Min 08/11/1951 43 WichitaFalls, Texas Memorial Auditorium Building August 11, 1951 The Board of Aldermen of the City of Wichita Falls, Texas, met in called session on the above date, at 12:00 o'clock noon, in theCouncil Room of the Memorial Auditorium Building, with the following members present: Harold Jones Mayor R. P. Willis Francis L. Harvey J. R. Ray 1 Aldermen J. Paul Montgomery J. B. Hickerson City Clerk Frank Wood City Manager J. Walter Friberg City Attorney Mayor Harold zones announced the purpose of 'this meeting to be consideration of Ordinance No. 1570, annexing certain territory north of the present City Limits, and declared the Public Hearing set on August 2, 1951, to be open. D. H. Lefford, Manager, Frank Brooks aid Geo. W. Anderson, Attorneys, came forward and filed a protest to passage of Ordinance No. 1570, for aid on behalf of the Wichita City Lines, Inc. When no one else came forward to be heard, the following motion was had: Moved by Alderman Harvey that the Public Hearing be closed. Motion seconded by Alderman Montgomery and carried. Action on a request by City Manager, Frank Wood, to raise the hourly rate for city employees in the Garbage, Street and Water Departments, from 850 to $1.00 and hour, was deferred until Monday, August 13, 1951, at 7-30 o'clock P.M. for further information. Moved by Alderman Montgomery that the bid of Stuckey Construction Company in amount of $258,914.05 on 122 units of paving, known as Group 6, be accepted. Motion seconded by Alderman Willis and carried. REPORT OF THE ENGINEER AS TO FINAL COMPLETION OF IMPROVEMENTS ON AVENUE F, IN THE CITY OF WICHITA FALLS, TEXAS. TO THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: Gentlemen: I beg to report that Stuckey Construction Company, a partnership, of Wichita Falls, Texas, to whom was awarded the contract for the improvement of certain streets and avenues in the City of Wichita Falls, Texas, has completed the improvements on, AVENUE F, from the East Property Line of Britain Street (north) to the West Property Line of Harrison Street, known and designated as Unit or District No. 35. The said improvements having been completed in strict accordance with the terms of said contract and specifications of said work adopted by the City, I hereby recommend that the said improvements be finally accepted by the Board of Aldermen. RESOLUTION NO. 137 RESOLUTION ACCEPTING IMPROVEMENTS ON A PORTION OF AVENUE F AND DIRECTING THE ISSUANCE AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED. WHEREAS, the City of WichitaFalls heretofore entered into a contract with Stuckey Construction Company, a partnership, of WichitaFalls, Texas, for the making and construction of certain improvements on the following portion of Avenue F in said City, to wit: 44 AVENUE F, from the East Property Line of Britain Street (north) to the West Property Line of Harrison Street, known and designated as Unit or District No. 35. and, WHEREAS, such improvements have been completed upon said portion of Avenue F and have been inspected and found to be complete in accordance with the contract therefor, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT 1. The improvements on said portion of Avenue F be, and they are hereby, accepted; and the contract with reference to the constructioh of such improvements be, and is hereby, found and declared fully completed and performed. 2. The Mayor be, and he is hereby directed to issue and'execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and owners thereof for such improvements, and the City Clerk is directed to execute same and impress thereon the corporate seal, all in accordance with the proceedings relating to such improvements and assessments; such certificates shall be delivered to said Company. 3. This resolution shall take effect and be in force from and'after its passage. Moved by Alderman Harvey that Resolution No. 137 be approved and passed as read. Motion seconded by Alderman Montgomery and carried by the following vote: Yeas: Aldermen Willis, Harvey, Ray and Montgomery. Nays: None. Motion seconded by Alderman Willis and carried by the following vote: Yeas: Aldermen Willis, Harvey, Ray and Montgomery. Moved by Alderman Willis that the grass lease between the City of Wichita Falls and J. R. Parkey& Son, on 156 acres adjacent to Lake Kickapoo in Archer County, in J. C. Phelan Survey, Abstract 336, at $1.50 an acre, from 8-1-51 to 7-31-52, be accepted. Motion seconded by Alderman Harvey and carried. RESOLUTION NO. 140 IT IS RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALIS, TEXAS: That the Mayor aid City Manager of the City of Wichita Falls be, and the ✓ same are hereby authorized to purchase from Bertha F. Hicks, Caroline B. Howard and Ellen G. Howard, the surface rights in and to the following described land situated in Wichita County, Texas, to-wit: All of the Southeast one-fourth (SEI) of J. A. Scott Survey No. 14, Abst. No. 304, which is not now owned by the City of Wichita Falls; the City now owning the title to 40 acres of land out of said Southeast one-fourth heretofore conveyed to the City on January 27, 1926 by Deed recorded in Book 256, page 215, Deed Records of Wichita County, Texas; and 8.23 acres and 4.65 acres, more or less, the title to which was acquired by the City in Cause No. 10867, condemnation in the County Court of Wichita County, Texas, under order of Arthur Tipps, County Judge, dated October 26, 1950. Said land to be acquired also subject to all outstanding rights-of-way and easements heretofore granted affecting the said land, and sabject to surface lease executed by the said Bertha F. Hicks, Caroline B. Howard and Ellen G. Howard as lessors to M. W. Oliver as lessee, covering said surface fights for grazing and farming purposes, for a term of five years from and after September 1, 1951, The consideration to be paid for said interest in said land to be the sum of Fourteen Thousand ($14,000.00) Dollars in cash, and the execution and delivery of a quitclaim deed from the City of Wichita Falls, Texas, to Bertha F. Hicks, Caroline B. Howard and Ellen G. Howard, conveying all oil and gas to them in and under the two tracts of land of 1:.88 acres condemned by the City on October 26, 1950, Said Mayor is authorized to execute any and all instruments, deeds and conveyances necessary to consummate this transaction. Moved by Alderman Harvey that Resolution No. 140 be approved and passed as read. o- Motion seconded by Alderman Willis and carried by the following vote: Yeas: Aldermen Willis, Harvey, Ray and Montgomery. 0741 Nays: None. 47 Moved by Alderman Ray that City Attorney J.
