The minutes of the previous meeting were read and approved. ------------------------- Moved by Alderman Jones that the plat and dedication of East Moreland Addition, filed by Anderson Builder Supply Co., be accepted and approved. Motion seconded by Alderman Curd and carried, -------------------------- Moved by Alderman Patton that J. H. Ott be permitted to establish a cold -drink -and hamberger stand at 1010 8th. Street. Motion seconded by Aldermen Jones and carried. Moved by Alderman Patton that the application of the Panhandle Refining Company for a permit to erect and operate a drive- in filling station on the SW corner of Avenue H and Harrison Street be received and the C ty Clerk be instructed to advertise a public hearing to be held in the Basement of the City National Bank Building at 7:30 P. M. April 19, 1926. Motion seconded by Alderman Clifford and carried. Moved by Alderman Jones that the taxes, penalties and costs for the years 1914 to 1925, inclusive, on Lot 14, Block 5, Lakewood Addition, be reduced from 529.20 to $25.00. Form 10-Brook RESOLUTION. Keeler to Speedway. WHEREAS, contract in writing between City of Wichita Falls and L. E. Whitham and Co.,for the improvement of the following street in said City to -wit; Brook street from the south property line of Keeler to 10 feet north of the north property line of Speedway, together with contraction bonds and maintenance bonds required thereby, are this day presented to the Board of Aldermen for adoption and approval; and, WHEREAS, the bid of L. E. Whitham and Company for the making and construction of the improvement provided for in the said contracts, has after due advertisement and notice, been made and upon opening of the said Bids, said contract was awarded to the said Company, and WHEREAS, it is deemed necessary to set aside and provide for the payment of all that portion of the cost required in the said contract to be paid by the City of Wichita Falls; THEREFORE, be it resolved by the Board of Aldermen of the City of Wichita Falls, that there be and is hereby set aside and appro- priated out of the funds available for that purpose, the sum of to pay and defray all that portion of the cost of improving said portion of Brook Street from the South Property Line of Keeler, to 10 ft. North of the North Property Line of Speed- way, to be paid for by the City of Wichita Falls; The said contract and the construction bond and maintenance bond, be and the same are hereby approved and adopted, and the Mayor is hereby authorized to execute and sign the said contract, in the name of the City passage. Whitham and Company and the City of Wichita Falls, for performing of all work of excavation in connection with the improvement of Brook Street from the South Property Line of Keeler, to 10 ft. North of the North Property Line of Speedway for the prices named therein and upon the terms therein set forth binding the City of Wichita Falls, Texas, to do and perform all work of excavation upon said street, as is pro- vided in the contract, being one contract for said street, are this day presented to the Board of Aldermen for adoption and approval, and, WHEREAS, it is deemed advisable to enter into said con- tract upon the terms set forth therein, and for the compensation there- in provided, THEREFORE, be it resolved by the Board of Aldermen of the City of Wichita Falls, Texas; I. That the City of Wichita Falls, Texas do enter into con- tracts with L. E. Whitham and Company binding the City to do and perform all the work of excavation shown in said contract, and on said street, at nd for the prices and for the terms therein stipulated and set forth. Gentlemen: This is to certify that the pavement on Ninth Street from the West Property Line of Broad Street to the East Property Line of Brook Street, has been completed by L. E. Whitham and Company in accordance with the plans and specifications therefor heretofore filed with your honorable body. I, therefore, recommend that this pavement be accepted. RESOLUTION ACCEPTING THE. IMPROVEMENTS ON NINTH STREET FROM THE. WEST PROPERTY LINT: OF BROAD STREET TO THE EAST PROPERTY LINE OF BROOK STREET AND DIRECTING THE MAYOR AND CITY CLERK TO ISSUE CERTIFICATES OF SPECIAL ASSESSMENT LEVIED AGAINST THE VARIOUS LOTS OR TRACtS OF LANITHE OWNERS THEREOF ABUTTING UPON SAID PORTION OF SAID STREET. BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, WHEREAS, the Board of Aldermen of the City of Wichita Falls has heretofore ordered that Ninth Street from the West Property Line of Broad Street to the East Property Line of Brook Street be im- proved by raising, grading, and filling same and installing concrete curbs and gutters and paving same and after due notice and hearing, special assessments were levied against the various lots and tracts of land and the owners thereof abutting upon the said portion of said street, and contract for the making and construction of the said im- provements was entered into with WHEREAS, the said L. E. Whitham and Company has fully performed its said contract and the said improvements have been made and constructed in accordance with the said contract and the specifi- cations therefor, and to the entire satisfaction of this Board: That the said improvements on said portion of said street be and the same are hereby accepted and L. E. Whitham and Company and the sureties on its construction bond are hereby release of any further obligation for or on account of the contract or bond for the making and constructing of said improvements. .._ II. That this resolution does not and shall not in any wise effect the bond of the said company for the maintenance of the said improvements, but such maintenance bond shall and does remain in full force and effect. That the Mayor and City Clerk be and they are hereby author- ized, instructed, and directed to issue to L. E. W4iitham and Company certificates of special assessments in evidence of the various assess- ments levied against the respective lot or parcels of land abutting - ��ta Ait 930 upon said portion of said street, and the owners thereof, and against which special assessment has been levied, reciting the description of such property, the amount of the assessment against same, the owner thereof, the terms 4f payment thereof, the rate of interest, the date of completion and acceptance of the said improvements, the lien of the said assessment and the personal obligation and liability of the owner of the property, and reciting that all proceeding with reference to making such improvements have been regularly had in accordance with the Law, the Charter of said City, the terms of the certificate, and that all prerequisites to the fixing of a lien and claim of personal liability evidenced by the certificates have been performed and containing other appropriate and pertinent recit- als, and in accordance with the contract with the said company and the law in force in the City, and the proceedings of this Board. Kramer and Associates, be allowed to tie on to the City water main on Speedway provided that the City assume no responsibility for reimbursement of the cost of water lines constructed by Kramer and Associates or for the maintenance or repair of their lines. E. Whitham and Company is the most advantageous and should be accepted; which bid was Two and 90/100 ! $2.90) Dollars per square yard with five (5) year maintenance for one course reinforced concrete pavement, Forty Cents ($.40) Dollars per lineal foot for monolithic surbing co plete in place, Forty Cents ($0.40) Dollars per lineal foot for concrete or oak headers complete in place, 0 ) per square foot with five (5) year maintenance for 4 inch : ' concrete sidewalks in place and Twenty Cents plus ($0.20 plus) Dollars per square yard for excavation. Whitham and Company for raising, grading, filling, installing concrete curbs and gutters and paving with one -course reinforced concrete and all necessary appurtenances on said portion of said street as heretofore filed with the City, be and the same is hereby accepted. II. That the form of contract embraced in the specifications be and the same is hereby adopted and approved and the Mayor is authorized and directed to enter into a contract for such improvement i with the said L. E. Whitham and Company and to execute such contract for and on behalf of and in the name of the City, and the City Clerk is here- by authorized and directed to attest same in the name of the City and to impress thereon the City+s corporate seal. BE IT RESOLVED BY THE CITY OF WICHITA FALLS, TEXAS, THAT, ordered that WHEREAS, the City of Wichita Falls, has heretofore AVENUE "R",- in -said City be improvedkW-11 is intersection with the pavement bh-Grant Street.to its intersection with the East Curb -- Line of Fairview Boulevard, , AVENUE "S", in said City.be improved from its intersection with the pavement on Grant Street to its intersection with the East Curb Line of Fairview Boulevard, AVENUE "T", in said City be improved from its intersec- tion with the East Curb Line of Fairview Boulevard to its intersection with the East Curb Line of Garfield Street, FAIRVIEW BOULEVARD, in said City be improved from its intersection with the south property line of York Street to its intersec- tion with the North Property Line of Lexirf on Street, by raising, grading, filling, installing concrete curbs and gutters and � paving, with necessary appurtenances, and thereafter plans and specifica- tions were duly adopted and approved for such improvements, bids were advertised for and received, and on the 5th. 4ay of April, 1926, such bids were opened, and WHEREAS, the bids received have been fully canvassed and considered and the City Council after fully considering same is of the opinion that the bid of Plains Paving Company is the most advantageous and should be accepted; NOIT, THEREFORE, BE IT RESOLVED BY THE CITY OF WICHITA FALLS, TEXAS, THAT; - I. The bid of Plains Paving Company for raising, grading, filling, installing concrete curbs and gutters, paving with two (2) inch sheet asphalt (Willite Process) surface on five (5) inch plain concrete foundation and all necessary appurtenances on said portion of street, filed with the City, be and the same is hereby accepted. II. The form of contract embraced in the specifications be and the same is hereby adopted and approved, and the Mayor is author- ized and directed to enter into contract, for such improvements with the said Plains Paving Company, and to execute such contract for and on behalf of and in the name of the City and the City Clerk is hereby authorized and directed to attest same in the name of the City and to impress thereon the City's Corporate seal. The City Engineer is hereby directed to have plans, profiles, specifications and estimates embracing the foregoing materi- als and plans of improvements prepared, and to file the same with the Board of Aldermen, the City Engineer being so instructed, there being no City Manager. The said improvements shall be paid for in the following manner, to -wit: The benefited and abutting property, and the owners thereof, shall be assessed and pay for all of the cost of installing ( curbs and not exceeding ninety-eight per cent of the remaining cost of such improvements, and the City of Wichita Falls shall pay the remainder. The sums payable by the benefited property and owners thereof shall be payable in six (6) equal installments, the first of which shall be due on or before thirty (30) days after date of completion and acceptance by the City of such improvements; the second shall be due on or before one(l� year after such date; the third shall be due on or before two (2) years after such date; the fourth shall be due on or before three (3) years after such date; the fifth shall be clue on or befoPe four (4) years after such date and the sixth shall be due on or befoPe five (5) years after such date, the entire amount of such sums shall bear interest from the date of such completion and acceptance and until paid at the Fate of eight (S%) per cent per annum, payable annually, but such property, and the owners thereof, shall have the privilege of paying any or all of such installments at any time before maturity, and the failure to pay any installment upon the maturity thereof shall at the option of the owner and holder of the certificate of special assessment issued in evidence thereof, mature the entire amount then unpaid; and the sums payable by the respective lots or parcels of property abutting upon the said improvement, and benefited thereby, shall be assessed against such lots or parcels and against the owners thereof, and shall be a personal liability of such owner and a first and prior lien and charge against such property, superior to all other liens, claims and charges and demands of whatsoever kind, excepting only State, County and Municipal taxes. No assessment shall be levied against any lot or par. eel of land, or the owner thereof, in excess of the special benefits to such lot or parcel of land in enhanced value thereof by means of such improvement, and no assessment shall be levied until after the notice and hearing as provided in the Charter and Laws in force and effect in this City, and in the ordinance and proceedings of the Board of Aldermen applicable thereto. IV. Upon the completion and acceptance of such im- provements, if same shall have been performed by contract, then cer- tificates in evidence of the assessments levied against the respective lots or parcels of property, and the owners thereof, shall be issued to the contractor or party performing and executing the :cork of such improvement and containing recitals lawful and properly applicable thereto, and the said improvements shall be executed, and the said matters filed, said notice and hearing ordered given, and ordinance levy' ing the assessment, and any other matters with reference to said im- provement shall be done and performed in the manner and form provided by the Charter and laws in force And effect in this City, and the pro- ceedings, ordinances, and resolutions of the Board of Aldermen.
