The City Council of the City of Wichita Falls, Texas, met
in regular session on the above date in the Council Room of the
Memorial Auditorium Building at 8: 30 o' clock a.m. , with the
following members present:

Mayor Lam called the meeting to order.
The invocation was given by Mayor Michael Lam.

Moved by Councilor Johnston that the minutes of the August
29, 1995 and September 5 , 1995 meetings be approved.
Motion seconded by Councilor Shine.
Councilor Martin stated that his intention for the $3 fee
on fines was to be assessed only to persons who are tried by the
City Judge in Municipal Court, not persons coming in to pay
their fines without a trial. Mayor clarified, and Council
members concurred, that the intent for the $3 assessment would
be to anyone coming into the Municipal Court building whether to
pay their fines or to go to trial. Councilor Johnston commented
that the purpose of the fine is to pay for security being
provided for people in the Court due to the presence of other
people outside the Court. Councilor Martin agreed that the
minutes stand as submitted.

Mr. Steve Morath, on behalf of the Texas Economic
Development Council, presented a plaque to the Mayor recognizing
the City of Wichita Falls for its outstanding community efforts
of job growth by inspiring creativity, leadership and
partnership in economic development.
Item 6a
A public hearing was held on hazardous structures.
Mayor declared the public hearing open.
Jimmy Foster, 1921 Hampton, said he does not have the
necessary finances and asked the City to demolish the structure
for him. Jack Blair Estate is the lien holder on this property.
Mr. Jim King gave history on this property. He informed
that CDBG funds could be used to seek competitive bids to
demolish the structure. The City would then look to Mr. Foster
to repay the cost for the demolition and if he is unable to pay,
a lien could then be filed on the property. This can be
accomplished within thirty days. Council directed Mr. King to
proceed with demolition process.
Edward Shaw, owner of 302 Oriole Street, said he would
begin tearing the structure down today, weather permitting. Mr.
King presented history on this structure. Code Enforcement will
work with Mr. Shaw on a demolition permit. Mayor directed Mr.
Shaw to get with Mr. King to get this done. Mr. King informed
that the demolition permit would be good for thirty days from
issuance date, October 19, 1995.
Mrs. Smith represented her mother Martha Irving who is in
charge of the Jack Blair Estate, owner of 1000 Tulsa, 1018
Tulsa, and 1921 Hampton. Mrs. Smith said that Mr. Blair ' s estate
was tied up in probate. They would like to rehab these
structures in order to rent them. Mayor informed Mrs. Smith of
the need to be realistic in the financial commitment and
responsibility to rehab these structures and make them
habitable. Mayor instructed Mrs. Smith that if she had an
interest to upgrade those three properties that she get with Mr.
King for him to set up a time table for her to present a plan.
If Mrs. Smith is unable to meet Mr. King' s time table, City will
proceed within thirty days to demolish.
Gene Buchanan, owner 1013 Woods, said he had the sewer and
water lines put in and was working to remove the remainder of
the sheetrock. He said all the rooms had been done except for
one. Mr. King presented history on this structure and said this

had been going on for four years. Mr. Buchanan has not obtained
an electrical permit and the structure would need to be re-wired
entirely. There are no bracings on the floor and it still needs
a tremendous amount of work. Mr. Buchanan said he could be
finished within thirty days. The Council did not think this was
realistic from the information received today and the video
presented by Code. Mr. Buchanan was directed to get with Mr.
King today or tomorrow and present a plan to him. Mr. Buchanan
will be given thirty days from the time he meets with Mr. King
to complete the work entirely. If this is not done, demolition
will proceed without bringing it back to the Council.
No one else wished to be heard. Mayor declared the public
hearing closed.
Councilor Martin asked if a progress report had been
received on the structure located on Cape Cod.
Mr. King informed that they had not received one, but Code
Staff had prepared their own progress report and the owner is in
compliance with Council' s directive.
ORDINANCE NO. 98-95
ORDINANCE CLOSING HEARING AND FINDING CERTAIN
BUILDINGS AND/OR STRUCTURES TO BE DANGEROUS:
COMMANDING PROPERTY OWNERS TO DEMOLISH SAID BUILDINGS
AND/OR STRUCTURES WITHIN THIRTY ( 30 ) DAYS OF THE DATE

AND DETERMINING THAT THE MEETING AT WHICH THIS

Item 7a
A proposed ordinance was presented waiving a portion of
demolition liens and interest assessed against the property
located at 1507 12th Street.
Moved by Councilor Hawkins that proposed ordinance be
passed.
Motion seconded by Councilor Martin.
Mr. Dave Clark explained that the $3 ,725 was the low bid
for demolition and the $5,246 was the demolition bid plus
additional landfill charges, fill material and administrative
costs.
Mayor explained that Mrs. Adams, owner of the property, had
been quoted a demolition fee of $2800 and she is willing to pay
her fair share, however she was sent a bill for $3700. She had
taken that action on the basis of the $2800.
Mr. King stated that the demolition occurred in 1989 and
the cost was for approximately 125 tons at $9/Ton for debris
totalling $1100 for disposal fee, which was the cost in 1989. He
informed that it was not their practice nor do they encourage
quotations to property owners prior to an actual bid process. He

did not know how this had come about and the person mentioned as
the one who gave the quote is no longer with the City.
Councilor Hawkins commented that it was easy to fall into a
situation where an estimate is given when a person is insistent.
Mayor felt a commitment was made and Mrs. Adams should only
have to pay the $2800 plus interest.
Mr. King informed that Mrs. Adams had contacted Code
Enforcement in March, 1992 by phone and he prepared a letter
outlining demolition costs and interest rate up to that point
and she was provided with a copy of what had been incurred. They
have not heard from her since then.
Councilor Thompson was concerned with City employees '
statements obligating the City and he thought that a system
should be worked out which would be consistent and fair to all.
Councilor Martin felt that the quote was just an estimate
and there was room for it being more or it being less, and the
1992 letter from Code Enforcement indicated it was more.
City Manager reminded Council that where liens were
involved the only lever available to them was when the property
was going to be sold. Councilor Thompson commented it should not
be on a case by case basis but a set system.
Councilor Hawkins said that if the case was that Mrs. Adams
was just disposing of the property and not making a profit, that
he would be in favor of getting the property out of her name to
make it productive even if it meant reducing the lien. City
Manager commented that there was a reason the City had taken
action in 1989 and there was a cost to the property owner, and
the City should not be put in the position of underwriting the
property owner' s costs because they have been delinquent.
Councilor Hawkins felt something should be done instead of
letting it sit there unproductive. City Manager made Council
aware that that is what they will be doing with the other
properties.
Motion failed by the following vote.

Arnold Oliver, 2407 Lou Lane, Chair Clean Country
Commission, addressed the graffiti ordinance and informed that
they had met with outside resources as well as with Councilor
Hawkins, Norma Crane, and Jim Finley. Notices were sent out to
twenty-seven retailers of aerosol paint in the City and they
were invited to attend their meetings. Out of the twenty-seven,
there were no attendees but one written comment was received
from Ronnie Pope, Walmart Manager. Mr. Oliver said that there
were some far ranging problems relating to graffiti and today' s
ordinance was only the first step. There are concerns as to who
is responsible for the removal of graffiti and graffiti
abatement. Mr. Oliver asked for Council input regarding these
concerns.
Councilor Martin suggested creating a youth commission to
provide preventative education. Mr. Oliver and City Attorney
addressed several questions and concerns from Council.
John Ward, lives just outside Wichita Falls city limits,
was concerned with the graffiti gang threats made to his 81 year
old mother who lives on the north side.

Item 7c
A proposed ordinance was presented waiving mowing liens,
interest, and attorney fees on seventeen ( 17) various properties
in Nelson Stone Addition of Wichita Falls, Texas.
Moved by Councilor Hawkins that proposed ordinance be
passed.
Motion seconded by Councilor Martin.
Elvin Dudley, 4001 Callfield Rd. , proposed to do something
with the seventeen lots and asked that Council waive the mowing
liens. He said Council has three options: 1) leave things as
they are and continue to add interest; 2) foreclose; or 3 ) let
him put houses on the lots and have the City tax them.
The following substitute motion was proposed.
Moved by Councilor Hawkins that the administrative charges
and that portion of the interest on the mowing liens be waived
to reduce the lien of taxes and mowing liens to $17, 000
providing that the property be closed within forty-five days.
Councilor Daniel commented how that could be justified. His
concern was Council ' s responsibility to the citizens. Councilor
Hawkins felt that City would be getting all the out of pocket
expenses and an additional $4000 in interest.
Councilor Thompson was concerned with finding a method to
do this which is fair and equitable to all who come before the
Council with this type of situation. Councilor Martin stated
that property owners have a responsibility to maintain their
property instead of letting it go and accumulate mowing liens
and then ask for a waiver on them. Councilor Hawkins said he
would like to see some growth inside the City and see our tax
base grow.

Moved by Councilor Martin to award the City' s insurance

Councilor Martin was concerned that $100,000 for Extra
Expense would not be sufficient coverage and he suggested
doubling that amount. Mrs. Stricklin informed that the Extra
Expense is just for Building and Content, and the Electrical is
covered separately. Councilor Martin asked Mrs. Stricklin to see
what the cost would be for an additional $100, 000 . He said he
would approve this today, but he asked that she bring that cost
to them. She suggested that they accept the bid and she would
come back with an amendment if those quotes are what they would
like to accept.

RESOLUTION NO. 161-95
RESOLUTION ACCEPTING LOW BID FOR AND AUTHORIZING THE
CITY MANAGER TO EXECUTE CONTRACT WITH INMAN
CONSTRUCTION FOR A SHELTER AT THE LUCY PARK NATURE
WORKS SITE

Item 10a
Staff recommended TXDOT Alternative No. 2 of the final
design concept for Call Field Road between Kemp and Lawrence,
which would be within City' s right-of-way budget.
There was some discussion on Alternative No. 2 vs.
Alternative No. 3, cost and time frame. The Maplewood reliever
was also mentioned as an option. Council wanted to discuss the
different alternatives with Staff, and directed Staff to prepare
work sessions with the Council members prior to the next Council
meeting.

Council meeting.

Item 10b
City Manager went over the two pay plans proposed to
Council. Plan One would allow a 3% pay increase across the board
plus a to pay increase to positions which are most out of line,
at least 15% below the survey level. Plan Two would be the same
except the percentages would be 2% and 20. He asked for a motion
or consensus directing payroll adjustments.
After polling the Council members, it was a consensus that
Council was in favor of Plan One.
Item 10c
Charlotte Spraggins, rural resident of Wichita County, and
A.J. Eckstein, 4813 Reginald, both own property located at F.M.
369 and S.H. 287 near the James V. Allred Prison. They said

their property was in the ETJ area and asked Council to consider
annexing out there.
Council and Staff advised them of the costs and procedures
involved in obtaining City services if this area was annexed.
Mayor said they would look at this.
City Manager informed that Staff has an annexation plan for
that area which is basically complete, and will be presented to
Council within the month.
Sue Ann O' Shea, 1080 Wenonah, expressed appreciation to the
Council for their support on Rev. James C.Thompson Victory Day.
She offered to help citizens of the north side who wanted to
start a neighborhood watch.
Item 10d
Councilor Martin requested that Mayor appoint a highway
commission to work on highway plans for Wichita Falls.
Councilor Hawkins was concerned with the number of City
employees working at MPEC. City Manager informed that that was
being logged and billed, but he will look into that.
Councilor Hawkins asked when Council was going to receive a
breakdown of expenses on MPEC. City Manager informed that they
would have that information by October.
Councilor Thompson asked that regarding waiving of mowing
liens, Staff develop a way to encourage development in our City
and he referenced the request from Mr. Elvin Dudley. Councilor
Thompson referred to the Library' s flooding situation and said
that plans need to be looked at to move the library to the
Activity Center once it is vacated. Also, that City start
looking at a bond issue to build some satellite library
branches.
Mayor requested the names of the persons who served on the
Library Evaluation Committee to possibly revive that committee
and get some firm recommendations on the use of the Activity
Center.
Item 10e
City Manager said he would get the Council copies of the
Library Committee Study.
Mayor commented that the goal would be to narrow the scope
of the Library Committee to using the Activity Center, then we
can address the Activity Center if the Library is not moved
there.

Over the past few years, the increase in commercial development along Call Field Road and Lawrence
Road has resulted in a consistent traffic problem. Traffic congestion has steadily increased since the
opening of Walmart, Sam's, K-Mart and Chili's. Since the late sixties, many solutions have been
proposed to relieve the anticipated traffic congestion.
Some of these options are:
A. Extend Maplewood to Lawrence Road.
B. Reconstruction of Call Field Road.
C. Construction of a direct connection from Lawrence to Rhea Road.
The purpose of this report is to inform the Wichita Falls City Council of the proposed alternates for
the reconstruction of Call Field Road. Although, the Maplewood reliever and the Rhea/Lawrence
connection will be discussed in this report, they have not been included as alternatives at this time.
On April 4, the Wichita Falls City Council entered an agreement with the Texas Department of
Transportation for the reconstruction and illumination of Call Field Road from the limits of Lawrence
Road to Kemp Boulevard, as shown in "Attachment A". The City of Wichita Falls has agreed to
participate in the development and construction of the project by:
A. Providing the necessary Right-Of-Way,
B. Providing for Utility Relocations,
C. Construction cost of new sidewalk, curb and gutter,
(Reconstruction of existing sidewalk, curb and gutter, etc. will be handled
as any other construction item.)
D. All cost associated with the engineering plans.

Recent studies by the City Engineering Department and TxDOT show that the existing configuration
of Call Field Road is not of sufficient capacity to adequately handle the current traffic volumes. The
most recent traffic volumes are shown in "Attachments B and C". The offset between Lawrence and
Rhea Roads, the relative location of Faith Road to the Kemp and Call Field intersection, and the
number of business driveways along Call Field adversely influences the traffic efficiency along Call
Field. Left turns along this corridor have increased due to the opening of K-Mart and Chili's. The
increase in the eastbound left turns is backing traffic to the west which effects the operation of the
existing traffic light at Rhea Road. According to the City's studies, approximately 99/6 of the
westbound Call Field traffic turns left at Faith Road that results in backed traffic into the Kemp
intersection during periods of moderate to heavy traffic flows.
Construction of a reliever would follow a route beginning at the Intersection of Kemp Boulevard and
Maplewood Avenue continuing along Avenue Z, across Tesco softball parks and connecting to
existing Keith Street. This route needs to be considered very seriously and at least acquire the right-
of-way before commercial development proceeds to a point this is no longer economically or
politically feasible. Although funds can be spent along Call Field Road to "tweak" the system, only
so much can economically be accomplished in a corridor that has already been commercially
developed without a sufficient street right-of-way being provided to allow future expansion. This
option was estimated at $3,200,000.00 by the City Staff in 1993.
The connection of Rhea Road to Lawrence Road was also reviewed by the City in 1993. The options
studied by the City were to construct a skewed intersection and to extend Lawrence southerly and
connect to Rhea Road. The option briefly looked at by TxDOT was to align Rhea and Lawrence
through the northeast comer of Lawrence and Call Field(currently FOX TV- 18). All three of these
options would require varying levels of right-of-way acquisition and relocation costs. Although the
direct connection of Lawrence and Rhea from a traffic engineering stand point is very desirable, from
an economic point of veiw, it may very well be that the funds would be better spent providing a
reliever to Call Field Road.
Attached are the alternatives currently being considered by the TxDOT Area Office for the above
referenced project. Preliminary data collection began in December of 1994 by City and State forces.
A schematic of the existing topography has been completed and preliminary estimates have been made
for each proposal. The cost estimates include Traffic Control, Mobilization, Erosion Control and
Illumination.

Alternative Number 1: Restricting Left Turns from Lawrence Road to Kemp
Boulevard. (See Attachment D)
This alterative consists of constructing a permanent barrier from just east of Lawrence Road
to just west of Kemp Boulevard. (See attached Typical Section.) A major disadvantage to
this alternative is the restriction of emergency vehicles into the Faith Village Addition. The
proposed traffic barrier would prohibit ALL left turns along this corridor. Although
restricting all left turns would restrict access to local business traffic, this option would allow
traffic to move smoothly along Call Field Road increasing the level of service. Eliminating
left turns at the Rhea Road intersection, from westbound Call Field Road to Rhea Road and
from Rhea Road to westbound Call Field Road, would allow for the removal of the existing
Rhea Road traffic signal. The anticipated widening of the existing roadway and placement
of the barrier would cause minimal disruption to traffic. Unfortunately, this alternative would
deny access to the Faith Village Subdivision from westbound Call Field Road to Faith Road.
An additional 5 feet of Right-Of-Way will be required. Estimated cost of construction for this
alterative is approximately $123,700.00 and includes barrier, removal of the existing signal
light at Rhea Road, and signing. Right-of-way cost is estimated at $83,300.00 making the
total cost of this alternative $207,000.00.

Alternative Number 2: Left-Turn Bays (See Attachment E)
Alternative two consists of constructing left-turn bays from west of Lawrence Road to west
of Kemp Boulevard and a concrete median island from the existing Albertson's driveway to
Kemp Boulevard. (See attached Typical Section.) Left-turn bays should be placed at the
following locations:
A. Eastbound Call Field Road to Lawrence Road
B. Eastbound Call Field Road to K-mart
C. Eastbound Call Field Road to Albertson's
D. Eastbound Call Field Road to Kemp Boulevard
E. Westbound Call Field Road to The Computer Store and Bill's Scoreboard
Parking Lot
F. Westbound Call Field Road to Rhea Road
The major advantage to this option is while restricting the number of turn movement locations
along Call Field, the left-turn bays would provide an added increment of safety and improve
the operation and efficiency of the facility. The construction of a concrete median island will
prohibit any left turns from westbound Call Field to Faith Road but should increase the
efficiency of the Kemp and Midwestern intersection.
To construct the left-turn bays, existing Call Field should be widened by 16 feet to the north
which will require an additional 20 feet of right-of--way. The pavement widening of Call Field
at Rhea and Lawrence roads would require replacement of all or a part of the existing
signalization. The estimated cost for this alternative is approximately $734,900.00 which
includes$472,600.00 for right-of-way acquisition, $262,300.00 for construction of the left-
turn bays, demolition,widening, and approximately $35,000 for the removal and replacement
of the existing signalization.

Alternative Number 3 supplements Number 2 with free right-turn lanes. (See attached Typical
Section.) The following options are included as additions to the left-turn bays to improve efficiency
along Call Field Road. Each option has an associated right-of-way and construction cost. The total
cost of the project with all options is estimated as $2,085,900.00 with a construction cost of
$540,300.00 and a right-of-way cost of$1,545,600.00. Additional Right-of-way is required to
construct the following free right turn lanes. (See Attachments F and G)
Option #3A Free Right-Turn Lane From Eastbound Call Field to Rhea Road.
Existing traffic counts show that 17%(1475 vehicles)of the eastbound traffic makes this turn
onto Rhea that is enough to back traffic into the Lawrence Road intersection. Currently, the
timing of the Rhea Road traffic signal is programmed to allow for these vehicles to clear the
intersection.
♦ Estimated Right-of-way Cost= $100,000.00
♦ Estimated Construction Cost = $24,735.15
Option #3B Right-Turn From Rhea Road to Eastbound Call Field Road.
All of the existing traffic at Rhea Road currently turn, 43% (1177 vehicles) turn right and
57% (1567 vehicles) turn left.
♦ Estimated Right-of-way Cost= $71,000.00
♦ Estimated Construction Cost = $22,749.33
Option #X Right-Turn From Eastbound Call Field Road to Kemp Boulevard.
Approximately 24%(2370 vehicles)of the existing eastbound traffic on Call Field turns right
to Kemp. Currently, this is an unprotected movement at a high volume intersection.

Option # 3D Right-Turn From Kemp Boulevard to Westbound Call Field Road.
Several attempts have been made to increase the efficiency of this movement including
signalizing the right turns, prohibiting right-turn on red and a free right. This movement is
currently a free right with an existing directional island.
♦ Estimated Right-of-way Cost = $31,150.00
♦ Estimated Construction Cost = $1,665.98
The construction of options 3A, 3B, 3C and 3D would move enough of the vehicles through the
intersection so that extra timing sequences would not be required in the traffic signal programming.
Option #3E Continuous Right-Turn From Westbound Call Field Road into
Albertson's and Chih's/K-Mart Parking Lot.
The existing continuous right-turn lane in front of K-Mart should be removed to construct
the left-turn bays. These locations generate the highest volumes of turning traffic along the
corridor, causing the greatest disruption. Moving the right turning vehicles out of the main
lanes will improve efficiency of Call Field and enhance safety.
♦ Estimated Right-of-way Cost= $137,400.00
♦ Estimated Construction Cost = $34,668.67
Option #3F Right-Turn From Westbound Call Field Road to Northbound
Lawrence Road
Right-turns onto Lawrence Road account for 40% (3363 vehicles) of the westbound traffic
which is more than enough to back traffic into the Rhea Road intersection. Currently, the
timing of the Lawrence traffic signal has also been programmed to allow for these vehicles
to clear the intersection.
♦ Estimated Right-of-way Cost= $40,625.00
♦ Estimated Construction Cost = $3,969.35
Option #3G Right-Turn From Lawrence Road to Westbound Call Field Road.
A force right would help to buy precious seconds of green time on the traffic signal. This
would be valuable in helping to dismiss drivers'perception that the cues of waiting vehicles
are unnecessarily long.

♦ Estimated Construction Cost = $6,580.65

Road.
This would be relatively inexpensive to construct as a part of the proposed construction and
would aid the driver to correctly and quickly maneuver in the intersection.
