Bebb Roger McKinney, Director of Planning * City Staff Donna Duncan, Recording Secretary ABSENT as Scott Cannady, Chairman * Member David Farabee * Councilor 40 CALL TO ORDER No The meeting was called to order at 1:35 p.m. by Roger McKinney who presided over the meeting in the absence of Chairman Scott Cannady. 40 Mr. McKinney reminded the Commission that with only four members present it will take an affirmative vote of all members to grant the request. If there is one dissenting vote the request would be denied 40 but could be resubmitted at a later date. APPROVAL OF MINUTES It was moved by Bill Franklin, seconded by Dr. Edwin Bebb and carried unanimously that the July 15, 1992 Minutes be approved as written. V-92-03. Variance request to reduce the 30 foot separation requirement from a single family residential zone to 10.5 feet and the 5 ft. side setback to 6 inches for 1133 & 1135 Ridgeway. Roger McKinney stated that the applicant is seeking a variance to allow the church to construct a 4800 s.f. recreation center and a 4416 s.f. day care facility at 1133 Ridgeway. The proposed development is located in a Single Family zone and does abut property with a single family use. That property lies to the north and is split into two zoning districts: LC and SF-2. They are requesting two variances for this development: 1. Reduce the additional setback required by (Section 4640) on the north side of the building from 30 feet to 10.5 feet within a Single Family zoning district. 2. Reduce the required side setback (Section 3140 (6) from 5 feet to 6 inches on the south property line adjacent to a drainage canal. Am Item No. HJrJS Page No. I ri Mr. McKinney pointed out that the side setbacks are required in order to promote the development of land and prevent overcrowding for health, public safety and fire code requirements. There is a drainage canal abutting this property to the south resulting in a man-made buffer between this and uses on the other side of the canal. It eliminates the possibility of a future structure being built next to the proposed building. Therefore requiring a 5-foot setback would not achieve its intended purpose. The unusual configuration of the zoning boundaries to the north and the drainage canal on the south of this lot constitute a hardship. In addition, the applicant has a Conditional Use request (C 92-45) before Planning and Zoning Commission to approve this project. The Staff has recommended approval of the Conditional Use request contingent upon approval of this variance. We notified 21 property owners within 200' and have 3 responses all in favor. The public welfare will not be adversely impacted by the granting of these requests. It is recommended that these 2 variances be approved. Mr. McKinney advised that the applicants should have a surveyor determine the exact location of their property lines. The chain link fence along the drainage canal was constructed by the City and may not follow the property line. The applicant should contact the City Engineering Department before removing this fence. Bill Franklin made a motion to grant both of the variances, seconded by Tom Hill.
