LINE OF POLK STREET, AND EXTENDING 100 FEET EASt THEREFROLIJ RE-
SERVING UTILITY RIGHTS; AiaD DECLARING AN &IERGENCY,
WHEREAS, an application has been filed with the Board of
Aldermen of the City of Wichita Falls, Texas, requesting the
City Council to cancel and terminate the West 100 feet of an
alley ruining.East and West, and lying between Lots 2,3 and
Lots 4, 5, Block'107A, Highland Addition to the City of Wichita
Falls, Texas; and,
WHEREAS, a petition has been filed by all of the present
owners of the land adjoining said alley requesting that the same
be closed, and,
WHEREAS, it appears that said alley is not necessary to the
proper ingress and egress of said lots, or for city service of
any nature other than as a right of way for utility rights:
NOW, THEREFORE, BE IT ORDAID:ED BY THE BOARD OF ALDER1,1hN
OF THE CITY OF WICHITA FALLS, TEXAS:
SECTION 1: That the alley running East and West, lying
between the South.side of Lots 2 and 3, and the North side of
Lots 4 and 5, Block 107A, Highland Addition to the City of
Wichita Falls, Texas, and more particularly described as follows:
Beginning at the Northwest corner of Lot 4;
r..., Thence in an Easterly direction along the North
line of Lots 4 and 5 to the l:ortheast corner of Lot 5;
Thence North across said alley to the Southeast
corner of Lot 2;
Thence West along the South line of Lots 2 and 3
to the Southwest corner of Lot 3;
Thence South to the place of beginning; all in
Block 107A, Highland Addition to the City of Wichita
Falls, Texas, as shown in the plat and dedication records
of Wichita County, Texas,
be, and is hereby, closed and abandoned for public use; provided,
however, the City specifically reserves its easement for all
public utilities.
SECTION 2: The fact that the closing of said alley is
necessary to the proper adjustment of property in connection with
street improvements made in said block which are now in progress
creates an emergency, end the rule requiring the reading of
Ordinances on three separate days is hereby suspended, and this
ordinance shall take effect immediately upon its passage
and
approval. nae -

FIELD NOTES FOR CLOSING A PBRTION OF THE ALLEY IN
BLOCK 107A, HIGHLAND ADDITION, WICHITA FALLS, TEXAS
All that portion of the alley through Block 107A Highland
Addition of the City of Wichita Falls, Texas lying between Lots 20,
4, and 5 being that portion of a 20 foot alley beginning at the East
property line of Polk Street and extending 100 feet East therefrom.
