Res 058-2012 6/19/2012 RESOLUTION NO. _58-2012_ Resolution Authorizing The City Manager And Chief Of Police To Execute All Documents Necessary To Protest The Texas Alcoholic Beverage Commission’s Renewal Of A License To Serve Alcohol At 309 N. Scott Avenue WHEREAS, the City Council finds that the number of police calls to 309 N. Scott Avenue has been at an excessively high level, which consumes an inordinately large amount of police resources, thereby depriving our citizenry of some benefit of those resources; WHEREAS, the TABC has indicated a desire to receive all relevant data concerning the renewal of its liquor license for said location; and WHEREAS, the City Council finds that protesting the aforementioned license is undertaken as a governmental function that is a normal incident of the City as a matter of law and given by the state as part of the state’s sovereignty, to be exercised by the City in the interest of the general public for the purpose of assisting in the proper allocation of police resources. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The City hereby authorizes its staff to enter a protest in the TABC’s renewal of the license to serve alcohol at 309 N. Scott Avenue, and the City Manager and Chief of Police are authorized to execute all documents necessary to protest the Texas Alcoholic Beverage Commission’s renewal of said license. th PASSED AND APPROVED this the 19 day of June, 2012. . ______________________________ M A Y O R ATTEST: ____________________ City Clerk
