The $rearing with reference to the application of the
Cowling Lumber and Building Company for a permit to construct and
operate a lumberyard on Lots Numbered '1 to 5, Block 106-A, High-
land Addition was called and after hearing the protests of VIt. i.'
Gordon, J. L. Dodson, C. I. Halford, C. H.- Jones, 1°rs. Douglass,
W. T. McMurry, Mrs. Dell Richardson, Mr. Berger and L. R. Asley
the following motion was put in order.

erection of a lumber yard by the Cowling -Lumber and Building
Company at the above named location be refused.

RESOLUTION.
RESOLUTION MAKING APPROPRIATION TO COVER THE COST
OF CONSTRUCTING A SEWERAGE TREATMENT WORKS FOR THE
CITY OF WICHITA BALLS.
WHEREAS, the Board of Aldermen has heretofore sub-
mitted to the qualified taxpaying voters of the City of Wichita Falls,
the proposition, Shall the.Board of Aldermen be authorized to issue
bonds in the amount of $375,000.00 for the purpose of extending and
improving the sewerage system in and for said City, and
WHEREAS, at said election said bonds were duly
authorized to be issued and have been issued and sold; and
WHEREAS, bids have been duly advertised and
received and a contract has been duly and legally entered into for the
construction of a modern sewerage treatement works;
THEREFORE, Be It Resolved by the Board of Aldermen
of the City of Wichita Falls, Texas:
Section 1; There is hereb appropriated out of the
Sewer Bond Fund of the said City the sum of 1267,800.00 to cover the
contract price of said sewerage treatement works and the sum of
$17,000.00 to cover contingencies as they arise.
Section II; The City Clerk is hereby authorized to
draw warrants on the above stated appropriation upon the receipt of
duly approved estimates prepared by the supervising engineers on said
project, and duly allowed by the Board of Aldermen, payable to the
Contractors, and the City Treasurer, is hereby authorized to pay any
and all warrants so drawn, provided they do not exceed the amount of
this appropriation.

Lumber Company in the amount of $135.05 covering part of the cost of
reconstructing the band stand in Bellevue Park be approved and allowed
out of the general fund contingent appropriation .

of C. C. Bunnenberg, Park Superintendent, covering trip to Dallas
to buy films for the free picture shows in Parks in the amount of
$19.00 be approved and allowed.

Moved by -Alderman Jones that the renewal subscrip-
tion to the Texas League of Municipalities in the amount of $40.00
covering the period from July 1, 1926 to June 3o, 1927 be approved and
allowed.

ins'trudted to advertise for bids on daily balances to be paid by
the local banks desiginated as such depositories for the year be-
ginning August 1, 1926 and ending July 31, 1927.

Moved by Alderman Hunt that the City Clerk be in-
structed to advertise for bids for the printing of legal noticies for
the year beginning August 1, 1926 and ending July 31, 1927,

Moved by Alderman Jones that the City Treasurer
be authorized to purchase, at par and accrued interest, ten (10)
water works bonds in the amount of $10,000.00 dated February 10,
1920 maturing February 10, 1960 from H. C. Burt and Company, Dallas,
Texas; said bonds to be taken up out of the available sinking fund
and cancelled.

RESOLUTION DECLARING THE NECESSITY OF IMPROVING
PORTIONS OF SIXTH STREET, BULLINGTON STREET,
FILMORE STREET, ADAMS STREET, NORTH SEVENTH STREET,
NORTH THIRD STREET, AVENUE "K", HUFF AVENUE, TAYLOR
STREET, THIRTEENTH STREET, AND, BRIDWELL STREET,
IN THE CITY OF WICHITA FALLS, TEXAS, STATING THE
NATURE OF SUCH IMPROVEMENTS, AND THE METHOD BY WHICH
IT IS PROPOSED THAT PAYMENT BE MADE THEREFOR, AND
DIRECTING THE CITY ENGINEER TO HAVE PLANS, PROFILES,
SPECIFICATIONS AND ESTIMATES OF THE PROPOSED IM-
PROVEMENTS PREPARED.
BE IT, AND IT IS HEREBY RESOLVED BY THE CITY OF

I.
IT is necessary that. -
The unpaved portion of Sixth Street, from the East
Property Line of Filmore Street, to the East Property Line of Polk
Street.
The unpaved portion of Bullington Street, from the
Center Line of Sunset Drive, to the East Property Line of Polk Street,
The unpaved portion of Filmore Street, from the South
Property Line of Bullington Street, to the North Property Line of
Sixth Street,
The unpaved portion of Adams Street, from its inter-
section the South Curb Line of Third Street, to its intersection
with the North Curb Line of Seventh Street,
The unpaved portion of North Seventh Street, from its
intersection with the West Curb Line of North Brook Avenue to its
intersection with the East Curb Line of Vermont Avenue,
The unpaved portion of North Third Street, from its
intersection with'the Present Pavement on North Broadway to its inter-
section with the West Property Line of Grand Avenue,
The unpaved portion of Avenue "K" from its intersec-
tion with the West Curb Line of Giddings Street to its intersection
with the East Property Line of Joline Street,
The unpaved portion of Huff Avenue between Clark
Street and Marshall Street,
The unpaved portion of Taylor Street between Ninth
Street and Tenth Street,
The unpaved portion of Thirteenth Street between
Broad Street and Burnett Street,
The unpaved portion of Bridwell Street from
the South Property Line of Pearl Street to the North Curb Line of
Speedway,
be improved by raising, grading, filling and paving the same, and
installing concrete curbs and gutters, and that the same be improv-
ed with one of the following methods and materials, to -wit:
(a) Concrete
(b) Brick
(c) Willite Process Asphalt
(d) Tarrenite Bitulithic

II.
The City Engineer is hereby directed to have plans,
profiles, specifications and estimates embracing the foregoing ma-
terials and plans of improvements prepared, and to file the same
with the Board of Aldermen, the City Engineer being so instructed,
there being no City Manager.
III.
The said improvements shall be paid for in the
following manner, to -wit -
The benefitted and abutting property, and the
owners thereof, shall be assessed and pay all of the cost of in-
stalling curbs and not exceeding ninety-eight per cent of the re-
maining cost of such improvements, and the City of Wichita Falls
shall pay the remainder.
The sums payable by the benefited property and the
owners thereof shall be payable in six (6) equal installments, the
first of which shall be due on or before thirty (30) days after date
of completion and acceptance by the City of such improvements; the
second shall be due on or before one (1) year after such date; the
third shall be due on or before two (2) years after such date; the
fourth shall be due on or before three (3) years after such date; the
fifth shall be due on or before four (4) years after such date; the
sixth shall be due on or before (5) years after such date, the entire
amount of such sumes shall bear interest from the date of such com-
pletion and acceptance and until paid at the rate of eight (8%) per
annum, payable annually, but such property, and the owners thereof,
shall have the privilege of paying any or all of such installments,
at any time before maturity and the failure to pay any installment
upon the maturity thereon shall at the option of the owner and
holder of the certificate of special assessment issued in evidence
thereof, mature the entire amount then unpaid; and the sums pay-
able by the respective lots or parcels of property abutting upon
the said improvement, and benefited thereby, shall be assessed
against each lots or parcels and against the owners thereof, and
shall be a personal liability of such owner and a first and prior
lien and charge against such property, superior to all other liens,
claims and charges and demands of whatsoever kind, excepting only
State, County and Municipal taxes.
No assessment shall be levied against any lot or
parcel of land, or the owner thereof, 1n excess of the special
benefits to such lot or parcel of land in enhanced value thereof by
means of such improvement, and no assessment shall be levied until
after the notice and hearing as provided in the Charter and Laws in
force and effect in this City, and in the ordinance and proceedings
of the Board of Aldermen applicable thereto.
IV.
Upon the completion and acceptance of such improve-
ments, if same shall have been performed by contract, then certificates
in evidence of the assessments levied against the respective lots or
parcels of property, and the owners thereof, shall be issued to the
contractor or party performing and executing the work of such improve-
ment and containing recitals lawful and properly applicable thereto,
and the said improvements shall be executed, and ordinance levying
the assessment, and any other matters with reference to said improve-
ment shall be done and performed in the manner and form provided by
the Charter and Laws in force and effect in this City, and the pro-
ceedings, ordinances and resolutions of the Board of Aldermen.
V.
Each street or portion of street herein named to be
improved shall be and constitute a separate and independent unit of im-
provement. The construction of said improvements on each particular
street or portion thereof named to be improved shall be wholly independ-
ent of the construction on any other street or portion thereof to be
improved. The assessments to be levied on each portion or portions
thereof named to be improved shall be made according to the improvements
on that particular street or portion thereof so named, and in accordance
with the benefits accrueing to the property by reason of said improve-
ments on that particular street or portion thereof named, wholly and
independent of the cost and of the benefits accruing by reason of the
improvements on any other portion of streets named to be improved.
VI.

That the said plans, profiles, and specifications
and estimates, be and they are hereby adopted and approved as
those under, by, and in accordance with which said improvements
shall be made and constructed,

That the City Clerk be and he is hereby directed to
advertise for competitive bids for the making and construction of
the said improvements, in the manner and for the length of time
and in the form required and provided by the City Charter and
laws in force and in effect at this time, and by the ordinances
and proceedings of this Board and such bi s will be received until
and shall be opened on the ,2� day of 1926, at 7:30

and a series of business buildings at the intersection of Polk
Street and Avenue "A" be received and the City Clerk be instructed
to advertise for a public hearing for the purpose of hearing pro-
tests at 7:30 P. M. o'clock, July 26, 1926 in the Council Chamber
in the basement of the City National Bank Building.

Moved by Alderman Queisser that the police department
be authorized to buy a Dodge car at a cost of 4570.00 and one second
hand Ford payable $200.00 in cash and a .370.00 in a note due in nine
(9) months at 6/ per annum and the Mayor and City Clerk be authorized
to sign said note.

Moved by Alderman Jones that the Mayor be authorized
to issue deed to Mrs. Charlotte Montgomery conveying a small strip
of land beginning at a point in the North line of Front Street where
the East line of Adams Street intersects the said North line of Front
Street; thence North 35 degrees west approximately 59 feet to a point
in the South line of the LR.'E. Montgomery tract as defined in the
U. S. Court decree, dated April 29, 1921,; thence North 55 degrees
and East approximately 15 feet; thence South 35 degrees and East
approximately 59 feet to a point in the North line of Front Street;
thence South 61 1/2 degrees west approximately 15 feet to place of be-
ginning.
