The minutes of the previous meeting were read and approved. ---------------------- The hearing with reference to paving Kemp Boulevard from Avenie "H" to Avenue "0" was called and after hearing protests the follow- ing motion was put in order. B I, IT RESOLVED BY THE BOARD OF ALDER fEN OF THE CITY OF 1,71CHITA F,,uLLS, THAT: WHEREAS., the Board of Aldermen of the City of Wichita Falls has heretofore ordered the following portion of Street in said City improved by raising, grading and filling same and installing concrete curbs and gutters, and paving with Warrenite-Bitulithic pavement on concrete founda- tions, to -wit: All the unpaved portion of Kemp Boulevard between the South property line of Avenue "H" to the South Property Line of Avenue "0" WHEREAS, by resolution of the Board of Aldermen adopted on the 21st. day of December 1925, i is ordered that a hearing to all owners of property abutting on said portion of said street, and all others interested be held in the Council Chamber in the Basement of the -City National Bank Building at 7:30 P. M. on the 8th. day of February 1926, and that notice thereof be given; and, WHEREAS, due notice of the time and place of such hearing was given and such hearing held, and all parties, their agents, attorneys, and all others desiring to be heard, have been fully and fairly heard, and at such hearing; the following protests were made; Florence ?''alker, E. J. Allison and B. V. Colley. Protesting against the cost of such improvements and that this is an inopportune time therefor; I. That all protests and objections, whether therein specifically mentioned or not, be and they are hereby over -ruled. II. That the Board of Aldermen finds from the evidence before it that no property will be damaged by means of, or as a result of any of said improvements. The Board further finds from the evidence before it that the proper rule of apportionment of the cost of such improvement is that applied and shown on the estimates, reports and statements of the City Engineer filed on the 21st. day of December 1925, and examined and approv- ed by the Board, and that such produces and effects substantial equality ` and justice between the various lots and parcels of land shown and affect- ed thereby and respective owners thereof, and the Board further 'finds from evidence that each parcel or lot of land abutting on said portion of Kemp Boulevard will be benefited in enhanced value by means of such improvements on said portion of Kemp Boulevard in an amount in excess of the portion of costs to be assessed against same as shown on said estimat- es, reports and statements of the City Engineer, and that each parcel or lot of land abutting on said portion of Kemp Boulevard will be benefited in enhanced value by means of such improvements on said portion of Kemp Boulevard in an amount in excess of the portion of costs of Kemp Boulevard proposed to be assessed against same as shown on said estimate, reports and statement of the City Engineer; and that each parcel or lot of land abbutting on said portion of Kemp Boulevard will be benefited in"enhanced value by means of such improvements on said portion of Kemp Boulevard in an amount in excess of the portion of costs proposed to be assessed against same as shown on said estimate reports and statements of the City Engineer. r IV. Whitham and Company for the improvement of the following street in said City to -wit; Broad Street from the South property Line of Eighteenth Street to the North Property Line of Twenty Fourth Street together with contraction bonds and maintenance bonds required thereby, are this day presented to the Board of Aldermen for adoption and approval; and, WHEREAS, the Bid of L. E. Whitham and Company for the making and construction of the improvdment provided for in the said contracts, has after due advertisement and notice, been made and upon opening of the said bids, said contract was awarded to the said Company, and VIHERE4S, it is deemed necessary to set aside and provide for the payment of all that portion of the cost required in the said contract to be paid by the City of Wichita Falls; THEREFORE, be it resolved by the Board of Aldermen of the City of th'ichita Falls, that there be and is hereby set aside and appropriated out of the funds available for that prupose, the sum of _ to pay and defray all that portion of the cost of improving said portion of Broad Street from the South'Property Line of Eighteenth Street to the North Property Line of Twenty Fourth Street to be paid for by the City of Vfichita Falls; The said contract and the construction bond and maintenance bond, be and the same are hereby approved and adopted, and the Mayor is hereby authorized to execute and sign the said contract, in the name of the City That this resolution shall take effect from and after its papsage. Whitham and Company and the City of Wichita Falls, for performing of all work and excavation in connection with the improvement of Broad Street from the South Property Line of Eighteenth Street to the North Prop- erty Line of Twenty Fourth Street for the prices named therein and upon the terms therein set forth binding the City of Wichita Falls, Texas, to do and perform all work of excavation upon said street, as is provided in the contract, being one contract for said street, are this day presented to the Board of Aldermen for adoption and approval, and t"HEREAS, it is deemed advisable by the Board of Aldermen of the City of Wichita Falls, Texas: I. That the City of Wichita Falls, Texas do enter into contracts with L. E. Whitham and Company binding the City to do and perform all the work of excavation shown in said contract, and on said street, at and for the prices and for the terms therein stipulated and set forth. Hibbs has completed the storm sewer construction on Oak Street and Indiana Avenue in accord- ance with the plans and specifications.. I, therefore, recommend the acceptance of this work, and the final payment for the work when proof of settlement of material and labor claims are presented. Respectfully, (Signed) F. 14. The public hearing with reference to closing of the alley running North and South through Block 28-Highland Addition was called and after hearing no protestg the following motion was put in order. BE IT RESOLVED BY THE CITY OF WICH1TA FAILS, TEXAS, THAT: WHEREAS, the City of Wichita Falls, has heretofore ordered that Avenue "0" in said City be improved from its intersection with the East property line of Wenonah Avenue to its intersection with the East Curb line of Santa Fe Avenue, by raising, grading, filling, installing con- crete curbs and gutters and paving with necessary appurtenances, and there- after plans and specifications were duly adopted and approved for such improvements, bids were advertised for ar.d received, and on the 6th. day of February 1926 such bids were opened, and 1,r'HER7AS, the bids received have been fully canvassed and considered and the City Council after fully considering same is of the opinion that the bid of Plains Paving Company is the most ad- vantageous and should be accepted; NO'`', THEREFORE, BE IT RESOLVED BY THE CITY OF °JICHITA FAILS, TEXAS, THAT; I. The form of contract embraced in the specifications be and the same is hereby adopted and approved, and the Mayor is authorized and directed to enter into contract for such improvements with the said Plains Paving Company, and to execute such contract for and on behalf of and in the name of the City and the City Clerk is hereby authorized and directed to attest same in the name of the City and to impress thereon the City's corporate seal. The City Engineer is hereby directed in accordance with provisions of Section 108 of the City Charter, to make and file report with the Board of Aldermen showing thereon the estimated cost of the proposed improvements, the proportion thereof to be paid by the City, the proportion thereof to be assessed against the abutting property andthe owners thereof, the owners of land abutting thereon and benefitt- ed thereby, a owner thereof, the rate per front foot proposed to be assessed for curb, and the amount to be assessed in each case for curb, the rate per front foot of property proposed to be assessed for improve- ments other than curb, the total amount proposed to be assessed against each lot or parcel of land and the owner thereof, and such report may show other matters or things and shall show the estimated amounts of damages, if any, to each piece or parcel of property, and the owner there of, which will be sustained by reason of said improvements, Such report shall in all respects comply with the provisions of the City Charter and with Chapter 11, Title 22,'of the Revised Civil Statutes of the State of Texas of 1911, and in all respects comply with the resolutions and other proceedings of this Board with reference to the proposed improvement of said portion of said street. age.
