December 28, 1951 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session, postponed from December 21:, 1951, at 10 o'clock A. M. in the Council Room of the Memorial Auditorium Building, with the following members present: Harold Jones Mayor R. P. Willis II Lloyd Thomas Francis L. Harvey # Aldermen • J. R. Ray [ R. J. Walter Friberg City Attorney Mayor Harold Jones declared the Public Hearing on the 1951-52 budget, set for December 28, 1951, to be open. When no one came forward to be heard concerning the 1951-52 budget, the following motion was haft Moved by Alderman Brown that the Public Hearing be closed. Motion seconded by Alderman Ray and carried. The Minutes of the meeting held December 10, 1951, were approved. ORDINANCE NO. 1590 AN ORDINANCE ADOPTING A BUDGET FOR THE ENSUING FISCAL YEAR, BEGINNING WITH OCTOBER 1, 1951, AND ENDING SEPTEMBER 30, 1952, IN ACCORDANCE WITH THE CHARTER AND ORDINANCES OF THE CITY OF WICHITA FALLS, TEXAS. Moved by Alderman Brown that Ordinance No. 1590 be approved and passed as read. Motion seconded by Alderman Willis and carried by the following votes Yeas: Aldermen Willis, Thomas, Harvey, Ray and Brown. Nays: None. • Moved by Alderman Harvey that a request of the F. &F. Trucking Company, to install a butane fuel storage tank at 610 Wichita Street, be approved. Motion seconded by Alderman Brown and carried. Moved by Alderman Ray that the request of the Gilmore Paint &Body Works to cross the alley with water, gas and air lines, at 11011 - 6th Street, be approved. 4.> Motion seconded by Alderman Brown and carried. RESOLUTION NO. 180 BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, THAT: 10p8 WHEREAS, the City of Wichita Falls owns and maintains airport facilities for the use of the various commercial airlines, and WHEREAS, the City of Wichita Falls has the services of a number of airlines which Carry passengers, freight and mail to and from the City of Wichita Falls by air, and WHEREAS, the City of Wichita Falls desires to establish an air center and do everything possible to facilitate the granting and giving of air transportation to and from said City, NOW, THEREFORE, BE IT RESOLVED, that said City requests additional air service for passengers, freight and mail between the City of Wichita Falls and the cities of Dallas, Abilene aid Amarillo. That this resolution is made to indicate the attitude of said City before the various regulatory, bodies that have to do with air transportation and service. Moved by Alderman Harvey that Resolution No. 18Q be approved and passed as read. Motion seconded by Alderman Thomas and carried by the following vote: Yeas: Aldermen Willis, Thomas, Harvey, Ray and Brown. Nays: None. Moved by Alderman Willis that a request of J. G. Wootten, Graham, Texas, for an oil and gas lease on approximately 40 acres out of the T. P. Martin Survey, adjacent to Lake Kickapoo, in Archer County, Texas, with a$10.00 per acre bonus, be denied. Motion seconded by Alderman Harvey and carried. The City Attorney was instructed to draw an ordinance for the control of outside toilets. No action was taken on a request by W. B. Hamilton for the City to reimburse him for the cost of water and sewer lines in the Sixth Supplemental County Club Estates Addition. Moved by Alderman Thomas that proposed alterations and improvements to the Water Department offices be authorised, same being arranged for on a cost plus basis, and under the supervision of the City Engineer. Motion seconded by Alderman Willis and carried. Bailey Surveys; Thence N. 45° 0' W. along said division line 41.7.3 feet to a point; Thence W. 275.0 feet to the Northwest corner of said Richard Brown Survey, said point being in the East line of the Lewis Wells Survey; Thence N. 00 14' W. along said East line 3,602.5 feet to the point of beginning, containing 1,185.97 acres of land, more or less AND WHEREAS, the above described tract of land and airport facilities thereon are now and have been heretofore occupied and used by the Government, in connection with activities of Sheppard Air Force Base, under lease rights from the City of Wichita Falls, Texas; and WHEREAS, the Chief of Staff of the United States Air Force has deemed that a military necessity exists for the acquisition of said land and that fee simple title thereto should be vested in the United States; and WHEREAS, the United States of America has requested the transfer of title to said property to it and has offered to pay to the City of Wichita 120 Falls, Texas, a nominal consideration, or a consideration of the sum of ONE AND NO/100 DOLLARS ($1.00); and WHEREAS, the Mayor and City Council of this City, having duly considered the above determination of the Chief of Staff of the United States Air Force and above request of the Government for transfer of title of said property, deem it advisable, proper, and for the best interests of the City to concur in such determination and accede to such request by selling and conveying said property for said consideration. NOW, THEREFORE, BE IT ORDERED AND RESOLVED by the Mayor and the City Council of the City of Wichita Falls, Texas, duly assembled in lawful and regular session An said City on this 28th day of December, 1951, a quorum of said Counoil and a majority of the members being present and voting "Yes" or in the affirmative on a motion duly made and seconded for such purpose, that the City convey to the United States of America all of its right, title and interest in said land and lands hereinbefore described, for the sum of ONE and NO/100 DOLLAR ($1.00) and for no other monetary consideration. IT 15 HEREBY FURTHER RESOLVED AND ORDERED:. That said motion be, and is hereby adopted, and that the City of Wichita Falls, Texas, is hereby authorized to convey by an appropriate conveyance the hereinbefore described lands in fee to the United States of America and that the Mayor of said City be, and is hereby authorized to make and execute all instruments necessary for the con- summation of said transaction and execute deed or deeds conveying said property to the United States of America, pursuant to both the express and implied provisions of this Resolution, and pursuant to law. That by reason of the fact that the United States Government is in urgent need of the fee simple title to said land, it is deemed necessary that said conveyance be made without delay. Therefore, for the preservation of the public health, peace and safety an emergency is hereby declared to exist whereby this Resolution shall be in full force and effect from and after its adoption. This Resolution is given in lieu of Resolution No. 155 passed and adopted 8 November 1951 to include additional land and to revise the description. A recommendation from the Park Board that a fire lane be created on Harrison Street from Tenth Street to the south line of Bridwell Park, was referred to the Traffic Department. No action was taken at this time on a recommendation from the.Park Board that approval of the Hursh Subdivision, First Section, be denied. REPORT OF THE ENGINEER AS TO FINAL COMPLETION OF IMPROVEMENTS ON THIRTEENTH STREET, IN THE CITY OF WICHITA FALLS, TEXAS TO fHP, BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS Gentlemen: I beg to report that Stuckey Construction Company, a partnership, of Wichita Falls, Texas, to whom was awarded the contract for the itprovement of certain streets and avenues in the City of Wichita Falls, Texas, has completed the improvements:. ON THIRTEENTH STREET, from the west line of the alley which lies in and between Scott Avenue and Lamar Street to the east property line of Travis Street, SAVE AND EXCEPT the intersection of Thirteenth Street and Lamar Street, known and designated as Unit No. 102. The said improvements having been completed in strict accordance with the terms of said contract and specifications of said work adopted by the City, I hereby recommend that the said improvements be finally accepted by the Board of Aldermen: Dated this 21st day of December, 1951. /s/ F. WHEREAS, the City of Wichita Falls, heretofore entered into a contract with Stuckey Construction Company, a partnership, of Wichita Falls, Texas, for the making and construction of certain improvements on the following portion of Thirteenth Street in said City to wit: THIRTEENTH STREET, from the west line of the alley which lies in and between wry' Scott Avenue and Lamar Street to the east property line of Travis Street, SAVE AND EXCEPT the intersection of Thirteenth Street with Lamar Street, known and designated as Unit No. 102. and, WHEREAS, such improvements have been completed upon said portion of'Thirteenth Street and have been inspected and found to be complete in accordance with the contract therefor, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: 1. The improvements on said portion of Thirteenth Street be, and they are hereby, accepted; and the contract with reference to the construction of such improvements be, and is hereby, found and declared fully completed and performed. 2. The Mayor, be and he is hereby directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and owners thereof for such improvements, and the City Clerk is directed to execute same and impress thereon the corporate seal, all in accordance with the proceedings and relating to such improvements and assessments; such certificates shall be delivered to said Company. 3. This resolution shall take effect and be in force from and after its passage. Moved by Alderman Thomas that Resolution No.'182 be approved and passed as read. WHEREAS, the City of Wichita Falls, heretofore entered into a contract with Stuckey Construction Company, a partnership, of Wichita Falls, Texas, for the making and construction of certain improvements on the following portion of Seventeenth Street in said City to wit: SEVENTEENTH STREET, from the east property line of Grace Street to the 112 center line of the alley lying between Grace Street and Magnolia Street, known and designated as Unit No. 94. and, WHEREAS, such improvements have been completed upon said portion of Seventeenth and have been inspected and found to be complete in accordance with the contract therefor, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FAILS, TEXAS, THAT: 1. The improvements on said portion of Seventeenth Street be, and they are hereby, accepted; and the contract with reference to the construction of such improvements be, and is hereby, found and declared fully completed and performed. 2. The Mayor be and he is hereby directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and owners thereof for such improvements, and the City Clerk is directed to execute same and impress thereon the corporate seal, all in accordance with the proceedings relating to such improvements and assessments; such certificates shall be delivered to said Company. 3. Motion seconded by AldermanBrown and carried by the following vote: I - Yeas: Aldermen Willis, Thomas, Harvey, Ray and Brown. Nays: None. No action was taken at this time on a request by W. W. Sawyer for the City to pay his bill at the Clinic Hospital in amount of $206.55. The request of the Harper-Phenix Finance Co. & Harper Used cars for the City 4to remove a bus stop shelter on the curb in front of the Lone Star Motor Co. was referred to the Chamber of Commerce for settlement, since this shelter was erected through the joint efforts of the Lone Star Motor Co. and the Chamber of Commerce. Moved by Alderman Harvey that the meeting be adjourned. Motion seconded by Alderman Thomas and carried. The Board of Aldermen th adjourned.
