ZONING BOARD OF ADJUSTMENT

CALL TO ORDER
The meeting was called to order at 1:30 p.m. by Chairman Perkins.
APPROVAL OF MINUTES
It was moved by Tom Hill, seconded by Scott Cannaday, and carried
unanimously that the December 19, 1990 Minutes be approved.
ADD -ON
Chairman Perkins asked Mr. McKinney to comment on the new composition
of the Board (from 5 regular members and 4 alternates to 5 regular
members and 1 alternate). Mr. McKinney advised that when the terms
of the three other members of the Board expired, the positions were
not filled. This decision was made by the Council due to attendance
problems of the Board and the necessity to have a quorum present for
voting, and for continuity in the action of the Board.

In keeping with the policy to disclose any contacts made prior to the
�" meeting, Burrell Lacey stated he made a site check of this property
and spoke with the applicant concerning procedural aspects of the
Board.

Board members were addressed by Pat McGinty of McGinty Tire &
Specialty, property owner and applicant. He noted that there are
properties on all four sides of this site with smaller setbacks than
the setback requested. The gas pumps and tanks have been removed, and
he would like to enclose the existing canopy in order to use this
space for a showroom and office. to
During discussion Scott Cannaday asked if the proposed overhead lanes
for Holliday would have any impact on this property. Mr. Mukerjee W
advised that Holliday will be widened, reducing the distance between
the curb and the property line. However, the distance between the
canopy and the property line will remain the same. Also, the elevated
lanes will be on the other side of Holliday, and the enclosure would gi
have no affect on that construction.
After further discussion, Tom Hill stated that this enclosure would
not block the view, and moved that the request be approved. The
motion was seconded by William Kidd and carried unanimously by vote
of Cannaday, Lacey, Perkins, Kidd and Hill.
