Chairman Balch called the meeting to order at 1:40 p.m.
APPROVAL OF MINUTES

It was moved by David Gossom, seconded by Syd Litteken, and
passed unanimously that the October 15, 1986 Minutes be
approved.
BUSINESS ITEM
V-86-28. Request for
variance from Sec. 3740 to allow con-
struction on the property
line at 208 N. Burnett
Mr. Mukerjee advised
the applicant proposes to add a portable
building on his lot
at 208 N. Burnett, to be used as a take-
out food service. A
driveway and three parking spaces will be

constructed to meet
the development requirements. The staff
recommended approval
of the request, as the lot is triangular -
shaped with double
frontage, leaving limited building area.
Also, there are existing commercial developments closer than
25' from the property line in the area.
The applicant, Oscar
Rodriguez, was present; however, Jimmy
Armendarez of the
Building Inspection Department answered
questions from Commission
members, as Mr. Rodriguez speaks

limited English. Mr. Armendarez explained Mr. Rodriguez will
install this building on skids, and if the business is not
profitable, the building will be moved off.
Mrs. C.R. Collins, owner of the property immediately north of
this lot, questioned where the parking spaces would be. When
shown that they would not be on her property, she stated she
had no objections to the request. Mr. Mukerjee advised the
only other response was one in favor.
During discussion by the Commission, Mr. Seabury asked if the
building could be turned to maintain the 25' setback, moving
the parking to the rear. Mr. Mukerjee noted different place-
ment of the building would result in a different violation,
such as the 3' setback from any structure.
After further discussion it was moved by Bill Rowland that the
variance be granted due to the special conditions being the
irregular shape of the lot, the two 25 foot setbacks, and the
existence of other commercial developments in the area. The
motion was seconded by Bob Seabury for the reasons cited by
Mr. Rowland, and also because there seems to be a need in this
neighborhood for this type of business, as there has been no
opposition. The motion carried with a vote of 5 in favor by
Litteken, Gossom, Balch, Rowland and 'Seabury. Dr. Sutton
deferred his vote to Mr. Litteken, as he had arrived late. '
The meeting adjourned at 2:00 p.m.
