Min 05/14/1951 10 Wichita Falls, Texas Memorial Auditorium Building May 14, 1951 The Board of Aldermen of the City of Wichita Falls met in regular session , on the above date, at 8:00 o'clock P. M., in the Council Room of the Memorial Auditorium: Building, with the following members present: Harold Jones Mayor R. P. Willis Lloyd Thomas Francis L. Harvey # Aldermen J. R. Ras J. Walter Friberg City Attorney Moved by Alderman Montgomery that the Board of Al:flermen ratify and con- firm the action of the Mayor, Harold Jones, and City Clerk, J. B. Hickerson, wherein Resolution No. 125 was signed May 9, 1951, authorizing the City National Bank to substitute $900,000.00 U. S. Treasury 2 1/4% bonds, 1956-59, in lieu of $811y000.00 U. S. Treasury Bonds 1951-53, as security on Wiehit of Wichita Falls bank deposits. Motion seconded by Alderman Harvey and carried by the following vote: • Yeas: Aldermen Willis, Thomas, Harvey, Ray, Montgomery, and Brown. Nays: None. RESOLUTION NO. 126 RESOLUTION APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVEMENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF BELL STREET AND PORTIONS OF SUNDRY OTHER STREETS AND AVENUES IN THE CITY OF WICHITA FALLS, TEXAS, FIXING TIME AND PLACE FOR HEARING TO OWNERS OF ABUTTING PROPERTY AND OTHERS INTER- ESTED, AND DIRECTING THE CITY CLERK TO GIVE NOTICE. WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas, has heretofore ordered that each of the hereinafter described portions of streets and avenues in the city of Wichita Falls, Texas, be improved by raising, grading and filling same and by installing and constructing thereon concrete curbs and gutters where not already constructed on proper grade and line and by paving same with a Type "Q"-modified Asphalt Pavement on crushed conglomerate flexible base, together with incidentals and appurtenances, inclwiing storm sewers and drains, as and where shown on the Plans and in strict accordance with the Plans and Specifications now on file with the City; and, WHEREAS, bids were duly advertised for and received, were fully tabulated, canvassed and considered, and the bid of Stuckey Construction Company, having been found to be,the lowest and most advantageous, was accepted by the City of Wichita Falls, Texas; and, WHEREAS, a form of contract has heretofore been executed by the City of Wichita Falls, Texas, and by Stuckey Construction Company, for the making and constructing of said improvements, and said contract is now on file with the City; and, WHEREAS, the Board of Aldermen of the City of Wichita Falls has caused the City Engineer to prepare and file estimates of the coat of such improvements and estimates of the amounts per front foot proposed to be assessed against abutting property and the owners thereof, and such estimates have been examined; THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: 1. Such estimates be, and they are hereby, adopted and approved. 2. It is hereby found and determined that the cost of improvements on each portion of street and avenue, with the amount or amounts per front foot proposed to be assessed for such improvements against abutting property and the owners thereof on each such portion are as follows, to wit: n On BELL STREET, from the south property line of Avenue "E" to the north property line of Avenue "G", SAVE AND EXCEPT THE intersection of Bell Street with Avenue "F°, known and designated as Unit No. 27: the estimated cost of the improve- ments is $6,893.09; the estimated amount per front foot to be assessed against those parcels of property which abut and which front on said portion of Bell Street • and againet the owners thereof is $4.041; the estimated amount per front foot to • be asse$eainst those parcels of property which abut on said Bell Street but which front on some strbet other than Bell Street and against the owners thereof is $3.233. On BLUFF STREET, from the north property line of Fourth Street to the j north property line of Sixth Street, known and designated as Unit No. 29: the estimated cost of the improvements is $10,219.85; the estimated amount per front foot to be assessed against those parcels of property which abut and which front on said portion of Bluff Street and against the owners thereof is $5.657; the estimated amount per front foot to be assessed against those parcels of property which abut on said Bluff Street but which front on some street other than Bluff Street and against the owners thereof is $ None. On CHEROKEE STREET, from the south property line of Speedway Avenue to the north curb line of Woodrow Avenue, known and designated as Unit No. 33; the estimated cost of the improvements is $3,146.94; the estimated amount per front foot to be assessed against those parcels of property which abut and which front on said portion of Cherokee Street and against the owners thereof is $3.933; the estimated amount per front foot to be assessed against those parcels of pro- perty which abut on a aid Cherokee Street but which fronton some street other than Cherokee Street and against the owners thereof is $3.147. On WOODROW AVENUE, from the east property line of Cherokee Street west a distance of 160 feet to the existing pavement, known and designated as Unit No. 34: the estimated cost of the improvements is $1,345.23; the estimated amount per front foot to be assessed against those parcels of property which abut and which front on„said portion of Woodrow Avenue and against the owners thereof is $3.880; the estimated amount per front foot to be assessed against those parcels of property which abut on said Woodrow Avenue but which front on some street•or avenue other than Woodrow Avenue and against the owners thereof is $ - On AVENUE "F", from the east property line of Britain Street to the west property line of Harrison Street, known and designated as Unit No. 35: the estimated cost of the improvements is $1,700.82; the estimated amount per front foot to be assessed against those parcels of property which abut and which front on said portion of Avenue "F" and against the owners thereof is $ - ; the estimated amount per front foot to be assessed against those parcels of property which abut on said Avenue "F" but which front on some•street or avenue other than Avenue "F" and against the owners thereof is $2.603. On FIFTH STREET, from the west property line of Travis Street to the east property line of Burnett Street, SAVE AND EXCEPT the intersection of Fifth Street with Austin Street, known and designated as Unit No. 36; the estimated cost of the improvements is $8,257.30; the estimated amount per front foot to be assessed against those parcels of property which abut aid which front on said portion of Fifth Street and against the owners thereof is $5.161; the estimated amount per front foot to be assessed against those parcels of property which abut on said Fifth Street but which front on some street other than Fifth Street and against the owners thereof is $4.129. On NORTH FIFTH STREET, from the west edge of the pavement on North Broad- way to the east curb line of Grand Avenue, known and designated as Unit No. 37: the estimated coat of the improvements is $6,010.29; the estimated amount per front foot to be assessed against those parcels of property which abut and which front on said portion of North Fifth Street and against the owners thereof is $3.756; the estimated amount per front foot to be assessed against those parcels of property which abut on said North Fifth Street but which front on some street other than North Fifth Street and against the owners thereof is $3.005. On•FOURTH STREET, from the west curb line of Bluff Street to the east curb line of Broad Street, known and designated as Unit No. 39: the estimated cost of the improvements is $7,782.90; the estimated amount per front foot to be assessed against those parcels of property which abut and which front on said portion of Fourth Street and against the owners thereof is $5.837; the estimated amount per front foot to be assessed against those parcels of property which abut on said Fourth Street but which front on some street other than Fourth Street and against the owners thereof is $4.670. On.,Avenue "I", from the west property line of Taft Street to theeeast property line of Monroe Street, known and designated as Unit No. 42: the estimated cost of the improvements is $3,309.12; the estimated amount per front foot to be assessed against those parcels of property which abut aid which front on said portion of Avenue "I" and against the owners thereof is $3,842; the estimated amount per front foot to be assessed against those parcels of property which abut 12 on said Avenue "I" but which front on some street or avenue other than Avenue "I" and against the owners thereof is $3.074. On MCGREGOR AVENUE, from the west property line of Hollidry Road to the west property line of Grace Street, known and designated as Unit No. 46: the estimated cost of the improvements is $6,068.83; the estimated amount per front foot to be assessed against those parcels of property which abut and which front on said portion of Mc- Gregor Avenue and against the owners thereof is $3.665; the estimated amount per front foot to be assessed against those parcels of property which abut on said McGregor Avenue but which front on some street or avenue other than McGregor Avenue and against the owners thereof is $2.932. If 3. A.hearing be given and held by and before the Board of Aldermen of the City of Wichita Falls to all owning or claiming any property abutting upon said portions of streets and'avenues, as well as all owning or claiming apy interest in any such'prop- erty. Such hearing shall be given and held on the 28th day of May, A. D., 1951, at 8 o'clock P. M., in the Council Room in the Memorial Auditorium in the City of Wichita Falls, Texas, and the City Clerk is hereby directed to give notice of the time and place of such hearing and of other matters and facts in accordance with and under the terms of the powers and provisions of Chapter 106 of the Acts of the First Called Session of the Fortieth Legislature of the State of Texas, now shown as Article 1105b of Vernon's Texas Civil Statutes, under which law these proceedings are taken and had. Such notice shall be by advertisement inserted at least three times in a newspaper published in the City of Wichita Falls, Texas, the first publication to be made at least ten (10) days before the date of said hearing. !4. This Resolution shall take effect and be in force immediately from and after its passage. Moved by Alderman Thomas that Resolution No.126 be approved and passed as read. ORDINANCE NO. 1557-4 AN ORDINANCE REGULATING THE RATES OF THE SOUTHWESTERN BELL TELEPHONE COMPANY IN THE CITY OF WICHITA FALLS, TEXAS. Moved by Alderman Harvey that Ordinance No. 1557 ,a approved and passed as read. Motion seconded by Alderman Brown and carried by the following vote: Yeas: Aldermen Willis, Thomas, Harvey, Ray, Montgomery and Brown. Nays: None. Moved by Alderman Harvey that the request of the Wichita City Lines, Inc., for a straight 10¢ fare for adults and a straight 5¢ fare for school children be deferred to the next regular meeting May 28, 1951. Motion seconded by Alderman Montgomery and carried. ORDINANCE NO. 1558 AN ORDINANCE CLOSING AND ABANDONING CERTAIN PORTIONS OF THE ALLEY OF THE CITY 1 OF WICHITA FALLS, TEXAS, AND BEING: That alley through Block 138 of the Original Townaite of the City of Wichita Falls, Texas, from Sixth Street to Fifth Street in said city. RESERVING TO THE CITY ALL NECESSARY EXISTING EASEMENTS FOR UTILITIES, IF ANY ARE NOW IN SAID ALLEYS, WITH ADEQUATE DRAINAGE, AND PROVIDING THAT THE CITY SHALL, UNDER NO CIRCUMSTANCES, BE LIABLE FOR DAMAGES IN THE EVENT BUILDINGS ARE CONSTRUCTED OVER EXISTING SEWER OR WATER LINES BY VIRTUE OF THE MAINTENANCE AND OPERATIONS THEREOF, THE SAID PORTION OF SUCH ALLEY VACATED AND ABANDONED BEING, PARTICULARLY DESCRIBED AS FOLLOW 13 Moved by Alderman Ray that Ordinance No. 1558 be approved and passed as read. Moved by Alderman Harvey that the City Clerk be authorized to pay` $242.21 to the Kell Estate, the same being the final payment on the W. S. Curlee reimbursement Water Main Contract, Indian Heights Addition. Motion seconded by Alderman Willis and carried. Moved by Alderman Ray that the bid submitted by the Ransdell Construc- tion Company, in the amount of $137,850.00, to construct four 2 MG filters, filter building, fluoride feed room, and equipping for immediate operation two of the filters, at the Water Purification Plant, be accepted. Motion seconded by Alderman Willis and carried. ORDINANCE NO. 1559 ORDINANCE CANCELLING,ANNULLING AND RESCINDING THOSE PORTIONS OF CON- TRACT WITH STUCKEY CONSTRUCTION COMPANY IN-SO-FAR AS SAID PORTIONS RELATE TO THE CONSTRUCTION OF IMPROVEMENTS ON A PORTION OF ALMA STREET AND ON PORTIONS' OF CERTAIN OTHER STREETS AND AVENUES IN THE CITY OF WICHITA FALLS, TEXAS, CANCELLING, ANNULLING AND RESCINDING THOSE PORTIONS OF ALL ORDINANCES , RESOLU- TIONS AND PROCEEDINGS IN-SO-FAR AS THEY RELATE TO THE IMPROVEMENTS ON A PORTION OF ALMA STREET AND ON PORTIONS OF CERTAIN OTHER'STREETS AND AVENUES IN THE CITY OF WICHITA FALLS, TEXAS, AND DECLARING AN EMERGENCY. Moved by Alderman Willis that Ordinance No. 1559 be approved and passed as read, and declaring an emergency. Motion seconded by Alderman Ray and carried by the following vote: Yeas: Aldermen Willis, Thomas, Harvey, Ray, Montgomery and Brown. Nays: None. Action on an ordinance regulating the planting, protection, care, removal and control of trees in public places, was deferred for further study by the Board of Aldermen. Moved by Alderman Harvey that Mayor Harold Jones be authorized to sign a Cooperation Agreement, for and on behalf of the City of Wichita Falls, with the Housing Authority of Wichita Falls, in connection with their future program for securing additional low rent housing. Motion seconded by Alderman Thomas and carried. Moved by Alderman Harvey that a request By S. F. Blue, Chief Clerk, Wichita Falls Water Collection Department, to charge off a list of old balances accumulated from 10-1-1: to 10-1-47 and deemed to be nncollectable, be granted. Balances to be charged off are as follows: Water Credit balance/2 7.,0 7 Water debit balance $1487.91; Refuse credit balance $7.92; Refuse Debit balance $686.79. Motion seconded by Alderman Willis and carried. Moved by Alderman Thomas that the charity bill for March, 1951, Wichita General Hospital, in the amount of $7150.20, be paid, and direct the city clerk to draw a warrant for this bill. Motion seconded by Alderman Ray and carried. 14 Arch Greenwood appeared before the Council requesting that fire lanes '. be cleared in the blocks closed for the Wheat Festival. The Minutes of the meetings held April 17, April 23 and April 26th were read and approved as read. Moved by Alderman Harvey that the.meeting be adjourned.
