Variance request to allow a car area at 4631 Langford Lane rt ;n the front setback Prior to the meeting, Board members were provided copies of the staff report on this agenda item, which presented the facts that the applicant has constructed a double carport on the lot without a building permit, which extends into lthe footfront fromsetback front with the carport being approximately prop- erty line. app The Board was addressed by • Edward True, True stated attorney variance tshou d 1be cant, William Hopson granted for the following reasons: - The carport extends into the setback because the original garage was converted to living space. Item No. ►%#J5 Page. No. 71a - There is insufficient space on either side of the house for a carport there. - The applicant has emphysema. - The street is exceptionally wide. - The carport deflects some of the sun's rays, resulting in the house being cooler. - There are several carports on Karla. - The applicant was unaware of the setback requirements of the Zoning Ordinance. - Granting the variance would not set a precedent, since a variance is "handled one at a time". Vice Chairman Gossom noted that although the applicant may have been unaware of the requirements of the Zoning Ordinance, he should have been aware of the requirement to obtain a building permit, and he did not comply with that. Mr. McKinney added that prior to adoption of the Zoning Ordinance, there was a require- ment to obtain a certain percentage of consent from property owners in the same block in order to extend a carport into the setback. Setback requirements for carports was not a new issue created by the Zoning Ordinance. After further discussion, it was moved by Richard Sutherland that the application be denied on the basis that no special conditions exist that would allow granting a variance under these circum- stances. This motion was seconded by Richard Sutton and carried unanimously. M The meeting adjourned at 1:50 p.m. avid Gossom, Vice Chairman: M M M Item No. tAA» 72 Page No. __
