AN ORDINANCE CLOSING AND ABANDONING A PURPORTED NORTH -SOUTH
STREET OR ALLEY LYING NORTH OF FIFTH STREET AND EAST OF FILLMORE
STREET IN THE CITY OF WICHITA FALLS.
WHEREAS, there may exist a north -south street or alley lying north of
Fifth Street and east of Fillmore Street; and,
and,
WHEREAS, said street has never been opened or maintained for public use;
WHEREAS, the Planning Board of the City of Wichita Falls has recommended
to the Board of Aldermen that said purported street or alley be closed; and,
WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas deems
it advisable and in the public interest to close and abandon that street or alley
hereinafter described.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, TEXAS THAT:
SECTION 1. That north -south thirty (30) foot strip of right-of-way
lying west of a line more fully described as follows:
BEGINNING at a point in the north line of Fifth Street thirty (30)
feet east of the Southeast corner of the C. W. Morgan 21.3 acre
tract as described in Vol. 51, page 172 Deed Records of Wichita
County, Texas;
THENCE N Oo 15' E to intersection with the east right-of-way line
of Fillmore Street
be and the same is hereby closed and abandoned.
SECTION 2. The City of Wichita Falls; Texas hereby reserves a ten (10)
foot utility easement in said land for the purpose of maintaining electric power
lines. Said easement is that north -south ten (10) foot strip of land lying west of
a line more fully described as follows:
BEGINNING at the above described beginning point in the North Line of
Fifth Street;
THENCE N Oo 15' E 179.49 feet.
