CALL TO ORDER
Chairman Mason called the meeting to order at 1:45 p.m.
APPROVAL OF MINUTES
It was moved by Richard Sutherland, seconded by David Gossom,
and carried unanimously that the February 18, 1987 Minutes be
approved as submitted.
BUSINESS ITEM
V-87-05. Variance from Section 4220 to allow construction of
a carport on the side property line at 1660 Victory Avenue
Prior to the meeting, Board members were provided copies of
the staff report, which recommended denial of this request
based on:
1) The availability and quality of alley access in itself
does not constitute a hardship.
2) Granting this variance would not meet the intent of the
5' setback provision which prohibits buildings in the setback
area for fire, health and safety reasons.
The Board was then addressed by Dr. J.B. Hathorn, applicant.
Dr. Hathorn cited several reasons why the request should be
granted:

- The alley which extends behind his home is the only one
in the area which is not paved, and it is barricaded at one
end. It is very rutted, and cannot be used as access for his
lot. In fact, the City Sanitation Department will not allow
their trucks to use this alley, and his motor home is also a
very heavy vehicle.
-- All the surrounding properties either have a garage or a
carport on the property line. On his own lot there are already
two buildings on the property line, and he plans to construct
the carport with the same setback.
- The carport would not adversely impact the neighborhood,
as there are already so many carports and/or garages on the
property line. Also, he plans to construct a fence to screen
the carport and will install gutters on the carport to prevent
rainfall from washing onto the adjoining lot.
- None of his neighbors object. This was evidenced by the
notification response, which was 9 in favor, and 0 against out
of 31 notified.
After discussion it was moved by Adrienne Barker that the var-
iance be granted on the basis that the alley is not usable for
access, and therefore it is a hardship. Chairman Mason added
to the motion that the public welfare would not be adversely
impacted because the visual corridor has already been disrupt-
ed by other carports, and by the existence of a playhouse on
the applicant's property. The motion was seconded by Richard
Sutherland and carried unanimously.
Add -on item
Chairman Mason appointed Vice Chairman David Gossom as a rep-
resentative of the Board to meet with the Planning and Zoning
Commission Land Use Subcommittee on the issue of certain types
of fences in the front yard. This meeting will be scheduled
later.
The meeting adjourned at 2:00 p.m.
