BE IT RESOLVED, by the Board of Aldermen of the City of
Wichita Falls, Texas, that the City of Wichita Falls, Texas, bargain,
sell and convey the following described property to J. Y. McQuigg, Jr.
of .ichita County, Texas, for a cash consideration of Eight Hundred
& N01100 Dollars (§800.00), and that Mayor R. E. Shepherd be authorized
to execute a warranty deed in the name of the City to said property
to J. Y. McQuigg, Jr. Said deed shall also recite that the City
assumes all taxes on the following property for the year of 1926 and
all prior years:
"That portion of Lots Nos. 3 and 4, in the Taylor
Subdivision to the City of Wichita Falls, Wichita
County, Texas, and being described by metes and
bounds as follows, towit: Beginning at the southwest
corner of Lot No. 2 of the Taylor Subdivision; Thence
. st with the south line of Taylor Subdivision 54.7
feet to a point; Thence north in a northeasterly
direction 148.2 feet to a point; in west line of Lot

authorized to issue a permit to J. C. Winfrey for the construction
of a business building at 1915 Grant Street.

to draw warrant payable to Mrs. Charlotte Montgomery for P650.00 to
cover the purchase of Block 158, Original Townside; said 5650.00 to
be paid only when all city, county, state and school taxes are paid
and warranty deed has been furnished the City.

VIDING FOR THE COLLECTION OF SUCH ASSESSMENTS, AND FOR THE ISSUANCE OF

of Ohio to the East Property Line of Indiana Avenue, together with con-
struction bonds and maintenance bonds required thereby, are this day pre-
sented to the Board of Aldermen for adoption and approval; and,
WHEREAS„ the Bid of L. E. Whitham & Company for the making and
construction of the improvements provided for in the said contracts, has
after due advertisement and notice bee made and upon opening of the said
Bids, said contract was awarded to said Company; and
WHEREAS, it is deemed necessary to set aside and provide for
the payment of all that portion of the cost required in the said contract
to be paid by the City of Wichita r'alls;

prices named therein and u on the terms therein set forth binding the City
of Wichita Falls, Texas, to do and perform all work of excavation upon
said street, as is provided in the contract, being one contract for said
street, are this day presented to the Board of Aldermen for adoption and
approval, and
INIEREAS, It is deemed advisable to enter into said contract upon
the terms set forth therein and for the compensation therein provided.

WHEREAS, the City Engineer has certified that the paving
and otherwise improving Oak Street from its intersection with the
Wichita Valley Railway Tracks from its intersection with the west
property line of Mississippi Street , has been completed by the Plains
Paving Company in accordance with the plans and specifications therefor
and the said City Engineer recommends the acceptance of the said work
by the vity.
NOVI THEREFORE BE IT RESOLVED BY THE BOARD OF ALDERMEN OF
THE CITY OF WICHITA FALLS, TEXAS:
That said paving and other improvements be and the same
are hereby accepted by the City of Wichita Falls, Texas, and the .mayor
be and is hereby authorized and directed to execute Special Assessment
Certificates evidencing the indebtedness of the owners of the property
abutting on said portion of street,in the name of the City of Wichita
Falls, and the City Clerk is hereby authorized and directed to attest
same and to impress the Seal of the City of Wichita Falls, Texas, and
to deliver said Special Assessment Certificates to the Plains Paving
Company, as set forth in the contract, for the above named improvements,
all in accordance with the ordinances and resolutions heretofore adopted
and passed by the City of Wichita Falls, with reference to the above

of constructing curbs along said portion of said street, and not exceeding

said property is the property that will be benefited by means of said im-

by law and the City Charter and the proceedings of this Board for such
reports, and same has been examined and corrected:

That said report of City Engineer filed on the 28th day of
December, 1925, be and it is hereby adopted and approved.

any other matters or things in anywise incident to or connected with the
said improvements, contract, proceedings, or assessments thereof, or method

That any claim for damages shall be made in writing and shall
set forth the matters and things in the manner and form provided and re-
quired by law and the provisions of the City Charter. And other claims
or matters may be presented either orally or in writing and at such hearing
all claims, protests, and objections whatsoever will be passed upon by the
Board of Aldermen and said hearing may be continued from time to time until
all have been fully and fairly heard, the said hearing will be closed, and
at said hearing and from the facts before it the Board of Aldermen will
d-termine the amounts to be assessed against each lot or parcel of land
and against the owner thereof, and will determine the lots or paroles bene-
fited by means of said improvements, and will determine the amount of damages,
if any, ro each lot or parcel of property and the owner thereof, the en-
hanced value of property by means of said improvements, and will correct
any errors, mistakes, or invalidities in any proposed assessment and in any
proceeding with reference to the making or construction of said improve-
ments, or the levying of assessments therefor, -and will thereafter, by
ordinance, make and levy assessments against each such piece or parcel of
property and against the owners thereof in the proportion provided and in
the manner and form and in accordance with the terms required by law in
force in this City, and the City Charter, and the ordinances, resolutions,
and other proceedings of this Board, and such assessments when levied shall
be a first and prior lien.
After such hearing is closed anyone desiring to appeal therefrom
shall prosecute and appeal to any uourt having jurisdiction within twenty
(20) days from the date such hearing 1s closed and final assessment levied
and not thereafter, and all persons, firms, corporations, estates, and
other parties shall after the expiration of twenty (20) days from the levy-
ing of such assessment, be forever barred and estoppel in any manner
doubting or resisting same or asserting any error, irregularity, mistake,
or invalidity therein.

HUNDRED THOUSAND DOLLARS ($500,000.00), AUTHORIZED AT AN ELECTION DULY
CALLED AND HELD FOR SUCH PURPOSE: PRESCRIBING FORM OF BONDS LEVYING
A TAX ON EACH ONE HUNDRED DOLLARS (^100.00) VALUATION OF TAXABLE PROPER-

WHEREAS, on the 30th day of September, 1926, pursuant to
notice duly given, an election was held in the City of Wichita Falls,
Wichita County, State of Texas, for the purpose of submitting to the
qualified property tax paying voters in said City the following pro-
position:
"Shall the Board of Aldermen of the City
of Wichita Falls be authorized to issue
bonds of said City in the sum of Five
Hundred Thousand Dollars (b500 000.00) to
mature serially in from one (11 to forty
(40) years from the date thereof, bearing
interest at the rate of four and three-
fourths per centum ( 4 3J4go) per annum,
payable semi-annually, for the purpose
of providing funds for the construction
of public buildings to -wit: A Municipal
Office Building and Auditorium in and for
said City; and to levy a tax sufficient to pay
the interest of said bonds as it accrues and
the principal at maturity." and,
WHEREAS, as shown by the canvass of the returns of said election
as duly certified and returned to this Board by the Judges and clerks
thereof, this Board of Aldermen found and hereby declares of record that
said election was called and notice thereof duly given, and conducted in
striet conformity with the requirements of law; and that there were cast
at said election 738 votes, of which 462 votes were in favor of and 276
votes were against the issuance of said bonds, and
WHEREAS, the lawful majority of the qualified property tax paying
voters voting on said proposition cast their ballots in favor of the
issuance of said bonds, the issuance thereof has been duly authorized, NOVI

a sinking fund to pay the principal thereof at maturity, a tax of 'Three

property in said City of Wichita r'alls, Texas, shall be annually levied on
said property and annually assessed and collected, or so much thereof as
shall be necessary or in addition theretom as may be required until the
said bonds with interest thereon have been fully paid; and that the said
tax of 'Three Cents (3¢) is here now levied for the current year and so much
thereof, as still be necessary or in addition thereto as may be required
is hereby levied for each succeeding year while said bonds or any of them
are outstanding, and the same shall be annually assessed and collected and
applied exclusively to the purpose herein stated.
SECTION 5. The fact that there is an urgent public need for

permanent improvements of the streets in said City for preservation
of the health of the community, creates an emergency and public
necessity; that the rules requiring ordinances to be read on three
separate days be suspended, and said rules are hereby suspended, and
this ordinance shall take effect and be in full force from and after
its passage, and it is so ordained.

WHEREAS,on the 30th day of September, 1926, pursuant to notice
duly given, an election was held in the City of Wichita Falls, Wichita
County, State of Texas, for the purpose of submitting to the qualified
property tax paying voters in said City the following proposition:
"Shall the Board of Aldermen of the
City of Wichita Halls be authorized
to issue bonds of the City of Wichita
Falls in the sum of One Hundred Thousand
Dollars, (4100,000.00), to mature serially
in from one (1) to forty (40) years from
the date thereof, bearing interest at the

WHEREAS, as shown by the canvass of the returns of said election
as duly certified and returned to this Board by the Judges and Clerks
thereof, this Board of Aldermen found and hereby declares of record that
said election was called and notice thereof duly given, and conducted in
strict conformity with the requirements of law; and that there were cast at
said election 737 votes of which 521 votes were in favor of and 216 were
against the issuance of said bonds, and
WHEREAS, a lawful majority of the qualified property taxpaying
voters voting on said proposition cast their ballots in favor of the
issuance of said bonds, the issuance thereof has been duly authorized, NOW,
THEREFORE,
