The Board of Aldermen of the City of Wichita Falls met in regular session on the above date with the following members present: J. H. Patton, ) J. W. Hunt, ) Oral Jones, ) Aldermen, Frank Queisser,) P. B. Curd ) W. E. MCBroom, City Clerk, W. E. George, City Attorney. Moved by Alderman Jones that Alderman Patton be appointed Mayor Pro -tern to act during the absence from the City of Mayor R. E. Shepherd. Motion seconded by Alderman Hunt and carried. Move by Alderman Jones that the reading of the minutes of November 22ndAa postponed until the next regular meeting. Motion seconded by Alderman Hunt and carried. Moved by Alderman Hunt that the order under date of November 22nd, 1926, authorizing the Mayor to sign a Quitclaim Deed conveying to J. A. Kemp any interest the City might have in an unnumbered tri- angular lot located at the intersection of Avenue M, Taylor and Polk Streets,be rescinded. adopted. vote: Motion seconded by Alderman Jones and carried. RESOLUTION RESOLUTION CLOSING SPECIAL HEARING TO THE OWNERS OF PROPERTY ON A PORTION OF VICTORY STREET IN THE CITY OF WICHITA FALLS, TEXAS, AND DIRECTING PAVING CONTRACTOR TO PROCEED WITH THE IMPROVEMENT OF SAID PORTION OF SAID STREET AS HERETOFORE ORDERED AND AGREED: WHEREAS, on the llth day of October, A. D., 1926, by petitions duly presented to the Board of Aldermen of the City of Wichita Falls, Texas, a special hearing was granted and extended to the owners of property abutting Victory Street, from the West Property Line of Duvall Street to the East Curb Line of Van Buren Street, in said city, said hearing being duly advertised as required by law, and the City Charter, and due notice having been given all interested parties, and WHEREAS, said hearing by request has been continued from week to week and extended until the 29th day of November, A. D., 1926, at w..ieh time all interested and benefited parties were given a fair and impartial hearing before this Board, and at which time a certain petition presented to said Board was duly considered, and WHEREAS, the following named owners of properties on Victory Street, between Duvall and Harrison Streets, in said City, to -wit: George C. Reid, W. C. Russell, W. F. Weeks, V. F. Carpenter, Richard W. Thompson, A. A. Spencer, H. M. Parks, H. S. Woods, Mrs. W. H. Downing, T. G. O'Dell, D. B. King, John L. Gibbs, Otto M. Lambert, M. E. Perry, C. C. Cabiness, Hamilton Martin Investment Co., (By P. L. Pearson, Secretary), and V. H. Hooper, presented a certain petition in writing, requesting that the paving improvements on said first described portion of Victory Street be proceeded with, as per original specifications, plans and contracts, and that L. E. Whitham & Company, the successful bidders on said project be directed to proceed with the paving of said portion of said street. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN of the City of Wichita Falls, that said hearing be closed as toall parties and that all objections heretofore expressed and filed with said Board with regard to paving said portion of said street be and the same are hereby in all things expressly overruled and held for naught. It is further re- solved, directed and ordered by this Board that L. E. Whitham & Company proceed in accordance with the terms of thier bid and contract heretofore duly entered into, with the paving of said portion of Victory Street in said city. PASSED AND APPROVED, this, the 29th day of November. A. D. 1926. The hearing with reference t8 granting a Right of Way Franchise to the Wichita Valley Railway Company across and upon portions of Pecan Street and Mill Street was called, and after hearing no protests the fol- lowing motion was put in order. ORDINANCE NO. 850 AN ORDINANCE GRANTING THE WICHITA VALLEY RAILWAY COMPANY, ITS SUCCESSORS, ASSIGNS AND LESSEES, THE RIGHT TO CONTRUCT AND MAINTAIN A STANDARD GAUGE SIDE TRACK UPON AND ACROSS PECAN STREET AND UPON AND ALONG MILL STREET IN THE CITY OF WICHITA FAILS, WICHITA COUNTY, TEXAS. Moved by Alderman Hunt that Ordinance No. 850 be passed on its second reading. vote: Motion seconded by Alderman Jones and carried by the following Yeas: Aldermen Hunt, Jones, Curd, Queisser. Nays: None. Moved by Alderman Hunt that the City Treasurer be authorized and instructed to purchase one (1) 4500.00 Park Bond dated August 15th, 1914, from R. E. Huff at par and accrued interest. Motion seconded by Alderman Jones and carried. Moved by Alderman Jones that the bill of Ira S. Harris for special auditing services rendered during the month of November, 1926, in the amount of �200.00, payable 4112.00 out of the Water Fund and �88.00 out of the General Fund, be approved and allowed. Motion seconded by Alderman Hunt and carried. Moved by Alderman Hunt that the following expense accounts be allowed: 124 Dr. H. D. Fillmore, trip to medical meeting at Austin, �48.08. W. E. McBroom, trip to Austin with bonds, §68.00. W. E. George, trip to Austin with bonds, �40.00. Motion seconded by Alderman Jones and carried. ORDINANCE NO. 858 AN ORDINANCE AMENDING SECTION 3 OF ORDINANCE NO. 588, PASSED AND APPROVED BY THE BOARD OF ALDERMEN ON THE LOTH DAY OF AUGUST, 1925, AN ORDINANCE ENTITLED: "AN ORDINANCE DEFINING "MILK" AND CERTAIN MILK PRODUCTS, "MILK PRODUCER", "PASTEURIZATION", ETC., PROHIBITING THE SALE OF ADUL- ERATED AND MISBRANDED MILK AND MILK PRODUCTS, REQUIRING PERMITS FOR THE SALE OF MILK AND MILK PRODUCTS, REGULATING THE INSPECTION OF DAIRY FARMS AND MILK PLANTS, THE TESTING, GRADING, LABELING, PLACARDING, P-3- TEURIZATION, REGRADING, DISTRIBUTION, SALE AND DENATURING OF MILK AND MILK GRADES, THE CONSTRUCTION OF FUTURE DAIRIES AND MILK PLANTS, THE ENFORCEMENT OF THIS ORDINANCE, AND THE FIXING OF PENALTIES." Moved by Alderman Curd that the Mayor be authorized to sign a Pipe Line License Agreement with the Fort Worth & Denver City Railway Company, covering the construction of a 15" Sewer Line under the Fort Worth & Denver City tracks at Mile Post 114.57 on Second Street, and the City Clerk be authorized to issue warrant in the amount of $15.00 to cover the consideration therein mentioned. Motion seconded by Alderman Queisser and carried. Moved by Alderman Jones that the Correction Deed and Waiver of Restrictions from R. E. Huff on the major portion of Block 238, Original Townside be accepted and the following resolution be adopted. Motion seconded by Alderman Hunt and carried by the follow- ing vote: Yeas: Alderman Hunt, Queisser, Curd and Jones. Nays: None. RESOLUTION WHEREAS, on November 20th, 1914, Robert E. Huff, by deed duly recorded in the Deed Records of Wichita County, Texas, conveyed to the City of Wichita Falls, Texas, the major portion of Block No. 238, of the original townsite to the City of Wichita Falls, to be used for park purposes only, and WHEREAS, the Board of Aldermen of the City of Wichita Falls, and the citizens thereof, are desirous of using said premises for the building site for the new proposed municipal office building and audi- torium, and WHEREAS, the said Robert E. Huff has signed a waiver of all restrictions, of every kind and character, to the above property, and agreed that the said property may be used as a building site for the new municipal office building and auditorium. Upon motion made and seconded, the following resolution was i a25 unanimously adopted: NOW, THEREFORE, BE IT RESOLVED, by the Board of Aldermen of the City of Wichita Falls, Texas, that it take this means, in behalf of the citizens of Wichita Falls, of expressing to Robert E. Huff its heartfelt thanks and gratitude for this waiver, and the conveyance of this property to the City unrestricted, and which said saw value is estimated to be One Hundred Thousand Dollars (4100,000.00) Moved by Alderman Jones that the bill of John W. Ratliff in the amount of 4143.07 covering the reconstruction of side walks on Giddings Street be approved and allowed, out of the Street Fund. Motion seconded by Alderman Hunt and carried. Moved by Alderman Hunt that the City Clerk be instructed to draw warrant on the Street Improvement Fund in the amount of 4166.99, pay- able to J. 0. Polhemus, covering the cost of excavating for paving on Hamilton Blvd., abutting the Polhemus property. Motion seconded by Alderman Curd and carried. Wichita Falls, Texas. November 29, 1926. Hon. Gentlemen: This is to certify that the pavement on Sunset Drive, from the South Property Line of Sixth Street to the Center Line of Seventh Street, has been completed by L. E. Whitham & Company, in accordance with the Plans and Specifications therefor, heretofore filed with your honorable body. I, therefore, recommend that this pavement be accepted.
