L CALL TO ORDER
The meeting was called to order by Vice -Chairperson, Mr. David Cook, at 2:00 p.m.
Vice -Chairperson Cook proceeded to make the following comments:
a. This meeting is being televised live on Channel 1300. It will be replayed at
2:00 p.m. daily including Saturday and Sunday until the next live meeting is
aired which will be the second Wednesday of next month at 2:00 p.m.
b. Motions made by the Commission members include all staff
recommendations and developmental requirements listed in the staff report.
Any deviations will be discussed on a case -by -case basis and voted on
accordingly.
c. Applicants and citizens who wish to address the Commission or answer
questions from the Commission members are asked to please speak into the
microphone at the podium. This meeting is being taped and there is no
microphone to record statements made from the audience.
d. Please silence all cell phones during the meeting. If it is necessary for you to
have a cell phone conversation during the meeting, please use the hallway
outside this room.

II. ROLL CALL
Commission Vice -Chairperson Cook roll called commission and staff members.
III. PUBLIC COMMENTS
Mr. Cook asked if there were any comments from the public. With no response,
Mr. Cook closed public comments.
IV. APPROVAL OF MINUTES
Mrs. Cayce Wendeborn made a motion to adopt the July 8, 2020 minutes. Mr.
Anthony Inman seconded the motion. The motion was passed unanimously.
VII. CONSENT AGENDA
Mrs. Cayce Wendeborn made a motion to approve the consent agenda. Mr.
Anthony Inman seconded the motion. The motion was passed unanimously.
Vlll. REGULAR AGENDA
1. Case C 20-11 — 2007 Berkeley Drive — Detached Garage:
Request for a conditional use to allow a 12.5 ft, reduction in the
interior side setback for an accessory structure in a Single Family-1
Residential (SF-1) zoning district.
Applicant: Justin Caraway
Owner: James Greathouse
Ms. Cayce Wendeborn made a motion to approve the case, Mr. Blake Haney
seconded. Mr. Medellin presented the case and stated the conditional use was for
a detached garage for vehicle storage and some recreational uses. Staff met with
architect John Allen who was proposing a structure constructed at 17 ft. in height,
requiring a 17 ft. setback. Considering the use of space, staff and architect realized
the need for a reduced setback. Staff advised the applicant Section 6516 allows for
such reductions with approval of the Commission and granting a Conditional Use
Permit, a reduced set back as long as structure matches both in character,
materials as well as match the style of the primary structure.
The property location is 2007 Berkeley Drive located southeast of the Harrison and
Kell Boulevard intersection in the Country Club Addition. The property owners are
doing a complete remodel on the property, proposing a 30 ft. X 56 ft., 3-car garage
that would also have storage and recreation space. Under current development
regulations a multi -story primary structure would be allowed the same five foot
setback being requested. A survey of the area showed several other homes in the
neighborhood have legally nonconforming accessory structures, built prior to the
zoning ordinance adoption, either in the rear, exterior or interior side setbacks. The
neighborhood is all Single Family-1 (SF-1) zoning district, which is a larger lot
district.
Staff sent out 13 notices to property owners within the 200 ft. notification area,
receiving two responses back, one in favor and one undecided. After reviewing the

plans and research, staff recommends approval of this request for a reduction of
12.5 ft. of the interior side required setbacks for an accessory structure at 2007
Berkeley Drive with the following conditions:
I. The proposed structure shall not have any openings (i.e. windows,
balconies, terraces, etc.) along the west wall that will overlook onto the
adjacent property.
2. A complete set of plans shall be submitted showing all directional sections
of the proposed structure, and is to be reviewed for conformance with the
conditions set forth.
3. Further site plan review by Planning and Building Inspections at the time
of permitting for construction to verify conformance with all other
applicable code and ordinances.
Mr. Cook asked if the applicant was present and wished to make a presentation.
Applicant was not present and there was no comment from the general public.
Vice -Chairman Cook opened the floor to the Commission for questions and
comments, which there were none. Mr. Cook called for a vote. Motion passed
unanimously with a vote of 6-0.
2. Case C 20-12 — 2000 Speedway Avenue — Carport:
Request for a conditional use to allow a carport in the required exterior
side setback in a Single Family-2 Residential (SF-2) zoning district.
Applicant: Steven Gill, Gill Welding
Owner: Tessa Menchaca
Ms. Cayce Wendeborn made a motion to approve the case, Mr. Blake Haney
seconded. Mr. Medellin presented the case and stated this proposal for a carport in
the side exterior setback. Staff met with the home owner, Ms. Menchaca and the
applicant, Mr. Gill of Gill Welding about not having a safe place to store their
vehicle to protect it. The subject property is located southeast of the Harrison and
Kell Boulevard intersection on the corner of Speedway Avenue and Van Buren with
the carport located on the Van Buren access side. The proposed carport is 23 ft.
10 in. X 23 ft. 10 in. and will leave a gap of 6 in. from the edge of the overhang to
the side property line on the Van Buren side.
The subject property is located in a residential neighborhood, zoned as Single
Family-2 (SF-2). There are a few townhomes located directly opposite from the
property in the Multi -Family Residential district (MFR). Mr. Medellin stated staff sent
21 notices to owners in the 200 notification area and had 3 replies, all in favor of
this Conditional Use.
Mr. Medellin advised the proposed structure meets all of the city regulations
outlined in Section 4220 of the development guidelines. Staff recommends
approval of this Conditional Use carport request for 2000 Speedway Ave. with the
following conditions:

other applicable code and ordinances.
Mr. Cook asked if the applicant was present and wished to make a presentation.
The applicant indicated his presence and stated he had no comment. There were
no comments from the general public. Vice -Chairman Cook opened the floor to the
Commission for questions and comments, which there were none. Mr. Cook called
for a vote. Motion passed unanimously with a vote of 6-0.
IX. ADJOURN
The meeting adjourned at 2:12 p.m.
