Min 10/11/1948 h s • / 536 THE STATE OF TEXAS COUNTY OF WICHITA CITY OF WICHITA FALLS : On this the llth day of October, 1948, the Board of Aldermen of the City of Wichita Falls, Texas, convened in Regular meeting at the regular meeting place, with the following members present, to-wit: Harold Jones, Mayor, C. A. Spragins, (S Edward G. Kadane E. J. I-;'ininger Aldermen, J. R. Ray John C. Coffey � also present were: George T. Henderson, City Clerk, George Fai rtrace, City Manager Kearby Peery, City Attorney, and with the following absent: Mr. B. C. Hunter, constituting a quorum, at which time the following proceedings were had: Alderman Spragins presented for the consideration of the Board of Aldermen a resolution. Alderman Spragins made a motion that the resolution be adopted finally. The motion was seconded by Alderman Coffey. The motion was carried by the following vote: YEAS: Aldermen Spragins, Kadane, Wininger, Ray, Coffey and Mayor Jones. NAYS: None. The resolution as adopted is as follows: RESOLUTION NO. 26 BY THE BOARD OF ALDIdiV riN OF THE CITY OF WICHITA FALLS, TEXAS, CALLING AN ELECTION ON THE QUESTION OF THE ISSUANCE OF $250,000.00 WATERWORKS SYSTEM BONDS; ON THE QUESTION OF THE ISSUANCE OF $250,000.00 SANITARY ShliER SYSTEPI BONDS, AND ON THE QUESTION OF THE ISSU- ANCE OF $5001000.00 ShXER IMPhOVE�,IENT tiND EXTENSION REVNUF. BONDS. WHAS, the Board of Aldermen of the City of Wichita Falls, Texas, deems it advisable to issue the bonds of said City for the purposes hereinafter mentioned; TEXAS: BE IT RESOLVED BY Tlii� BOARD OF ALD21i, 1EN OF THE CITY OF 4ICHITA FALLS, 1. That an election be held in said City of Wichita Falls, Texas, on the 9th day of Nove,-aber, 1948, at which election the following propositions shall be submitted: PROPOSITION NO. 1 "Shall the Board of Aldermen of the City of Wichita Falls, Texas, be authorized to issue the bonds of said City in the amount of Two Hundred Fifty Thousand (4250,000.00) Dollars, maturing serially in such installments as may be fixed by the Board of Aldenien, the maximum maturity date being not more than Thirty (30) years from their date, and bearing in- terest at a rate not to exceed Four (4%) per cent per annum, payable annually or semi-arrivally, and to levy a tax sufficient to pay interest as it accrues and principal as it matures on said issue of bonds, for the purpose of constructing, repair- ing, improving and extending the water works of said City, as authorized by the Constitution and laws of the State of Texas." 537 s `; O PitOPOSITION NO. 2 "Shall the Board of Aldermen of the City of Wichita Falls, Texas, be authorized to issue the bonds of said City in the amount of Two Hundred Fifty Thousand ($250,000.00) Dollars, maturing serially in such. installments as may be fixed by the Board of Aldermen, the maximum maturity date being not more than Thirty (30) years from their date, and bearing in- terest at a rate not to exceed Four (4%) per cent per annum, payable annually or semi-annually, and to levy a tax sufficient to pay interest as it accrues and principal as it matures on said issue of bonds, for the purpose of constructing, repair- ing, improving and extending the sanitary sewers of said City, as authorized by the Constitution and laws of the State of Texas." PttOPOSITION 140. 3 "Shall the Board of Aldermen of the City of Wichita Falls, Texas, he authorized to issue the bonds of said City in the amount of Five Hundred Thousand (9500,000.00) Dollars, maturing serially in such installments as may be fixed by the Board of Aldermen, the maximum maturity being not more than Twenty Five (25) years from their date, bearing inter- est at a rate not to exceed Four (4%) per cent per annum, for the purpose of constructing improvements and extensions to the sanitary sewer system of said City, to be issued in accordance with and secured in the ;canner provided in Arti- cles 1111-1118, both inclusive, of the Revised Civil Statutes of Texas, 1925, as amended, each bond to be conditioned that the holder thereof shall never have the right to demand pay- ment of said obligation out of funds raised or to be raised by taxation, secured by a pledge of the net revenues from the operation of said system." 2. A substantial copy of this resolution signed by the Mayor of said City and attested by the City Clerk shall serve as proper notice of said election. Notice shall be given in accordance with Article 7U4, Re- vised Civil Statutes of 1925, as amended by Chapter 382, passed at the First Called Session of the Forty Fourth Legislature, supra. The Mayor is authoriz- ed and direct4d to have a cope of said notice posted at the City Hall and at a public place in each of the voting precincts within said City, not less than fifteen days prior to the date fixed for holu.ing said election. He shall also cause said notice to be published on the same day in each of two successive weeks in a newspaper of general circulation published within said City, the date of the first publication to be riot less than fourteen days prior to the date set for said election. Except as otherwise provided in said Article 7U4, as amended, the manner of holding said election shall be governed by the laws governing general elections.
