November 26, 1951 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session, at 7-30 otclock P.M., in the Council Room in the Memorial Auditorium Building, with the following members present: Harold Jones Mayor R. McKinney that a liquor zone be established at the Traffic Circle at Seymour Road and Beverly, same to extend 500 feet each way from the center of the traffic island, was referred to the Liquor Zoning Committee. ORDINANCE NO. 1585 AN ORDINANCE EXTENDING THE CITY LIMIT OF THE CITY OF WICHITA FAT.TS, TEXAS, BY ANNEXING CERTAIN LANES ADJACENT TO THE PRESENT TERRITORIAL LIMITS OF THE CITY OF ' WICHITA FALIS, TEXAS, THE SAME LYIN A S THERL�AN TION FROM THE PRESENT LIMITS OF THE CITY OF WICHITA FAITS, TDC ARE FULLY DESCRIBED IN THE BODY OF THIS ORDINANCE. Moved by Alderman Harvey that Ordinance No. 1585, providing for the annexa- tion of that certain territory known as:the Hursh Subdivision on the Jacksboro Highway be introduced, that the same be published, and a Public Hearing be set for December 10, 1951. Motion seconded by Alderman Brown and carried by the following vote: Yeas: Aldermen Willis, Harvey, Montgomery and Brown. Nays: None. Moved by Alderman Harvey that the request of the Bead Chafin Wholesale Gasoline Co. to install one - 2000 gal. and one-3000 gal. gasoline tank at 613 Lee St., and one-3000 gal. tank at 301 N. Broadway, be approved; provided the same are installed under the supervision of the City Engineer. Motion seconded by Alderman Montgomery and carried. Moved by Alderman Harvey that the City of Wichita Falls pay one-half the cost of a new boiler for the Nurses Home on Rose Street, same to cost approximately $1085.00. ORDINANCE NO. 1586 ORDINANCE DETERMINING THAT IT IS NOT PRACTICAL TO PROCEED WITH THE IMPROVEMENTS , HERETOFORE ORDERED ON A PORTION OF NORTH ALS TIN STREET, KNOWN AND DESIGNATED AS UNIT NO. RESOLUTION NO. 168 RESOLUTION ORDERING AND'PROVIDING FOR THE IMPROVEMENT OF A PORTION OF NORTH AUSTIN STREET IN THE CITY OF WICHITA FALLS, TEXAS, APPROVING AND ADOPTING PLANS AND SPECIFICATIONS FOR SUCH IMPROVEMENTS, APPROVING AND AWARDING SUPPLEMENTAL CONTRACT TO STUCKEY CONSTRUCTION COMPANY FOR THE MAKING AND CONSTRUCTION OF SUCH IMPROVEMENTS, ORDERING THE EXECUTION THEREOF, DIRECTING THE ENGINEER TO PREPARE AND FILE ESTIMATES OF THE COST OF THE IMPROVEMENTS, AND PROVIDING SUNDRY OTHER MATTERS INCIDENT THERETO. WHEREAS, the Engineer for the City of Wichita Falls, Texas, has heretofore prepared and filed with the Board of Aldermen of said City Plans and Specifications for the improving and paving of a portion of North Austin Street hereinafter described, and said Plans and Specifications are here now before the Board of Aldermen and have been fully examined and found to be in all matters and things proper and correct; and, WHEREAS, competitive bids for the making and constructing of said improvements were duly advertised for in the manner and for the length of•time and in the form re- quired and provided for by the City Charter and the law in force and effect in the City of Wichita Falls, Texas, and the bid of Stuckey Construction Company, Contractors, of Wichita Falls, Texas, was found to be the lowest and most advantageous; THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: 1. The Plans and Specifications for the improvement of that portion of North Austin Street hereinafter described, to wit: NORTH AUS TIN STREET, from the east property line of North Brook Avenue to the north curb line of Warren Street, SAVE AND EXCEPT the intersection of North Austin Street with Wichita Street, to be known and designated as Unit No. 63 A, be, and the same are hereby adopted and approved. 2. It is hereby determined that it is necessary that said hereinabove•des- cribed portion of North Austin Street be improved by raising, grading and filling same, by constructing and installing concrete curbs and gutters, where same are not already constructed on proper grade and line and by constructing thereon a seven inch flexible in ch course with a one and one-half Type Tr-Modified Asphalt Pavement Surface, together with incidentals and appurtenances, including storm sewers and drains, as and where shown on the Plans relating to said improvements and in strict accordance with the Plans and Specifications therefor. 3. Payment for such improvements shall be made in the following manner, towit: (a) The abutting property and the owners thereof shall be assessed and pay for not exceeding all of the cost of curbs and gutters plus nine-tenths (9/10th) of the re- maining cost of the improvements. (b) After deducting the amounts assessed against and paid by the abutting property and the owners thereof, the remaining cost of said improvements shall be paid for by the City of Wichita Falls, Texas. It is contemplated that where the property abutting the portion of North Austin Street to be improved fronts on said portion of North Austin Street, said abutting property and the owners thereof shall be assessed and pay for not more than seventy five per cent (75%) of the total cost of the improvements and that where the property abutting the portion of.North Austin Street to be improved does not front on said portion of North Austin Street, abutting property and the owners thereof shall be assessed and pay for not more than sixty per cent (60%) of the total cost of the improvements. The City of Wichita Falls, Texas will pay for that portion of the cost of the improvements which is not assessed against the abutting property and the owners thereof. The amounts payable by the abutting property and the owners thereof shall be assessed against such property and against the real and true owners thereof and shall be a first and prior lien upon the property upon which assessments are levied except State, County, School District and City ad valorem taxes, and a personal liability of the owners of said property. 4. Assessments against abutting operty and the owners thereof shall bear interest at the rate of six per centum (6%) per annum, payable annually except as to the 89 first installment which matures in less than one year, which interest on said first installment shall be payable at the maturity of said installment. That said assess- ments shall be payable in five (5) equal installments, due respectively on or before ten (10) days' one (1), two (2), three (3) and four (q) years after completion and acceptance of such improvements, provided that if default be made in the payment of any installment when due, then at the option of the owner and holder of the certificate issued in evidence of the particular assessment, the entire assessment in connection with which default is made shall mature and become due and payable, together with reason- able attorneys' fees and costs of collection, if incurred. 5. No assessments shall be levied against any property or its owner until after notice and hearing as provided by law, nor in excess of special benefits to the particular property resulting from the improvement for which assessment is levied. 6. Proceedings shall'be taken and assessments levied pursuant to and in accordance with the law passed at the First Called Session of the Fortieth Tsgisla- ture of the State of Texas in 1927, shown as Chapter 106 of the Acts of said Session, together with any amendments of said Act, such Act being shown as Article 1105b of Vernon's Texas Civil Statutes, which Act, together with all amendments thereto, has heretofore been incorporated in and made a part of the Charter of the City of Wichita Falls, Texas. 7. The City Clerk is directed to prepare, sign and file with the County Clerk of Wichita County, Texas, a notice in accordance with the provisions of the Act passed by the Fifth Called Session of the Forth-First Legislature of the State of Texas and shown as Chapter 21 of the Acts of said session of the Legislature, said Act having been passed in the year 1930. 8. The improvements may be omitted abutting any property exempt from the line of special assessments for street improvements unless the owner or owners of such property shall satisfactorily secure payment. Should the owner or owners of any property exempt from the lien of special assessment fail to satisfactorily secure payment for the improvements to be constructed, then the City of Wichita Falls, Texas, may determine that no improvements of any nature whatsoever will be constructed. 9. Supplemental contract for'the making and construction of the Street improve- ments hereinabove described, having been examined and found to be in all matters and things proper and correct, same be, and it is hereby adopted and approved. 10. The work of making and constructing such improvements and the supplemental contract therefor is hereby awarded to Stuckey Construction Company, which said supplemen- tal contract is dated this date and is on file with the City and has heretofore been executed by Stuckey Construction Company and the City Manager is hereby authorized and directed to execute same in the name of the City of Wichita Falls, Texas, and the City Clerk is authorised and directed to attest same and to impress the corporate seal of the City thereon. 11. To provide for the payment of the indebtedness to be incurred by the City of Wichita Falls, Texas, an appropriation has heretofore been made for the con- struction of certain street improvements on, among others, that portion of North Austin Street hereinabove described, as well as an additional portion of said North Austin Street, which said appropriation be, and the same is hereby ratified, confirmed and approved, same being deemed sufficient to pay for the City's portion of the cost of the improvements herein ordered on that portion of North Austin Street hereinabove described. 12. The Engineer for the City of Wichita Falls, Texas be, and he is hereby, ordered and directed to file with the Board of Aldermen estimates of the cost of such improvements in accordance with the terms of the powers and provisions of the Charter of the City of Wichita Falls, Texas. 13. This Resolution shall take effect and be in force and effect immediately from and after its passage. Moved by Alderman Montgomery that Resolution No. 168 be approved and passed as read. Nays: None. 90 RESOLUTION NO. 169 RESOLUTION APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVEMENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF ARDATH AVENUE AND PORTIONS OF SUNDRY OTHER STREETS AND AVENUES IN THE CITY OF WICHITA FALLS, TEXAS, FIXING TIME AND PLACE FOR HEARING TO OWNERS OF ABUTTING PROPERTY AND OTHERS INTERESTED, AND DIRECTING THE CITY CLERK TO GIVE NOTICE. WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas, has heretofore ordered that each of the hereinafter described portions of streets and avenues in the City of Wichita•Falls, Texas, be improved as follows: AW Each of the hereinafter enumerated and described portions of streets and avenues known and designated as Units Nos. 60, 634,64, 66, 71, 72, 74, 78, 80, 81, 84, 97, 105, 119, 120 and 121, be improved by raising, grading and filling same,by constructing and installing concrete curbs and gutters, where same are not already constructed on proper grade and line, and by constructing thereon a seven inch flexible base course with a one and one-half inch Type 'Q"Modified Asphalt Pavement Surface; Each of the hereinafter enumerated and described portions of streets and avenues known and designated as Units Nos. 69, 79, 91 and 92, be improved by raising, grading and filling same, by installing and constructing thereon curbs and gutters, where same are not already constructed on proper grade and line, and by constructing thereon a five inch concrete base with a one and one-half inch Type 4IV^-Modified Asphalt Pavement Surface; The hereinafter described unpaved and unimproved portion of Taylor Street, known and designated as Unit No. 101, be improved by raising, grading and filling same and by constructing thereon a six inch reinforced concrete pavement with integral curbs; • The hereinafter described portion of Tulsa Street, known and designated as Unit No. 112, be improved by raising, grading and filling same, by constructing and installing thereon curbs and gutters, where same are not already constructed on proper grade and line, by constructing concrete sidewalks where same are shown and provided for on the Plans, and by further constructing thereon a seven inch flexible base course with a one and one-half inch Type 'V'-Modified Asphalt Pavement Surface; The hereinafter described portion of Wichita Street, known and designated as Unit No. 117, be improved by raising, grading and filling same, by constructing and installing concrete curbs and gutters, where same are not already constructed on proper grade and line, and by constructing thereon a seven inch flexible base course with a one and one-half inch Type 'WLModified Asphalt Pavement Surface, and be further improved by constructing a six inch reinforced concrete pavement in the intersection of Wichita Street with North Lamab Street, said concrete pavement to be in lieu of flexi- ble base with asphalt surface; All of the hereinabove described improvements be constructed together with incidentals and appurtenances, including storm sewers and drains, as and where shown on the Plans relating to said improvements and in strict accordance with the Plans and Specifications therefor, now on file with the City, and contract for the making and constructing of such improvements was made and entered into with Stuckey Construction Company, a copartnership of Wichita Falls, Texas; and, WHEREAS, theBoard of Aldermen of the City of Wichita Falls has caused the City Engineer to prepare and file estimates of the cost of such improvements and estimates of the amounts per front foot proposed to be assessed against abutting property and the owners thereof, and such estimates have been examined, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: 1. Such estimates be, and they are hereby, adopted and approved. 2. It is hereby found and determined that the cost of improvements on each portion of street and avenue, with the amount or amounts per front foot proposed to be assessed for such improvements against abutting property and the owners thereof on each such portion are as follows, to wit: On ARDATH AVENUE, from the east property line of Harrison Street to the west property line of Van Buren Street, known and designated as Unit No. 60: the estimated cost of the improvements is $5,369.27; the estimated amount per front foot to be assessed against those parcels of property which abut and which front on said portion of Ardath Avenue and against the owners thereof is $40576; the estimated amount per front foot to be assessed against those parcels of property which abut on said Ardath Avenue but which front on some street or avenue other than Ardath Avenue and against the owners thereof is $ - . � On NORTH ALB TIN STREET, from the east property line of North Brook Avenue to the north curb line of Warren Street, SAVE AND EXCEFP the intersection of North Austin Street with Wichita Street, known and designated as Unit No. 63-A: the estimated cost of the improvements is $7,168.90; the estimated amount per front foot — —— 91 to be assessed against those parcels of property which abut and which front on said por- tion of North Austin Street and against the owners thereof is $4.750; the estimated amount per front foot to be assessed against those parcels of property which abut on ' said North Austin Street but which front on,some street other than North Austin Street and against the owners thereof is $3.800. On BLUFF STREET, from an imaginary line drawn perpendicularly across Bluff Street at a point 7i feet north of the north property line of Twenty-First Street to an imaginary line drawn perpendicularly across Bluff Street at a point where said imaginary line is an east prolongation of the property line separating Lots 24 and 25, Block 9, Sibl -Taylor Addition to the City of Wichita Falls, Texas, known and designated as Unit No. 6t the estimated cost of the improvements is $7,279.52, the estimated amount per front foot to be assessed against those parcels of property which abut and which front on said portion of Bluff Street and against the owners thereof is $4.403; the estimated amount per front foot to be assessed against those parcels of property which abut on said Bluff Street but which front on some street other than Bluff Street and against the owners thereof is $3.522. On BROAD STREET, from the south property line of Twelfth Street to the north property line of Thirteenth Street, known and designated as Unit No. 66: the estimated cost of the improvements is $6,613.53; the estimated amount per front foot to be assessed against those parcels of property which abut and which front on said portion of Broad Street and against the owners thereof is $7.294; the estimated amount per front foot to be assessed against those,parcels of property which abut on said portion of Broad Street but which front on some street other than Broad Street and,against the owners thereof is $5.835. On AVENUE F, from the east property line of Giddings Street to the west property line of that portion of Britain Street which intersects Avenue F on the south, known and designated as Unit No. 74; the estimated cost of the improvements is $2,917.18; the estimated amount per front foot to be assessed against those parcels of property which abut and which front on said portion of Avenue F and against the owners thereof is $3.587; the estimated amount per front foot to be assessed against those parcels of property which abut on said portion of Avenue F but which front on some street or avenue other than Avenue F and against the owners therof is $2.869.
