. Kadane &Sons, /s/ F. E. Robertson Moved by Alderman Harvey that the Board of Aldermen accept the bid of G. E. Kadane &Sons for the oil and gas lease at Lake Kickapoo when and at such time a clause is inserted in the oil and gas lease requiring that all salt water from any and all wells be put back into the ground. Further to authorize and empower Mayor Kindel Faulk to execute the said oil and gas lease for and on behalf of the City of Wichita Falls. Motion seconded by AldermanCox and carried. ORDINANCE NO.1626 AN ORDINANCE ADOPTING A BUDGET FOR THE ENSUING FISCAL YEAR, BEGINNING OCTOBER 1, 1952, AND ENDING SEPTEMBER 30, 1953, IN ACCORDANCE WITH THE CHARTER AND ORDINANCES OF THE CITY OF WICHITA FALLS, TEXAS. Moved by Alderman Mason that Ordinance No. 1626 be approved and passed on its second and final reading. Motion seconded by Alderman Harvey and carried by the following vote: Yeas: Aldermen Thomas, Harvey, Cox and Mason. Nays: None. ORDINANCE NO.1629 AN ORDINANCE LEVYING, ASSESSING AND FIXING THE TAX RATE FOR THE USE AND SUPPORT '0F THE MUNICIPAL GOVERNMENT OF THE CITY OF WICHITA FALLS, TEXAS, AND PROVIDING FOR THE INTEREST AND SINKING FUND FOR THE FISCAL YEAR 1952-53, AND APFORTIONING EACH LEVY FOR THE SPECIFIC PURPOSE AND PROVIDING FOR THE ASSESSMENT OF ALL ANNUAL OCCUPATIONAL TAXES FROVIDED HY LAW. Moved by Alderman Harvey that Ordinance No. 1629 be approved and passed as read. Seconded by Alderman Cox and carried by the following vote: Yeas: Aldermen Thomas, Harvey, Cox and Mason. Nays: None. Moved by Alderman Mason that the Board of Aldermen approve and authorize ;that surety bonds for all employees be cancelled and re-written for a period of three years, thereby creating a substantial saving, and further, to approve and authorize the City Manager and City Clerk to transfer the sum of $1200.00 from the Contingent Appropriation Account to Account No. 90 F-3b to cover the three year premium. Motion seconded by Alderman Harvey and carried. Moved by Alderman Harvey that the Board of Aldermen authorize a transfer of $3500.00 from the Contingent Appropriation Account to Account No. 311 Z-2, for the purpose of purchasing a bulldozer for the Garbage Department. Motion seconded by Alderman Cox and carried. 222 Moved by Alderman Thomas that the Board of Aldermen authorize the City Tax Assessor and Collector to lower the 1951 tax value on lots i1 & 15, Block 2, Ed Wilson Addition, from$1620.00 to $1100.00; further to authorize the personal tax of F. L. Cruse Tire Co. to be reduced from $420.00 to $339.09 for the year 1951, bye virtue of an error by the Tax Department in assessing the property at 100% whereas the same should have been 65%,and waive all penalty and interest. Motion seconded by Alderman Cox and carried. Moved by Alderman Thomas that the Board of Aldermen approve and authorize the execution of an Easement and Right-Of-Way to the Texas Electric Service Co., for the erection of poles and guys in the vicinity of Lake'Kickapoo, for the purpose of serving designated cabin sites, or future cabin sites, along the south shore of Lake Kickapoo, and upon the terms and conditions recited in the said Easement and Right-of-Way; further to authorize and empower City Manager Bill N. Taylor to execute the same for and on behalf of the City. Motion seconded by Alderman Cox and carried. • Moved by Alderman Mason that the City Clerk be authorized and directed to make payroll deductions for city employees who may so desire, for contributions to the Community Chest. Motion seconded by Alderman Harvey and carried.
