The Board of Aldermen of the City of Wichita Falls, Texas met in regular session on the above date with the following members present: R. E. Shepherd, Mayor Oral Jones, 4 P. B. Curd, 4 Aldermen J. H. Patton, ¢ Frank Queisser,Q T. E. McBroom, City Clerk W. F. George, City Attorney. The minutes of the previous meeting were read and approved. ---------------------- The hearing with reference to paving Indiana Avenue from 13th. Street to the Wichita Valley Railway Tracks and Oak Street from n'ichita Valley Railway Tracks to Mississippi Street was called and after hearing no protests the following motion was put in order. Moved by Alderman Patton that the following resolution be adopted, and the City Engineer be instructed to revise the assess- ments for paving Indiana.Avenue reducing the width from sixty feet to forty feet. Motion seconded by Alderman Jones and carried by the following vote: Yeas; Aldermen Patton and Queisser Nays; Aldermen Curd and Jones. There being a tie vote the Mayor announced that he would vote "Yea" making a majority in favor of the adoption. Form 8-Indiana- 13th. to Ps.V.Ry.Tracks RESOLUTION. RESOLUTION CLOSING HEARING 17ITH REFERFNCE TO IMPROVEMENTS AND ASSESSP,IFNTS THERFFOR ON A PORTION OF INDIANA AVENUE IN THE CITY OF WICHITA FALLS, TEXAS. WHEREAS, by resolution passed and adopted on the loth. day of August 1925 it was ordered that Indiana Avenue from its intersec- tion with the north property line of Thirteenth Street to its inter- section with the Wichita Valley Railway Company Tracks, be improved in the manner set forth in the said resolution; and thereafter contract was let and entered into with the Plains Paving Company for the mak- ing and construction of such improvements; and thereafter the City Engineer filed roll or statement showing thereon the various parcels of property abutting upon said street, with the names of the owners thereof, as far as known, and showing the amounts to be assessed against each parcel, and showing other matters and things; and such statement having been examined and approved, it was by resolution ordered that hearing be given to all owners of abutting property and to all others interested and a time and place was fixed therefor; and at said time and place, towit; The day of 1926 at 7:30 P. M. o'clock, in the Council ham er in the City Nationai Bank Building in P� the City of Wichita Falls, Texas, said hearing was duly had and held, notice of the time and place thereof and of such hearing having been theretofore given in due and proper manner and for the length of time as was proper; and at said hearing the following protests were made, to -wit: ( No protests ) And all parites desiring themselves to be heard, their agents, representatives and attorneys, were fully and fairly heard, and evidence intorduced and considered; and the Board of Aldermen having heard the evidence and having considered same, and having heard and considered all protests and objections, made, whether here- in enumerated or not, is of the opinion that -all protests and objec- tions should be over -ruled, and that said hearing should be closed; and all errors and other matters requiring corrections or rectifications having been corrected or rectified: THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF. THE CITY OF WICHITA FALLS, TEXAS, THAT: I. All protests and objections, whether herein enumerated or not, be, and the same are hereby overruled. II. The Board of Aldermen from the evidence finds that in each and every case the property abutting upon the said improvements will be enhanced in value by means of such improvements, in a sum in excess of the amount proposed to be assessed against it therefor; and further finds that the apportionment of the cost of the said improvements made and applied and shown on the Engineerts roll or statement is substan- tially in proportion to the benefits received by means of the improve- ments, and that such apportionment is ,just and equitable, and results insubstantial justice and equality between the various parcels of proper ty and the owners thereof, considering burdens imposed and benefits received. That the said hearing be, and it is hereby closed, and it is ordered that each parcel of property abutting upon the said im- provements and the owners of such property be assessed in the sums shown on the said roll or statement opposite the description of the respective parcels under the column "Total Assessment" and itemized in the colums preceeding such column; and it is directed that ordinance levying such assessments in accordance with the terms and provisions of the proceedings of the City with reference to said improvements and in accordance with the law and charter be prepared . IV. The Board of Aldermen further finds that the sums assessed against the respective parcels of propertydo not exceed the amount or proportion authorized by charter and provided by the proceed- ings of the City; and further finds all other matters and things nec- essary and prerequisite to this resolution and to such assessments. w This resolution shall take effect and be in force from and after its passage. Tracks RESOLUTION APPROVING CONTRACT FOR THE IMPROVEMENT OF A PORTION OF INDIANA AVENUE IN THE CITY OF WICHITA FALLS, AUTHORIZING THE MAYOR TO SIGN SAME; APPROVING THE CONTRACTORIS BONDS THEREFOR AND APPROPRIATING FUNDS FOR THE CITYIS PORTION OF THE COST THEREOF. WHEREAS, a contract in writing between the City of Wichita Falls, Texas and the Plains Paving Company for the improvement of Indiana Avenue from its intersection with north property line of Thirteenth Street to its intersection with Wichita Valley Ry. Company Tracks, together with the construction and maintenance bonds, required thereby, are this day presented to the Board of Aldermen for adoption and approval; and l°]HEREAS, the bid of Plains Paving Company for the mak- ing and construction of the improvements provided for in the said con- tracts, has after due advertisement and notice been made and upon the opening of the bids said contract was awarded to said Plains Paving Company, and WHEREAS, it is deemed necessary to set aside and provide for the payment of all that portion of the cost required in said con- tract to be paid for by the City of Wichita Falls; THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT I. s There be and is hereby set aside and appropriated out of the funds available for that purpose, the sum of Seven -Hundred Eighty _" and 03/100 (1780.03) to pay and defray all that portion of the cost of improving said portion of Indiana Avenue, to be paid for by the City of Wichita Falls. RESOLUTION DECLARING THE NECESSITY OF IMPROVING A PORTION OF SIDE:"'ALKS ON ADAMS STREET IN THE CITY OF WICHITA FALLS, TEXAS, STATING THE NATURE OF SUCH IMPROVEMENTS ,ANDTHR METHOD BY THICH IT IS PROPOSED THAT PAYMENT BE MADE THEREFOR, AND DIRECTING THE CITY ENGINEER TO HAVE, PLANS, PROFILES, SPECIFICATIONS AND ESTIMATES OF THE PROPOSED IMPROVEMENTS PREPARED. BE IT, AND IT IS HEREBY RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT; I. It is necessary that Sidewalks abutting the East side of Block 160 on Adams Street, be improved by raising, grading, filling paving same and installing concrete curbs and gutters and that same be improved with one of the following materials, to -wit: n, (a) One -course concrete 'd-) e.§448 glt llthi II. The City Engineer is hereby directed to have plans, profiles, specifications and estimates embracing the foregoing materials and plans of improvement prepared, and to file same with the Board of Aldermen, the City Engineer being so directed, there being no City Manager. The said improvements shall be paid for in the follow- ing manner, towit: The benefited and abutting property and the owners thereof shall be assessed and pay for all of the cost of installing curbs and gutters and not exceeding 98 per cent of the remaining cost of such improvements, and the City of Wichita Falls, shall pay the remainder. The sums payable by the benefited property and the owners thereof shall be payable in six (6) equal installments, the first of which shall be due and payable upon the date of completion and acceptance by the City of such improvements; the second shall be due and payable on or before one (1) year from said date of completion and acceptaneel the third shall be due and payable on or before two (2) years from said date of completion and acceptance; the fourth shall be due and payable on or before three (3) years from said date of comple- tion and acceptance; the fifth shall be due and payable on or before four (4) years from said date of completion and acceptance and the sixth shall be due and payable on or before five (5) years from said date of completion and acceptance by the City of such improvements. The entire amount of such sums shall bear interest from the date of said completion and acceptance and until paid at the rate of eight per cent (8%) per annum, payable annually, but such property and the owners thereof shall have the privilege of paying any or all of such installments at any time before maturity, and the failure to pay any installments upon maturity thereof shall at the option of the owner and holder of the certificate of special assessment, issued in evidence thereof, mature the entire amount then unpaid; and the sums pay- able by the respective lots or parcels of land or property abutting upon said improvement, and benefited thereby, shall be assessed against such jIots or parcels and against the owners thereof, and shall be a personal pliability of such owner and a first and prior lien and charge against such property, superior to all other liens, claims and charges and de- mands of whatsoever kind excepting only State, County and Municipal taxes, No assessment shall be levied against any lot or parcel of land, or the owner thereof in excess of the special benefits to such lot or parcel of land in enhanced value thereof by means of such improvement, ,and no assessment shall be levied until after the notice and hearing as �provided in the Charter and Laws in force and effect in this City, and in the ordinance and proceedings of the Board.gf Aldermen applicable thereto, IV, Upon the completion and acceptance of such improvements,, if same shall have been performed by contract, then certificates in evidence of the assessments levied against the respective lots or parcels of - property, and the owners thereof, shall be issued to the contractor or party performing and executing the work of such improvements and con- taining recitals lawful and properly applicable thereto and the said im- provements shall be executed, and the said matters filed, said notice and hearing ordered given, and ordinance levying the assessment and any other matters with reference to said improvement shall be done and performed in the manner and form provided by the Charter and Laws in force and effect in this City, and the proceedings, ordinances and resolutions of the Board of Aldermen. That the said plans, proviles, specifications and esti- mates, be and the same are hereby adopted and approved as those under, by, and in accordance with which the said improvements shall be made and con- structed. Whitham and Company, contractor, for purpose of certain improvements on the roadway abutting and serving Municipal Park, in accordance with plans and specifications made a part of the contract, and provided for the payment of approximately $20,000.00 for said improvements, and WHEREAS, the Board of Aldermen on December 21, 1925, arranged for the issuance of $20,000.00 of 5 1/2% interest -bearing time warrants to be delivered to said Contractors; and 1"HEREAS, L. Rugsley uIr"r 7-ngineer WHEREAS, said pavement covered by said first estimate has been inspected by the Board of Aldermen of said City and found to be in accordance with the specifications adopted by said City, and to be well worth the sum of $16,517.39 the amount provided in said first estimate, and said Board of Aldermen has accepted the pavement covered by said estimate for and in behalf of said City of Wichita Falls; and Whereas, said estimate herein set out has been fuly audited by said Board of Aldermen and found to be correct; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF TICHITA FALLS, TEXAS;' That said estimate covering said improvem6nts completed and accepted, aggregating the sum of $16,517.39, which has been pre- sented by L. E. Whitham and Company, contractor, be, and the same is hereby allowed. That, in accordance with said contract between the City of Wichita Falls and L. E. That any claim for damages shall be made in writing and shall set forth the matters and things in the manner and form provided and required by law and the provisions of the City Charter, And other claims or matters may be presented either orally or in writing and at such hearing all claims, protests, and objections whatsoever will be passed upon by the Board of Aldermen and said hearing may be continued .from time to time until all desiring to be heard have been fully heard, and after all have been fully and fairly heard, the said hearing will be closed, and at said hearing and from the facts before it the Board of Aldermen will determine the amounts to be assessed against each lot or parcel of property and against the onner thereof, and will determine the lots or parcels benefited by means of said improvements, and will determine the amount of damages, if any, to each lot or parcel of property and the owner thereof, the enhanced value of property by means of said improvements, and will correct any errors, mistakes, or invalidities in any proposed assessment, and in any proceeding with reference to the making or construction of said improvements, or the levying of assessments therefor, and will thereafter, by ordinance, make and levy assessments against each such peace or parcel of property and against the owners thereof in the proportion provided and in the manner and form and in accordance with the terms required by law in force in this City, and the City Charter, and the ordinances, resolu- tions, and other proceedings of this Board, and such assessments when levied shall be a first and prior lien. After such hearing is closed anyone desiring to appeal therefrom shall presecute and appeal to any Court having jurisdiction within twenty (20) days from the date such hearing is closed and final assessment levied and not thereafter, and all persons, firms, corpor- ations, estates and other parties shall after the expiration of twenty (20) days from the levying of such assessment, be forever barred and estopped in any manner doubting or resisting same or asserting any error. irregularity, mistake, or invalidity therein.
