CALL TO ORDER

The meeting was called to order at 1:31 p.m. by Roger McKinney who
presided over the meeting in the absence of Chairman Scott Cannady.
Mr. McKinney reminded the Commission and the applicant, Mr. Seabury,
that with only four members present it will take an affirmative vote of
all members to grant the request. If there is one dissenting vote the
request would be denied but could be resubmitted at a later date. Mr.
Seabury wanted to go ahead with the request at this time.
APPROVAL OF MINUTES
46 It was moved by Dr. Edwin Bebb, seconded by Tom Hill, and carried
unanimously that the March 18, 1992 Minutes be approved as written.
40 V-92-02. Variance request seeking to allow a 20-foot front building
setback on lot 49C Villa Colina. The variance would allow
a larger building area on this lot and would conform to
existing construction on adjacent lots.
Subir Mukerjee stated that the applicant is seeking a variance to allow
a 20-foot front building setback on lot 49C, Villa Colina. The
variance would allow a larger building area on this lot and would
conform to existing construction on adjacent lots, 26 and 27. Villa
Colina was platted as a zero lot line subdivision in 1984. Under
regulations then in effect, 20-foot front setbacks were allowed with
the feeling that the market demand for zero lot lines would cater to
affordable housing in terms of smaller building sizes. Subsequently
the market demand has changed and recently the subdivision was
replatted into a standard -lot subdivision where 25-foot front setbacks
are now required. It is the last lot in the block, and it is adjacent
to the hillside. We have notified the property owners within 200' and
have not received any comments and we feel the reduction would be in
line with the intent of the zoning ordinance.

Due to the existing 20-foot setbacks of the adjacent residences and the
narrow depth of this lot, the public welfare will not be adversely
impacted by the granting of this variance. It is recommended that this
variance be approved.
Bill Franklin made a motion to grant the variance, seconded by Tom
Hill. A roll call vote was made with Dr. Edwin Bebb, Roger Murphy, Tom
Hill and Bill Franklin all in favor.
The meeting adjourned at 1:37 p.m.
