CALL TO ORDER
Vice Chairman Gossom called the meeting to order at 1:30 p.m.

Prior to the meeting, Board members were provided copies of the
staff report on this agenda item, which presented the facts that
the applicant has constructed a double carport on the lot without
a building permit, which extends

- The carport extends into the setback because the original
garage was converted to living space.

- There is insufficient space on either side of the house
for a carport there.
- The applicant has emphysema.
- The street is exceptionally wide.
- The carport deflects some of the sun's rays, resulting in
the house being cooler.
- There are several carports on Karla.
- The applicant was unaware of the setback requirements of
the Zoning Ordinance.
- Granting the variance would not set a precedent, since a
variance is "handled one at a time".
Vice Chairman Gossom noted that although the applicant may have
been unaware of the requirements of the Zoning Ordinance, he
should have been aware of the requirement to obtain a building
permit, and he did not comply with that. Mr. McKinney added that
prior to adoption of the Zoning Ordinance, there was a require-
ment to obtain a certain percentage of consent from property
owners in the same block in order to extend a carport into the
setback. Setback requirements for carports was not a new issue
created by the Zoning Ordinance.
After further discussion, it was moved by Richard Sutherland that
the application be denied on the basis that no special conditions
exist that would allow granting a variance under these circum-
stances. This motion was seconded by Richard Sutton and carried
unanimously.
