The Board of Aldermen of the City of Wichita Falls, Texas met in regular session on the above date with the following members present: R. E. Shepherd, Mayor Oral Jones, ¢ J. W. Hunt, ¢ Frank Queisser¢- Aldermen, J. H. Patton, ¢ P. B. Curd, ¢ W. E. McBroom, City Clerk. W. E. George, City Attorney. The minutes of the previous meeting were read and approved. The hearing with reference to paving Brittain Street from Avenue "I" to the South line of Lot 7, Block 4, Jackson -Roberts Addition, was called and at the request of Commissioner Hunt, the following motion was put in order. Moved by Alderman Queisser that the hearing be con- tinued until 7:30 P. M. January 17, 1927. Motion seconded by Alderman Hunt and carried. A. L. Huey appeared before the Council and read the following recommendations from the City Plan Committee of the Chamber of Commerce. V "MINUTES OF THE CITY PLAN COMI ITTEE" The City Plan Committee met at the Chamber of Commerce Tuesday afternoon, January 4th, at 2 P. M. The following were pres- ent: A. L. Huey, Qhairman, Mrs. P. A. Welty, John W. Thomas, W. S. Curlee, President State Realtors Association, Mr. Stone, Secretary State Realtors Association, Charles I. Francis and Hubert Harrison, General Manager. A general discussion was had with reference to the status of zoning in Texas and with particular reference to the local situation in Wichita Falls. Mr. Francis, who has been retained as attorney by some citizens who are endeavoring to prevent the building of a filling station at the corner of Eleventh and Brook, has given the matter of zoning considerable study. He is of the opinion that the decision of the Texas Supreme Court in 1921 in the Spann case from the City of Dallas does not necessarily block all zoning in Texas for the reason that this case went up on a very faulty city ordinance of Dallas. He believes that Wichita Falls should adopt a complete modern zoning law with maps showing restricted areas, etc., and that a test case should be carried to the Supreme Court of the State on this law at once. Mr. Harrison outlined the plans that have been made by other cities. He stated that Representative Kemple of Tarrant County is preparing to introduce a bill for the passage of a State Enabling Act on zoning. Mr. Francis stated that he believed under the Home Rule Act the City of Wichita Falls now had all of the rights to adopt zoning legislation that the legislature had the power to give. He recommended immediate preliminary plans for the formation of a constitutional amendment to cure the objections raised in the deci- sion of the Spann case. It was the opinion of the Committee, upon the advise of Mr. Francis and other local attorneys, that the decision of the United States Supreme Court in the Euclid, Ohio case does not effect zoning in Texas at all. Upon motion of Mr. Curlee, seconded by Mr. Thomas, the Committee voted to recommend to the Board of Directors that four able attorneys of Wichita Falls be appointed and requested to draft a complete modern zoning ordinance for the City of Wichita Falls to be presented to the City Council for its adoption. The Committee recommended further that representatives of the Wichita Falls Chamber of Commerce be authorized to confer with officials of other Texas towns with reference to the most practical plans for securing a State Enabling Act or the passage of a consti- tutional amendment with reference to zoning. Considerable discussion was had concerning offset streets, dangerous sharp corners and street widening. Upon motion of Mr. Thomas, seconded by Mrs. Welty, the Committee recommended to the Board of Directors that the Chamber of Commerce use its influence actively with the City Council to secure, as soon as possible, the elimination of dangerous corners at Seventh and Brook, Eleventh and Harrison, Tenth and Brook, Tenth and Taylor, Tenth and Monroe, Tenth and Denver, Tenth and Grant, the widening of Tenth Street from Baylor to Van Buren; the opening of Huff Avenue from Harrison Street to Avenue "B"; and the promotion of a paved thoroughfare from Harrison Street to Hayes in the vicinity of Junior College. Moved by Alderman Hunt that the recommendations of the City Plan Committee of the Chamber of Commerce be accepted and the Committee be extended a vote of thanks for their interest manifested in civic matters. Motion seconded by Alderman Patton and carried. The hearing with reference to paving Bluff Street from Fourteenth to Fifteenth Streets was called and after hearing protests the following motion was put in order. Moved by Alderman Patton that the City Clerk be in- structed to issue a warrant for $925.00 to Webb Ransom to cover appraisal services on new buildings for the tax department for the year 1926. Moved by Alderman Patton that the water department be authorized to construct 650 feet of 2 inch galvonized pipe line on North First Street and North Broadway at an approximate cost of $227.50.
