in regular session on the above date with the following members

There being no quorum present it was moved by Alderman
Queisser and seconded by Alderman Hunt that the meeting be adjourn-

RESOLUTION ACCEPTING THE IMPROVEMENTS ON BROOK STREET FROM
THE SOUTH PROPERTY LINE OF KEELER AVENUE TO THE 10 FEET
WEST PROPERTY LINE OF SPEEDTAY, AND DIRECTING THE MAYOR AND
CITY CLERK TO ISSUE CERTIFICATES OF SPECIAL ASSESSMENT
LFVIED AGAINST THE VARIOUS LOT, OR T'ACTS OF LAND AND THE
OWNERS THEREOF ABUTTING UPON SAID PORTION OF SAID STREET.
WHEREAS, the Board of Aldermen of the City of Wichita Falls,
Texas, has heretofore ordered that Broo, Street from the South property
line of Keeler Avenue to the 10 £t. North property line of Speedway,
be improved by raising, grading, and filling same, and installing
concrete curbs and gutters and paving same, and after due notice
and hearing, special assessments were levied against the various lots
and tracts of land and the owners thereof abutting upon the said portion
of said street, and contract for the making and construction of the said
improvements was entered into with L. E. Whitham and Company, and,
THEREAS, the said L. E. Whitham and Company, has fully per-
formed its said contract, and the said improvements have been made and
constructed in accordance with the said contract and the specifications
therefor, and to the entire satisfaction of this Board:
THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE
CITY OF WICHITA FALLS, TEXAS,
I.
That the said improvements on said portion of said street
be and the same are hereby accepted and L. E. Whitham and Company and
the sureties on its construction bond are hereby released from any
further obligation for, or on account of, the contract or bond for the
making and constructing of said improvements.
II.
That this resolution does not and shall not in any way
effect the bond of the said company for the maintenance of the said
improvements, but such maintenance bond shall and does remain in full
force and effect.
III.
That the mayor and City Clerk be and they are hereby
authorized, instructed, and directed to issue to the said L. E..
Whitham and Company certificates of special assessment, in evidence
of the various assessments levied against the respective lot or parcels
of land abutting upon said portion of said street, and the owners thereof
and against which special assessment has been levied, reciting the
description of such property, the amount of the assessment against same,
the owners thereof, the terms of payment thereof the rate of interest,
the date of completion and acceptance of the said improvements, the lien
of the said assessment and the personal obligation and liability of
the owners of the property, and reciting that all proceeding with
reference to making such improvements have been regularly had in accord-
ance with the Law, the Charter of said City, the terms of the certificate,
and that all prerequisites to the fixing of a lien and claim of personal
liability evidenced by the certificates have been performed, and contain-
ing o11er appropriate and pertinent recitals, all in accordance with the
contract with the said company and the law in force in the City, and the
proceedings of this Board.
IV.
This resolution shall take effect and be in
force from and after its passage.

RESOLUTION ACCEPTING THE WORK OF PAVING AND
OTHERWISE IMPROVING A PORTION OF AUSTIN STREET
AND AUTHORIZING THE EXECUTION AND DELIVERY OF
SPECIAL ASSESSMENT CERTIFICATES.
BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE
CITY OF WICHITA FALLS, TEXAS, THAT,
WHEREAS, the City Engineer has certified that
the paving and otherwise improving Austin Street from its intersection
with the North Property lipe of Seventh Street to its intersection with
the North Property Line of Fourth Street, has been completed by the
Plains Paving Company in accordance with the plans and specifications
therefor and the said City Engineer recommends the acceptance of the
said work by the City.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS,
THAT said paving and other improvements be and
the same are hereby accepted by the City of Wichita Falls, Texas,
and the Mayor be and is hereby authorized and directed to execute
Special Assessment Certificates evidencing the indebtedness of the
owners of the property abutting on said portion of street, in the
name of the City of Wichita Falls, and the City Clerk is hereby author-
ized and directed to attest same and to impress the Seal of the City
of Wichita Falls, Texas, and to deliver said Special Assessment Cer-
tificates to the Plains Paving Company, as set forth in the contract,
for the above named improvements, all in accordance with the Ordinances
and resolutions heretofore adopted and passed by the City of Wichita
Falls, with reference to the above described improvements.

WHEREAS, the Bid of West Texas Construction Company for the
making and construction of the improvement provided for in the said con-
tracts, has after due advertisement and notice, been made and upon the
opening of the bids said contract was awarded to the said Company; and
WHEREAS, it is deemed necessary to set aside and provide for
the payment of all that portion of the cost required in the said contract
to be paid for by the City of Wichita Falls;

installing concrete curbs and gutters and paving same with once -course
reinforced concrete, together with necessary appurtenances, and thereafter
plans and specifications were duly adopted and approved f gr ,s'uch improve-
ments, bids were advertised for, and received, and on the day of June
1926, such bids were opened and 111111 ______
WHEREAS, the bids received have been fully canvassed and
considered and the City Council after duly and fully considering
same is of the opinion that the bid of L. E. Whitham and Company is
the most advantageous and should be accepted; which bid was

forced concrete pavement, Dollars per lineal foot
for monolithic curbing comp e e in p ace, Do jars per lineal

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF
THE CITY OF 'PT CHITA FALLS, TEXAS, THAT;
I.
That the bid of L. E. Whitham and Company for raising,
grading, filling, installing concrete curbs and gutters and paving with
one -course reinforced concrete and all necessary appurtenance on said
portion of said street as heretofore filed with the City, be and same is
hereby accepted.
II.

That the form of contract embraced in the specifications
be and the same is hereby adopted and approved, and the Mayor is authorized
and directed to enter into a contract for such improvement with the said
L. E. Whitham and Company and to execute such contract for and on behalf —
of and in the name of the City, and the City Clerk is hereby authorized
and directed to attest same in the name of the City and to impress thereon
the City's corporate seal.

and after its passage.

Moved by Alderman Jones that C. C. Linley be permitted
to break the curb and pave the street at llth, dand Holliday for a
distance of 50 feet.
Motion seconded by Alderman Queisser and carried.

Moved by Alderman Jones that the application of % E.
Carter for the construction of a filling station and grocery store at
the intersection of loth. Street and Kemp Boulevard be received and
the City Clerk be instructed to advertise for a public hearing to be
held on June 21st. at 7:30 P. M. in the basement of the City National
Bank Building for the prupose of hearing protests.
Motion seconded by Alderman Hunt and carried.

Moved by Alderman Queisser that the owner of the Seven
Gables Building at the corner of 9th, and Van Buren Streets be permitted
to set back the curb and widen the street,for a distance of 50 feet on
the side of 9th, street, adjoining his building at this location.
Motion seconded by Alderman Jones and carried.

Moved by Alderman Hunt that the City Clerk be instructed
to draw Warrant on the street improvement fund payable to G. T. Peckham
covering the excavation of the streets for pavement in Marlborough
Addition as follows:
109000 cubic yards rough excavation (O 24 cts $2,400,00
Fine grading 13,017 yards @ 5 cts 650.85
Motion seconded by Alderman Jones and carried.
