Ord 39-2012 8/7/2012 ORDINANCE NO. 39-2012 Ordinance Amending Table 6741 Of Appendix B, Zoning, Of The Code Of Ordinances Of The City Of Wichita Falls, To Modify Said Table And Add Note 10 Thereto To Allow An Institutional Sign Placed Within Residential And Limited Commercial Areas To Display A Message Using Electronic Light Impulses And Allow Up To Two Institutional Signs Per Street Frontage WHEREAS, institutions such as churches and schools within Residential and Limited Commercial zones have requested to display a digital message on their signs, and the community standard for institutions set prior to the adoption of the Zoning Ordinance is two signs per street frontage; and WHEREAS, it is deemed appropriate for one of the two signs per street frontage to display a message digitally; and WHEREAS, the Planning and Zoning Commission has reviewed this proposal and recommends approval of these amendments to the Zoning Ordinance; and WHEREAS, the City Council concurs with the Planning and Zoning Commission's recommendation to amend the Zoning Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: 1. Two signs per street frontage and Note 10 added Table 6741 Table 6741 of Appendix B of the Code of Ordinances of the City of Wichita Falls is hereby amended by deleting 1 per street frontage" under the Spacing column for an Institutional Sign type and adding "2 per street frontage", and adding Note "10" under the Special Requirement column for an Institutional Sign. Note 10 added to associated notes below Table 6741 The associated notes of Table 6741 of Appendix B of the Code of Ordinances of the City of Wichita Falls are hereby amended to add Note 10 in its proper numerical order, which shall read as follows: NOTE 10 One of the two allowed Institutional Signs per street frontage may display information related to the institution through electronically controlled intermittent light impulses provided that a 200-foot separation distance from a residential use is maintained. An exception to the 200-foot separation requirement shall apply if: 1 . Any image produced by the Institutional Sign remains static (no animation, movement, scrolling, or flashing) for a period of at least 5 seconds; or, 2. It can be reasonably demonstrated that the sign is not visible from any residential property within 200 feet of the sign. 3. Codification This ordinance amends the Code of Ordinances of the City of Wichita Falls and is intended to be part of said Code. Accordingly, the provisions of said Section may be renumbered or relettered to accomplish such intention. PASSED AND APPROVED this the 7t" day of August, 2012.
