The Mayor presented to the Board for its consideration an ordinance granting the Fort Worth & Denver City Railway Company the right to construct and maintain a standard track over and across a portion of Pecan and Mill Streets. Moved by Alderman Curd that the City Treasurer be authorized to purchase $5000.00 worth of Water Works Bonds dated February loth, 1920, at par and accrued interest. I,?oved by Alderman Hunt that the City Treasurer be instructed to call for redemption as of December 1st, 1926, Street Improvement Bond # 13, dated June 1st, 191.6, optional June 1st, 1926, amount w500.00. Motion seconded by Alderman Jones and carried. Moved by Alderman Jones that the expense account of J. T. Murrell, City Chemist, in the amount of $18.75, on trip to Forth Worth to attend the health officer's school be approved and allowed. Motion seconded by Alderman Hunt and carried. The hearing with reference to paving Forest Avenue from York to Lexington Sts., continued from November 1st, 1926, was called and after hearing the protests of A. H. Fell, C. C. Grantham, W. D. Howard, J. W. McCurly, Clarence Dodge and J. M. Baber, the following motion was put in order. Moved by Alderman Hunt that the hearing be continued until 7:30 o'clock P. M. November 22nd, 1926. Motion seconded by Alderman Patton and carried. Moved by Alderman Hunt that the hearing with reference to the delaying of improvement on Victory Street from Duvall to Harrison be continued until 7:30 o'clock P. M. November u9th, 1926. Motion seconded by Alderman Jones and carried. Moved by Alderman Patton that the building inspector be auth- orized to issue a permit to W. 0. Hudgins for the construction of a frame grocery store at 2306 Grant Street. Motion seconded by Alderman Hunt and carried. Moved by Alderman Queisser that the Gulf Refining Company be permitted to remove 70 feet of the Parkway on Holiday Street between Tenth and Eleventh Streets and pave same at their own cost. Motion seconded by Alderman Hunt and carried. Moved by Alderman Patton that the Mayor be apt}�h�orized to issue a deed conveying to the Panhandle Lodge #341 IOOF, ii =:i East -J, Lot 284, Block F, Riverside Cemetery; this conveyance being made at the request of J. R. Ogle, Secertary of the Lodge, who advises that J. ;11. Houlihan was buried by the Odd Fellows on this lot several years ago and that no deed had ever been issued conveying this portion of the lot to anyone. Motion seconded by Alderman Curd and carried. Moved by Alderman Patton that the bill of M. W. Hibbs in the amount of $427.65 covering the construction of storm sewers on Taylor Street be approved and allowed. RESOLUTION ACCEPTING THE I21PROVEMENTS ON GALVESTON STREET FROM THE WEST CURB LINE OF MILTS STREET TO THE CENTER LINE OF MISSISSIPPI STREET, AND DIRECTING THE MAYOR AND CITY CLERK TO ISSUE CERTIFICATES OF SPECIAL ASSESSMENT LEVIED AGAINST THE VARIOUS LOTS OR TRACTS OF LAND AND THE OWNERS THEREOF ABUTTING UPON SAID PORTION OF SAID STREET. WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas, has heretofore ordered that Galveston Street from the West Curb line of Millt Street to the Center Line of Mississippi Street, be improved, by raising, grading, and filling same, and installing concrete curbs and gutters and paving same, and after due notice and hearing, special assessments were levied against the various lots and tracts of land and the owners thereof abutting upon the said portion of said street, and contract for the making and construction of the said improvements was entered into with L. E. Whitham & Company, and, WHEREAS, the said L. E. Whitham & Company, has fully per- formed -its said contract, and the said improvements have been made and constructed in accordance with the said contract and the speci- fications therefor, and to the entire satisfaction of this Board: THEREFORE: BE IT RESOLVED BY THE BOARD OF ALDE181EN OF THE CITY OF .ICHITA FALLS, TEXAS, 1. That the said improvements on said portion of said street be and the same are hereby accepted and L. E. Whitham & Company and the sureties on its construction bond are hereby released from any further obligation for, or on account of, the contract or bond for the making and constructing of said improvements. M That this resolution does not and shall not in any way effect the bond of the said company for the maintenance of the said improve- ments, but such maintenance bond shall and does remain in full force and effect. 3 That the :Mayor and City Clerk be and they are hereby auth- orized, instructed, and directed to issue to the said L. E. 1,hitham & Company, certificates of special assessment, in evidence of the various assessments levied against the respective lot or parcels of land abutting upon said portion of said street, and the owners thereof, and against e%hich special assessment has been levied, reciting the description of such property, the amount of the assessment against same, the owner thereof, the terms of payment thereof the rate of interest, the date of completion and acceptance of said improvements, the lien of the said assessment and the personal obligation and liability of the owner of the property, and reciting that all proceed- ing with reference to making such improvements have been regularly had in accordance with the Law, the Charter of said City, the terms of the certificate, and that all prerequisites to the fixing of a lien and claim of personal liability evidenced by the certificates have been performed, and containing other appropriate and pertinent recitals, all in accordance with the contract with the said company and the law in force in the City, and the proceedings of this Board. ' Sibley St RESOLUTION Holliday to Broad RESOLUTION ACCEPTING THE VhORK OF PAVING AND OTHERWISE IMPROV- ING OF A PORTION OF SIBLEY AVENUE AND•AUTHORIZING THE EXECUTION AND DELIVERY OF SPECIAL ASSESSMENT CERTIFICATES. BE IT RESOLVED BY THE -BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT WHEREAS, the City Engineer has certified that the paving and otherwise improving Sibley Avenue from its intersection with the East property line of Holliday Street to its intersection with the West property line of Broad Street, has been completed by the Plains Paving Company in accordance with the plans and specifications therefor and the said City Engineer recommends the acceptance of the said work by the City. NOW THEREFORE BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS. That said paving and other improvements be and the same are hereby accepted by the City of Wichita Falls, Texas, and the Mayor be and is hereby authorized and directed to execute Special Assessment Certificates evidencing the indebtedness. of the owners of the property abutting on said portion of street, in the name of the City of Wichita Falls, and the City Clerk is hereby authorized and directed to attest same and to impress the sale of the City of Wichita Falls, Texas, and to deliver said Special Assessment Certificates to the Plains Paving Company, as set forth in the contract, for the above named improvements, all in accordance with the ordinances and resolutions heretofore adopted and passed by the City of Wichita Falls, with reference to the above described improvements. ORDINANCE NO. 841 AN ORDINANCE PROVIDING FOR A TAX ON DOGS, PROVIDING FOR VACCINATION OF DOGS AGAINST RABIDS BY A LICENSED VETERINARI_SN AS A CONDITION PRECEDENT TO THE ISSUANCE OF SUCH LICENSE TAG, THE FEES TO BE CHARGED FOR SUCH VACCINATION AND PROVIDING FOR THE METHOD OF THE COLLECTION OF SAID TAX AND PROVIDING A PENALTY, REPEALING ORDINANCES NOS. 396 and 569 AND ALL OTHER ORDINANCES IN CONFLICT HEREWITH. Moved by Alderman Queisser that Ordinance No. 841 be passed on its third and final reading, and be adopted as read. Motion seconded by Alderman Jones and carried by the following vote: Yeas: Aldermen Curd, Queisser, Jones, Hunt and Patton. Nays: None. Moved by Alderman Jones that the bill of L. E. Whitham & Company in the amount of 52910.95 covering the final estimate on the Municipal Park Road be approved and allowed and the Mayor and City Clerk instructed to issue two notes to cover this payment as follows: 1 Note in the amount of $1455.50 payable in 6 months after date out of the Park Fund. 1 Note in the amount of 01455.45 payable in 18 months after date out of the Park Fund, both with interest at 6% per annum. Motion seconded by Alderman Hunt and carried. Moved by Alderman Patton that the salary of Ivy Gonzales and Clift Kiersey, members of the Police Department, be raised $10.00 per month effective December 1st, 1926. Motion seconded by Alderman Jones and carried. Moved by Alderman Hunt that the matter of re -arranging Sewer lines to serve Dr. V. E. Wratten and J. C. Martin be referred to Commissioner Patton for necessary action, provided the City be not called upon to pay more than one-half of re-arrangement.cost. Motion seconded by Alderman Jones and carried. Moved by Alderman Curd that the Mayor be premitted to be absent from the next regular meeting of the Board. Motion seconded by Alderman Patton and carried.
