Min 10/29/1951 74 Wichita Falls, Texas Memorial Auditorium Building October 29,1951 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session, postponed from October 22, 1951, at 7-30 o+clock P.M., in the Council Room in the Memorial Auditorium Building, with the following members present: Harold Jones Mayor R. P. Willis II Lloyd Thomas I Aldermen Francis L. Harvey J. R. Ray k J. B. Hickerson City Clerk Bill N. Taylor City Manager J. Walter Friberg City Attorney The minutes of the meeting held October 8, 1951, were read'and approved as read. Moved by Alderman Thomas that City Attorney, J. Walter Friberg, City Engineer, F. M. Rugeley, and City Manager, Bill N. Taylor, work out a recommendation to be presented at the next council meeting, as to the best way to dispose of a Small triangular piece of land on the Virginia Street Cut-off Road, to Ray Keith. Motion seconded by AldermanRay and carried. Moved by Alderman Harvey that an application by Fowler & Thornton to o erect a neon sign on the building at the southwest corner of Indiana & 7th Street be approved, for one year, provided the same is erected under the supervision of the City Engineer. Motion seconded by Alderman Thomas and carried. Moved by Alderman Harvey that action be deferred on a request by Fred Cone Company, that they be allowed to proceed with paving on Terrace Street and Lakewood Drive in the Inglewood Addition, North 1/2 Block 3, using sandstone base instead of conglomerate base, until such time as the Board of Aldermen could hear the recommendation of City Engineer, F. M. Rugeley, in the matter. Motion seconded by Alderman Ray and carried. Nays: None. Moved by Alderman Harvey that the plat of the Abernathy Subdivision, Block 5, Marlow Subdivision, which is attached hereto and made a part hereof, be approved. Motion seconded by Alderman Willis and carried. Moved by Alderman Thomas that a request by the Elks Club, to use the Municipal Auditorium on November 16, 1951, be approved, at a charge of $75.00. Motion seconded by Alderman Harvey and carried. Moved by Alderman Harvey that a request by the A.&M. Club, for a refund of $75.00 paid by them for use of the Municipal Auditorium, be granted. Motion seconded by Alderman Thomas and carried. The Board of Aldermen instructed City Attorney J. Walter Friberg and City Manager, Bill N. Taylor, to give the Lane Wells'Co: a letter stating the Council's approval of the Lane-Wells Co. continuing their business at their present location in the Robert Evans Survey on Highway No. 82, within the present city limits of the City of Wichita Falls. Mayor Harold Jones declared the public hearing, which was set for October 29, 1951, on paving assessments on Austin and various other streets, to be open. When no one came forward to be heard, the following motion was had: Moved by Alderman Thomas that the Public Hearing be closed. Motion seconded by Alderman Harvey and carried. ORDINANCE NO.11580 ORDINANCE CIM INO HEARING AND LEVYING ASSESSMENTS FOR PART OF THE COST OF IMPROVING MOTIONS OF ALE TIN STREET AND FORTIONS OF SUNDRY OTHER STREETS AND AVENUES IN THE CITY OF WICHITA FALLS, TEXAS; FIXING CHARGES AND LIENS AGAINST PROPERTIES ABUTTING ON SAID PORTIONS OF STREETS AND AVENUE AND AGAINST THE OWNERS THEREOF, PROVIDING FOR THE COLT.FrTION OF SUCH ASSESSMENTS AND THE ISSUANCE OF ASSIGNABLE CERTIFICATES IN EVIDENCE THEREOF, AND DECLARING AN EMERGENCY. 76 Moved by Alderman Ray that Ordinance No. 1580 be approved and passed as read. RESOLUTION NO. 157 Ilimw ' BE IT RESOLVED BY THE HOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: That the Mayor be, and he is hereby authorized, to execute and enter into, and the City-Secretary be, and he is hereby authorized, to attest an agreement with Texas Electric Service Company supplemental to an agreement made the 28th day of October 1941, and supplement thereto dated February 5, 1967, covering said Company's use and occupancy of the streets, alleys, highways, easements, parks and other public places within the City of Wichita Falls, Texas. Said supplemental agreement to extend the afore mentioned agreement and supplement for a period of 10 years from the date of the supplemental agreement. Nays: None. The City:Attorney, J. Walter Friberg, was instructed to prepare a Resolution setting forth the future policy on Water and Sewer line extensions in new Subdivisions, and present the same to the Council at their next meeting. RESOLUTION NO. 158 BE IT RESOLVED by the Board of Aldermen of the City of Wichita Falls, that the First Baptist Chureh, Wichita Falls, Texas, is granted permission to cut a steam pipe trench across the alley between their properties at the corner of 9th&Burnett Streets, without first having obtained a permit from the City Manager's Office in the City of Wichita Falls, Texas. Moved by Alderman Ray that Resolution No. 158 be approved and passed as read. Motion seconded by Alderman Willis and carried by the following vote: Yeas: Aldermen Willis, Thomas, Harvey and Ray. Nays: None. ORDINANCE NO. 1581 AN ORDINANCE AMENDING ORDINANCE NO. 1474 WHEREIN A PORTION OF GALVESTON STREET IN THE J. A. Motion seconded by Alderman Willis and carried. REPORT OF THE ENGINEER AS TO FINAL COMPLETION OF IMPROVlMEN1S ON A PORTION OF LAMAR STREET, IN THE CITY OF WICHITA FALLS, TEXAS. TO THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: Gentlemen: I beg to report that Stuckey Construction Company a partnership of Wichita Falls, Texas, to whom was awarded the contract for the improvement of certain streets and avenues in the City of Wichita Falls, Texas, has completed the improve- ments on, THE UNPAVED AND UNIMPROVED PORTION OF LAMAR STREET which abuts Lot 13, Block 126, Original Townsite of the City of Wichita Falls, Texas, and being the east one-half of that portion of Lamar Street ' which abuts said Lot 13, known and designated as Unit No. 86. The said improvements having been completed in strict accordance with the terms of said contract and specifications of said work adopted by the City, I hereby recommend that the said improvements be finally accepted by the Board of Aldermen. RESOLUTION NO. 159 RESOLUTION ACCEPTING IMPROVEMENTS ON A PORTION OF LAMAR STREET AND DIRECTING THE ISSUANCE AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED. WHEREIN, the City of Wichita Falls, heretofore entered into a contract with S tuckey Construction Company, a partnership, of Wichita Falls, Texas, for the making and construction of certain improvements on the following portion of Lamar Street in said City to wit: • THE UNPAVED AND UNIMPROVED PORTION OF LAMAR STREET which abuts Lot 13, Block 126, Original Townsite of the City of Wichita Falls, Texas, and being the East one-half of that portion of Lamar Street which abuts said Lot 13, known and designated as Unit No. 86. and, WHEREAS, such improvements have been completed upon said portion of Lamar Street and have been inspected and found to be complete in accordance with the Contract therefor, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: 1. The improvements on said portion of Lamar Street be, and they are hereby, accepted; and the contract with reference to the construction of such improvements be, and is hereby, found and declared fully completed and performed. ,ate 2. The Mayor, be and he is hereby directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and owners thereof for such improvements, and the City Clerk is directed to execute same and impress thereon the corporate seal, all in accordance with the proceedings relating to such improvements and assessments; such certificates shall be delivered to said Company. 3. Moved by Alderman Harvey that the September bill of Wichita General Hospital in amount of $5934.03, for charity patients, be paid upon payment of a like sum by Wichita County, and order and direct the City Clerk to draw a warrant for the same. Motion seconded by Alderman Willis and carried. ORDINANCE NO. 1582 AN ORDINANCE PROVIDING FOR CLASSIFICATION OF ALL FIREMEN UNDER CIVIL SERVICE EMPLOYED BY THE CITY OF WICHITA FALLS. Moved by Alderman Harvey that Ordinance No. 1582 be approved and passed as read. Motion seconded by Alderman Thomas and carried by the following vote: Yeas: Aldermen Willis, Thomas, Harvey and Ray. Nays: None. ORDINANCE NO. 1583 AN ORDINANCE PROVIDING FOR CLASSIFICATION OF ALL POLICEMEN UNDER CIVIL SERVICE EMPLOYED BY THE CITY OF WICHITA FALLS.
