I. CALL TO ORDER
The meeting was called to order by Vice-Chairperson, Mr. David Cook, at 2:00 p.m.
Vice-Chairperson Cook proceeded to make the following comments:
a. This meeting is being televised live on Channel 1300. It will be replayed at
2:00 p.m. daily including Saturday and Sunday until the next live meeting is
aired which will be the second Wednesday of next month at 2:00 p.m.
b. Motions made by the Commission members include all staff
recommendations and developmental requirements listed in the staff report.
Any deviations will be discussed on a case-by-case basis and voted on
accordingly.
c. Applicants and citizens who wish to address the Commission or answer
questions from the Commission members are asked to please speak into the
microphone at the podium. This meeting is being taped and there is no
microphone to record statements made from the audience.

d. Please silence all cell phones during the meeting. If it is necessary for you to
have a cell phone conversation during the meeting, please use the hallway
outside this room.
II. ROLL CALL
Commission Vice-Chairperson Cook roll called commission and staff members.
III. PUBLIC COMMENTS
Mr. Cook asked if there were any comments from the public. With no response,
Mr. Cook closed public comments.
IV. APPROVAL OF MINUTES
Mrs. Cayce Wendeborn made a motion to adopt the August 12, 2020, minutes. Mr.
Blake Haney seconded the motion. The motion was passed unanimously.
VII. REGULAR AGENDA
1. Case C 20-13 — 3806 Iowa Park Road — Commercial Offices:
Request for a conditional use to allow for the commercial use of an
office in a Residential Mixed Use (RMU) zoning district.
Applicant/Owner: Dan Dilts, Dilts Construction
Ms. Cayce Wendeborn made a motion to approve the case, Mr. Jack Browne
seconded. Mr. Medellin presented the case and stated the owner and applicant, Mr.
Dan Dilts, owner and operator of Dilts Construction, had outgrown his current office
location and would like to relocate to the subject property. Mr. Dilts has worked
with an architect and presented plans for a 2,800 sq. ft. office to be constructed on
the subject property located in the northwest part of Wichita Falls, 300 ft. west of
the Iowa Park Road and City View Drive intersection.
The subject property is currently a 10-acre, undeveloped tract that Mr. Dilts
currently uses for agricultural purposes. The plans presented to staff show the
2800 sq. ft. facility would be on a small area of the 10-acre tract, approximately 172
ft. of the overall length and 180 ft. of the width of the property. If granted approval,
and post construction of the new office, Mr. Dilts would like to continue the
agricultural use of the remaining acreage for grazing cattle.
Conceptual drawings show plans for multiple offices, conference rooms, reception
area and payment service center. Mr. Medellin stated Mr. Dilts specialized in
owner financed properties and one of the proposed features would be a drive-thru
payment center where tenants could drive up, make their monthly payment and
make their way out onto Iowa Park Road. Landscaping plans had also been
received by staff for the location.
The proposed location is located in a Residential Mixed Use (RMU) district which is
primarily residential, therefore, an in-depth, impact review of the surrounding
properties was performed by staff. The property directly to the east of the subject
site is a vacant lot and residential uses to the west. Mr. Medellin advised there are
commercial uses further along Iowa Park Road, to the west is an auto repair facility

and civic uses to the east, including City View Elementary School. To the south
side of Iowa Park Road are industrial uses such as the railroad and Tryer
Processing.
Mr. Medellin stated the impact study shows no greater impact than the railroad,
Tryer Processing and a few other industrial uses near the subject property. The
trend for large residential acreage tracks is to set the residence back a good
distance from the roadway. For example, the first residential property to the west is
setback approximately 200 ft. from the roadway, whereas plans show the
commercial offices setback 50 ft. However, other commercial structures in the area
have a shorter setback from the roadway.
Mr. Medellin advised the Commission staff had mailed notices to 11 property
owners within the 200 ft. notification area with no responses. Staff recommended
the approval of this request to allow for the commercial use of an office at 3806
Iowa Park Road with the following conditions:
1. Obtain all necessary permits in accordance with city ordinances, adopted
building code and zoning regulations through the site plan review
process.
2. The plans submitted for the site plan review process must be identical to
those submitted for the conditional use permit in building size, height,
placement, parking count, vehicular circulation, ingress and egress points
to the site, screening, and landscaping. The Director of Development
Services may approve minor variations to the submitted plans to allow for
conformance with city ordinances.
3. Any proposed additional commercial structures, excluding carports,
additions to the approved 2,800 square feet structure, new or expansion
of uses, excluding those permitted by right by Section 3270 of Appendix
B, will require a conditional use permit from the Planning and Zoning
Commission
4. Any proposed lights provided to illuminate any parking facility or paved
area shall be designed to reflect away from any residential use and/ or
public street.
Mr. Cook asked if the applicant was present and wished to make a presentation.
Applicant was not present and there was no comment from the general public.
Vice-Chairman Cook opened the floor to the Commission for questions and
comments. Mr. Cook called for a vote. Motion passed unanimously with a vote of
6-0.
