Ordinance Closing And Abandoning An Approximately 6,927 Square
Foot Alley Behind 4923 Lake Park Drive Subject To The Retention Of
All Utilities And Easements In The Alley
WHEREAS, Dan Mowery, with Lake Park Resources, LLC, the owners of 4923
Lake Park Drive, has requested the City close, vacate and abandon the alley located
behind said property between Lake Park Drive and Southwest Parkway; and
WHEREAS, all affected City departments have reviewed this request and have
recommended conditional approval to close, abandon, and vacate this alley, subject to
retention of the entire area as a utility easement; and
WHEREAS, it has been determined to be in the best public interest to close,
vacate, and abandon said alley as herein indicated on the attached Location Map and
Exhibit "A."
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
1. The alley located behind 4923 Lake Park Drive, as described above and as
depicted in the attached Location Map and Exhibit "A" consisting of approximately
6,927 square feet, is hereby closed, abandoned, and vacated, subject to the retention
of a utility easement covering the entire area of the aforementioned alley.
2. In consideration of the receipt of $6,927.00 for the cost of the property, plus
$300.00 for the cost of the appraisal and the retention or dedication and relocation of
utilities and easements, this ordinance shall approve the closure of the aforementioned
alley.
3. The City Manager is authorized to execute a quitclaim deed to convey the
property with the retained utility easement.
