ized to issue a permit to Mike Casky for the construction of a grocery
store on Lot 9, Block 89 A, Highland Addition. A waiver of property
ownerts restrictions was presented, inspected and returned to J. A.
Kemp for filing.
Motion seconded by Alderman Jones and carried.
Moved by Alderman Hunt that the plat of Riverts Addition
presented by W. E. Wilson be approved.

The hearing with reference to paving 7th. Street from Van Buren to
Sunset Drive was called and after hearing no protests the following

to Plains Paving Company contract for the imppovement of certain

WHEREAS, Plains Paving Company has sold its interests in
said contacts to Fuller Construction Company upon condition that the
City of Wichita Falls consents to Fuller Construction Company being
substituted as contractor in lieu of Plains Paving Company, and that
Plains Paving Companybe released from any obligation to said city
relating to the improvement of the above portions of the above said
dtreet, and
WHEREAS, Fuller Construction Company has indicated its
willingness to enter into the contracts which babe been awarded to
Plains Paving Company and to perform the same in the same manner
that Plains Paving Company would be obligated to do. Therefore,
BE IT RESOLVED BY THE CITY OF WICHITA FALLS, TEXAS:
(1) That Fuller Construction Company be, and it is
hereby accepted as the contractor to perform the improvements upon
the aforesaid streets or portions thereof in lieu of Plains Paving
Company, and the Mayor is authorized to enter into contract for
such improvements with Fuller Construction Company and to execute
such contracts for and on behalf of and in the name of the City and
the City Clerk is hereby authorized and directed to attest same ir- the
name of the City and to impress thereon the City's corporate seal..
(2) That Plains Paving Company be and it is hereby released
f from the performance of said contracts; provided however. that' such
" release shall not become effective until said Fuller Construction
Company shall have executed the contracts with said City for the per-
formance of said obligations, and shall have given the security re-
quired by said City therefor.
