Min 09/24/1951 60 Wichita.Falls, Texas Memorial Auditorium Building September 24, 1951 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date, at H o'clock P.M., in the Council Room of the Memorial Audi- torium Building, with the following members present: Harold Jones Mayor -' R. Walter Friberg City Attorney ORDINANCE NO, 1574 ORDINANCE AMENDING RESOLUTION DATED JULY 9, 1951, AND ALL OTHER ORDI- NANCES AND PROCEEDINGS WHICH RELATE TO THE IMPROVEMENT OF THAT PORTION OF SHERMAN ROAD KNOWN AND DESIGNATED IN SAID RESOLUTION AS UNIT NO. 95, SO AS TO PROVIDE FOR A DIFFERENT TYPE OF IMPROVEMENT ON A PORTION OF SAID UNIT NO. 95 THAN THE TYPE HERETOFORE ERRONEOUSLY ORDERED CONSTRUCTED BY SAID RESOLUTION AND ERRONEOUSLY SET OUT IN THE CONTRACT RELATING TO THE CONSTRUCTION OF THE IMPROVEMENTS SO ORDERED; AUTHORIZING THE EXECUTION OF A SUPPLEMENTAL CONTRACT TO CORRECT SAID ORIGINAL CON- TRACT SO AS TO PROPERLY DESCRIBE THE IMPROVEMENTS.INTENDED TO BE CONSTRUCTED ON SAID PORTION OF UNIT NO. 95aAND DECLARING AN EMERGENCY. Moved by Alderman Montgomery that Ordinance No. 1574 be approved and passed as read. Motion seconded by Alderman Thomas and carried by the following vote: YEAS: Aldermen Willis, Thomas, Harvey, Ray, Montgomery, and R. J. Brown. NAYS: None. Moved by Alderman Thomas that the City Clerk be authorized to transfer $210,000.00 from the Water Fund to other funds as follows: General $95,000.00 Street 65,000.00 Park 40,000.00 Library 10,000.00 Motion seconded by Alderman Ray and carried. Moved by Alderman Montgomery that action on the requests of the Senior-Junior Forum and The Altrusa Club, for free use of the Auditorium on November 1, 1951, and December 14, 1451, respectively, be deferred, and that Mayor Harold Jones appoint a committee to work out a schedule of rates for future renting of the Muiicipal Auditorium. Motion seconded by Alderman Brown and carried. Mayor Harold Jones appointed Aldermen Brown, Thomas and Montgomery to study the rate schedule for the Auditorium, as proposed in the foregoing motion. Moved by Alderman Thomas that B. D. Norriss be paid $486.29, being one-third of water revenue from a certain territory in College Heights Addition from May 6, 1950, to June 6, 1951, in accordance with a water main contract he has with the City of Wichita Falls. Motion seconded by Alderman Ray and carried. 61 • Moved by Alderman Willis that the August bill from the Wichita General Hospital, in amount $6016.74 for charity patients, be paid, upon payment of a like sum by Wichita County, and authorize the City Clerk to draw a warrant in this amount. Motion seconded by Alderman Thomas and carried. Moved by Alderman Brown that the application of Paul M. Thiem to install two - 5000 gal. underground gasoline tanks on Sheppard Field Access Road, 500 feet from Iowa Park Highway and on west side of road, be approved,' provided these tanks are installed under the supervision of the City Engineer. Motion seconded by Alderman Ray and carried. Moved by Alderman Ray that a Re-Plat of Unit No. 2 of Faith Village, which is filed in the Office of the City Engineer, be approved. Motion seconded by Alderman Willis and carried. Moved by Alderman Willis that the provisions of the building line ordi- nance be waived, and an application by Jack E. Dennison to extend the present building on Lot 889, Block 169, 711 Bluff Street, 12 feet west from the existing structure be approved, and the city engineer issue a permit for the same. Motion seconded by Alderman Ray and carried. Moved by Alderman Thomas that the resignation of the City Manager, Frank Wood, be accepted effective October 1, 1951, and that he be paid two months addi- tional salary at the rate of $916.66 per month. Motion seconded by Alderman Brown and carried. • REPORT OF THE ENGINEER AS TO FINAL COMPLETION OF IMPROVEMENTS ON BELL STREET, IN THE CITY OF WICHITA FALLS, TEXAS TO THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALIS, TEXAS Gentlemen: I beg to report that Stuckey Construction Company, a partnership, of PI Wichita Falls, Texas, to whom was warded the contract for the improvement of certain streets and avenues in the City of Wichita Falls, Texas, has completed the improvements on, BELL STREET, from the south curb line of Avenue "C" to the north property line of Avenue "D", known and designated as Unit or District No. 28. The said improvements having been completed in strict accordance with the _ terms of said contract and specifications of said work adopted by the City, I hereby recommend that the said improvements be finally accepted by the Board of Aldermen. Rugeley RESOLUTION NO. 150 RESOLUTION ACCEPTING IMPROVEMENTS ON A PORTION OF BFT,T STREET AND DIRECTING THE ISSUANCE AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED. WHEREAS, the City of Wichita Falls, heretofore entered into a contract with Stuckey Construction Compar;y, a partnership, of Wichita Falls, Texas, for the making and construction of certain improvements on the following portion of Bell Street in said City to wit: BELL STREET, from the south curb line of Avenue "C" to the north property line of Avenue "D" known and designated as Unit or District No. 28, and, WHEREAS, such improvements have been completed upon said portion of Bell Street and have been inspected and found to be complete in accordance with the con- tract therefor, THEREFORE, • `illlii 62 BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: 1. The improvements on said portion of Bell Street be, and they are hereby, accepted; and the contract with reference to the construction of such improve- ments be, and is hereby, found and declared fully completed and performed. 2. The Mayor be, and he is hereby directed to issue and execute in the, name of the City, certificates in evidence of the special assessments levied against abutting property and owners thereof for such improvements, and the City Clerk is directed to execute same and impress thereon the corporate seal, all in accordance with the proceedings relating to such improvements and assessments; such certificates shall be delivered to said Company. 3. This resolution shall take effect and be in force from and after its passage. Moved by Alderman.Thomas that Resolution No. 150 be approved and passed as read. Gentlemen: I beg to report that Stuckey Construction Company, a partnership, of Wichita Falls, Texas, to whom was awarded the contract for the improvement of certain streets and avenues in the City of Wichita Falls, Texas, has completed the improvements on, NORTH FIFTH STREET, from the west edge of Pavement on North Broadway to the East Curb Line of Grand Avenue, known and designated as Unit or District No. 37. RESOLUTION NO. 151 RESOLUTION ACCEPTING IMPROVEMENTS ON A PORTION OF NORTH FIFTH STREET AND DIRECTING THE ISSUANCE AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESS- MENTS LEVIED. WHEREAS, the City of Wichita Falls heretofore entered into a contract with Stuckey Construction Company, a partnership, of Wichita Falls, Texas, for the making and construction of certain improvements on the following portion of North Fifth Street in said City to wit: North FIFTH STREET, from the West Edge of Pavement on North Broadway to the East Curb Line of Grand Avenue, known and designated as Unit o>: District No. 37. and, WHEREAS, such improvements have been comleted upon said portion of North Fifth Street and have been inspected and found to be complete in accordance with the contract therefor, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, fl TEXAS, THAT: y' 1. The improvements on said portion of North Fifth Street be, and they are hereby, accepted; and the contract with reference to the construction of such improvements be, and is hereby, found and declared fully completed and performed. 2. RESOLUTION NO. 152 RESOLUTION ACCEPTING IMPROVEMENTS ON A PORTION OF HAMPSTEAD LANE AND DIRECTING THE ISSUANCE AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED. WHEREAS, the City of Wichita Falls, heretofore entered into a contract with Stuckey Construction Company, a partnership, of Wichita Falls, Texas, for the making and construction of certain improvements on the following portion of Hamp- stead Lane in said City to wit; HAMPSTEAD LANE, from East Property Lime of Taft Boulevard to the West Property Line of Milby Avenue, known and designated as Unit or District No. 55. and, WHEREAS, such improvements have been completed upon said portion of Hampstead Lane and have been inspected and found to be complete in accordance with the contract therefor, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS THAT: 1. The improvements on said portion of Hempstead Lane be, and they are hereby, accepted; and the contract with reference to the construction of such improvements be, and is hereby, found and declared fully completed and performed. 2. The Mayor be, and he is hereby directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and owners thereof for such improvements, and the City Clerk is directed to execute same and impress thereon the corporate seal, all in accordance with the proceedings relating to such improvements and assessments; such ,011440.01., certificates shall be delivered to said Company. 1411111011110R- 3. Moved by Aldermen Montgomery that the Chief of Police be commended in his action of issuing windshield stickers to handicapped veterans in order that they might receive additional privileges and courtesies. Motion seconded by Alderman Thomas aid carried. The Minutes of the meeting held September 10, 1951, were read and approved as-read. Moved by AldermmiBrown that the meeting be adjourned.
