The Board of Aldermen of the City of Wichita Falls met in regular session on the above date with the following members present: adopted. ing vote: R. E. Shepherd, Mayor, Oral Jones, ) P. B. Moved by Alderman Jones that the following resolution be Motion seconded by Alderman Hunt and carried by the follow - Yeas: Aldermen Hunt, Jones, Queisser, Curd, Patton. Nays: None. RESOLUTION WHEREAS, R.L. Miller, under date of May 18,.1907, as owner of the forty acres of land out of the S. E. Corner of the Thomas H. Garner Survey, Abstract No. 84, Certificate No. 3147, subdivided and platted said tract into forty blocks containing one acre each, and in connection therewith, did on the same date dedicate to the public a forty foot street around each of such blocks, being twenty feet off of each said blocks, it being provided, however, that such dedication should not become effective and the public should not have any right in said streets except as sales were made from the east side oflsaid forty acres, and WHEREAS, Geo. A. Smoot is the owner of block six and the portion hereby affected of block five and T. A. Litteken is the owner of blocks four and seven and the streets between such blocks have never been opened up and used by the public; and such blocks would better conform to the other block of the city if such streets were not opened up, but such named blocks were allowed to remain as one block without streets being opened between them and, WHEREAS, such owners have conveyed or agreed to convey to the City of Wichita Falls, Texas, certain streets on the outside of such blocks to conform to the platted streets of said city; and it would be to the best interests of said city to release and convey to such property owners all its right, title and interest in and to such streets between such blocks, therefore, BE IT RESOLVED, that such city hereby, in consideration of the deeding to it of such streets on the outside of such blocks and of the granting to it of the right to erect and maintain poles along the line between blocks five and six and seven and four to carry elec- tric and telephone wires and cables, should release and convey to such property owners of such blocks all its right, title and interest in and to the forty foot streets between blocks five, six, four and seven in the R. L. Miller Addition to the City of Wichita Falls, Texas, as shown in the dedication thereof of record in Volume 48 page 422 of the Deed Records of Wichita County, Texas; and be it further resolved that the Mayor, R. E. Shepherd, be and is hereby authorized to execute a quit- claim deed to Geo. A. Smoot covering the portions of blocks five and six so dedicated as streets and to T. A. Littiken covering the portions of blocks four and seven so dedicated as streets. Moved by Alderman Hunt that Taylor Brothers, contractors, be permitted to use 12 feet of the street at #812 Eleventh Street for storing building material for a period of 90 days. Moved by Alderman Jones that the hearing with reference to paving North Lamar Street from Wichita Street to Brook Avenue be continued until 7:30 O'Clock P. M., March 14th, 1927. Moved by Alderman Curd that the penalties, interest and cost on the above described properties rendered by Stephens Lumber Company be remitted for the year 1926 on account of taxes not having been paid due to the above adjustments. Moved by Alderman Hunt that the ninth estimate of Callahan, Whitham & McFarland covering construction on the Sewerage Disposal Plant in the amount of �11,408.40, and the engineering fee of Montgomery & Ward in the amount of 4285.21 be approved and allowed out of the Sewer Bond Fund. Moved by Alderman Hunt that the Mayor be authorized to negotiate with the Water Improvement District # 1 for rent of office space in the new auditorium building.
