Min 09/08/1952 208 Wichita Falls, Texas Memorial Auditorium Building September 8, 1952 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date, in the Council Room of the Memorial Auditorium Building, at 8:00 o'clock P.M., with the following members present: AMP Lloyd C. Thomas Francis L. Harvey Dr. E. Aubrey Cox k Aldermen J. Paul Montgomery Henry D. Mason Geo. T. Henderson City Clerk Bill N. Taylor City Manager J. Walter Friberg City Attorney Moved by Alderman Montgomery that Alderman Lloyd Thomas be elected Mayor. Protem for this meeting. Motion seconded by Alderman Mason and carried. The'Minutes of the regular meeting held August 11, 1952, were approved. Moved by Alderman Montgomery that the Board of Aldermen authorize and direct the City Tax Assessor and Collector to waive penalty and interest, and accept the sum of $72.38 as payment in full, covering Lot 9, Block 10, Sibley Taylor Addition for 1951 and prior years. . Motion seconded by Alderman Mason and carried. Mrs E. A. Allen requested the Council to take some action to eliminate a nuisance created by barking dogs at the Burrus Veterinary Hospital, located at 2108- 5th, whereupon Mrs. Allen mas advised this is a matter over which the City has no jurigAiction. Moved by Alderman Harvey that action on the proposed Garbage Ordinance be deferred until the next regular meeting, to be held September 22, 1952. Motion seconded by Alderman Mason and carried. Moved by Alderman Cox that a Committee be appointed to formulate Building, Plumbing and Electrical Codes for the City, and present the sane to the Council for consideration. Motion seconded by Alderman Harvey and carried. RESOLUTION NO.220 BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: WHEREAS, the City has heretofore issued certain time warrants against antici— pated revenues, said Warrants being Nos. 1, 2, 3 and 4, totaling an amount of $21.4,000.00, and, WHEREAS, such anticipated revenues having failed to materialize on or before the due date of such Time Warrants, and, WHEREAS, it is mutually desirable that said Warrants be extended to November 15, 1952, the same to bear the same rate of interest and on the same terms and conditions as originally issued; NOW, THEREFORE, BE TT RESOLVED THAT the City Manager is hereby-authorized to enter into a contract extending the due date of the above numbered.Time Warrants to on or before November 15, 1952, such contract to be negotiated with the City National 209 Bank, Wichita Falls, Texas, the owner and holder of such warrants, and the same are to be paid on or before November 15, 1952, under the same terms and conditions as originally issued except for the new due date. Moved by Alderman Mason that Resolution No. 220 be adopted and passed as read. Motion seconded by Alderman Harvey and carried by the following vote: !; Yeas: Aldermen Harvey, Cox, Montgomery and Mason Nays: None. -- ORDINANCE NO.1626 AN ORDINANCE ADOPTING A BUDGET FOR THE ENSUING FISCAL YEAR, BEGINNING OCTOBER 1, 1952, AND ENDING SEPTEMBER 30, 1953, IN ACCORDANCE WITH THE CHARTER AND ORDINANCES OF THE CITY OF WICHITA FAILS, TEXAS. Movedi by Alderman Harvey that Ordinance No. 1626 be approved and passed on its 1st reading, and that a Public Hearing be held on the same in the Council Room of the Mem. Aud. at 10:00 A.M. Sept. 22, 1952. Motion seconded by Alderman Mason and carried by the following vote: Yeas: Aldermen Harvey, Cox, Montgomery and Mason. Nays: None. Moved by Alderman Harvey that the Board of Aldermen authorize the issuance of a permit to A. H. Fell to install an air conditioner over the front door at 808- � 7th St., providing that same is installed in accordance with requirements of the City Engineer. It is expressly understood this permit shall expire October 1, 1952. Motion seconded by Alderman Montgomery and carried. Moved by Alderman Harvey that the Flat of Tom E. Harwell be approved as ✓ V to street width only. Motion seconded by Alderman Montgomery and carried. Moved by Alderman Harvey that the Motion, duly made and seconded, to defer action upon the proposed Garbage Ordinance until the next regular meeting, be and is hereby rescinded. Motion seconded by Alderman Cox and carried. ORDINANCE NO. 1627 AN ORDINANCE DEFINING THE VARIOUS KINIS OF GARBAGE, REGULATING THE KINIS AND SIZE OF RECEPTACLES IN WHICH TO PLACE SAME, THE MANNER OF ITS PREPARATION AND WHERE IT MUST BE PLACED TO BE COT,LFCTED BY THE CITY GARBAGE DEPARTMENT; . PROVIDING REGULATIONS FOR COLLECTION OF SAME AND PROHIBITING THE PLACING OF GARBAGE OR ANY ARTICLE OR MATERIAL IN THE STREETS AND ATJ FYS OF THE CITY OF WICHITA FALLS, TEXAS; PROVIDING THE SERVICE CHARGES, AND A METHOD OF BILLING AND COLLECTION OF THE FEES; PRO'rIIBITING THE MEDDLING, SCATTERING CONTENTS, PILFERING OR JUNKING WITH GARBAGE CANS, TRASH,OR RUBBISH RECEPTACLES; PROHIBITING JUNKING OR CARRYING OFF THE PREMISES OF THE DUMP GROUND ANY ARTICLE OR JUNK; PROHIBITING THE COT•T,FPTION OF GARBAGE, TRASH OR RUBBISH BY OTHERS THAN CITY FORCES WITHIN THE CITY LIMITS; DESIGNATING CERTAIN CITY OFFICIALS WITH THE AUTHORITY OR ENFORCEMENT OF THE PROVISIONS OF THIS ORDINANCE; AND PRESCRIBING PENALTIES; AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH. 1111 Moved by Alderman Cox that Ordinance No. 1627 be approved and passed as read. Allen, Chairman of the Sanitation & Health DivisiOaLof the Citizens Committee, for the splendid work performed in connection with survey made of the Garbage Department, and recommendations made in connection therewith. Moved by Alderman Mason that the contract for auditing the records of the City of Wichita Falls for the fiscal year ending September 30, 1952, be awarded to J. B. Allred & Company for the sum of $2000.00. Motion seconded by Alderman Montgomery and carried. Moved by Alderman Harvey that the Board of Aldermen approve and authorize payment to Hairston Best Lumber Co. the sum of $600.79, being payment due May 1, 1952, on a water main contract for the John W. Thomas Subd., entered into by and between the said Hairston Best Lumber Co. and the City of Wichita Falls Aug. 2, 1951; further to direct the City Clerk to draw a warrant for the same. Motion seconded by Alderman Montgomery and carried. Moved by Alderman Mason that the Board of Aldermen approve and authorize payment to E. E. Cloer the sum of $1098.81, being payment due Aug. 1, 1952, an a water main contract in Wichita Manor, entered into by and between the said E. E. Cloer and the City of Wichita Falls January 9, 1950; further to direct the City Clerk to draw a warrant for the same. Motion seconded by Alderman Montgomery and carried. Moved by Alderman Montgomery that the Board of Aldermen approve and authorize payment to Morningside Estates, Inc. and/or Paul Theim Jr., Secretary, the sum of $1902.61, being payment due August 31, 1952, on a water main contract, for Inglewood Addition, entered into by and between the said Morningside Estates, Inc., and/or Paul Theim, Jr., Secy., and the City of,Wichita Falls October 10, 1949; further to direct the City Clerk to draw a warrant for the same. Motion seconded by Alderman Mason and carried. Moved by Alderman Harvey that the Board of Aldermen approve and ratify the action of the City Manager and City Clerk for payment to Wichita General Hospital the sum of $6858.78 August 27, 1952, for charity patients for the month of July, 1952. Motion seconded by Alderman Montgomery and carried. Moved by Alderman Mason that permission be granted to Tex-Ad Company for additional bus stop advertising benches or use for rotation purposes for benches already in operation, at the following locations: 2000 Blk Harrison, west side, approx. 50 ft.from entrance street to Wichita Manor Apartments, and adj. to a vacant lot. Motion seconded by Alderman Harvey and carried. fi 211 The following report was read to the Board of Aldermen by the City Clerk: Honorable Mayor &Board of Aldermen: Gentlemen: Pursuant to your request, we, the undersigned, have audited the books of the Tex-Ad Co. and find that all receipts have been property accounted for through the month of June, 1952, and they have remitted the proper amount to the City of Wichita Falls. s Geo. Henderson, City Clerk /Wa Waiter Friberg, City Attorney Moved by Alderman Mason that the Board of Aldermen approve and authorize the execution of a Water Main Contract, Joe Farabee Addition, Surrey Circle Subdivision, by and between Joe H. Farabee and the City of Wichita Falls, in the amount of $1013.57, upon the terms and conditions therein stated, and to authorize and empower Mayor Protein Lloyd C. Thomas to execute the said contract for and on behalf of the City of Wichita Falls. Motion seconded by Alderman Montgomery and carried. Moved by Alderman Mason that the advertising for bids for the sale of an oil and gas lease on the south side of Lake Kickapoo be deferred until the next regular meeting to be held September 22, 1952. Motion seconded by Alderman Harvey and carried. Moved by Alderman Harvey that the motion duly made, seconded and passed, as of this date, to approve the plat of Tom E. Harwell, as to street width only, covering �xrc. that certain property lying north of the Continental Refinery and immediately adjacent to the City Limits, be and is.hereby rescinded. Motion seconded by Alderman Montgomery and carried. Moved by Alderman Montgomery that the meeting be adjourned. Motion seconded by Alderman Mason and carried.
