The meeting was called to order at 1:30 p.m. by Chairman Perkins.
Approval of Minutes
It was moved by Tom Hill, seconded by Richard Sutherland, and carried
unanimously that the Minutes of November 21, 1990 and November 26,
1990 be approved.
V-90-14 Variance request to reduce front and exterior side setbacks
at 400 5th Street
The Board was addressed by Leon Mallonee, applicant. Mr. Mallonee
referred Board members to the site plan prepared for Dwight Transfer
& Storage Company. Construction plans for a new storage warehouse
call for a 1' side setback on 5th Street, and a 16' front setback on
Lee. The 1' setback on 5th will be in line with the existing company
office across the alley. The 16' setback on Lee would be approxi-
mately 1' more than the setback for the adjacent residence. Mr.
Mallonee stated that he has explained the request to the property
owners of this residence, and to his knowledge, they have no objec-
tion. He also advised that Dwight Transfer & Storage owns several
adjacent lots; therefore, most of the traffic in this area is
generated solely by the business, especially since 5th Street dead -
ends into the railroad tracks.

Scott Cannaday noted that the construction will eliminate most of the
on -site parking. Mr. Mallonee stated that the company has acquired
the lot across 5th Street for parking. Mr. McKinney advised this
arrangement does meet the parking requirements.
Burrell Lacey questioned the jog in the north property line. Mr.
Mallonee stated that this 7' x 75' strip was a part of the lot when
he purchased the property 20 years ago. He therefore objected to the
expense of replatting, since he was not involved with changing the
lot. Mr. Mukerjee stated that replatting will be necessary if the
construction crosses a lot line, and he will verify this.
After further discussion it was moved by Richard Sutherland that the
variance be granted, based on Section 7340 of the Zoning Ordinance:
- that it would not be contrary to the public interest,
- that special conditions do exist other than financial hardship,
for example, the railroad tracks at Michigan,
- it would not permit an activity that would not otherwise be
allowed;
and subject to replatting if the City determines that it should be
replatted.
The motion was seconded by Syd Litteken and carried unanimously by
vote of Hill, Sutherland, Perkins, Lacey and Litteken.
