The resolution is as follows: A RESOLUTION ACCEPTING THE IMPROVEMENTS CONSTRUCTED UNDER CONTRACT BETWEEN THE CITY OF WICHITA FALLS AND L. E. WHITHAM & COMPANY AND AUTHORIZUA4 THE DELIVERY TO THE CONTRACTOR OF THE WARRANTS EVIDENCING THE CITY'S G4 INDEBTEDNESS THEREFOR. WHEREAS, the City has heretofore executed a contract with L. E. Whitham & Company on April 4, 1927, providing for the pavingof the West side of Broad Street from the South property line of Sth Street to the North property line of 9th Street, which section of the Street is abutted by a municipal park owned by the City; and WHEREAS, a supplemental contract by and between the City and the Contractor was executed May 9, 1927; and WHEREAS, both of said contracts were duly ratified by the Board of Aldermen heretofore on this May 9, 1927; and WHEREAS, the contractor has presented his final estimate showing the complete performance of said contract, which estimate has been duly approved by the said engineer and such other City officials as are required to approve it and has been filed with the City Clerk. BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: (1) That the estimate filed by the contractor and approved by the engineer, be, and it is hereby. in all things aiproved; (2) That a copy of the estimate be, and it is hereby made a part hereof, marked Exhibit "A"; (3) The Mayor, City Clerk and City Treasurer are hereby directed to deliver to L. E. Whitham & Company 03,500.00 of interest bearing time warrants styled "City of 4aichita Falls Park Paving War- rants, Series 192711, dated May 15th, 1927, bearing 4-3/4/o interest, numbered one (1) to seven (7), inclusive, of the denomination of y500.00 each, maturing serially throughout the year 1928 to 1933, ,.yore parti- cularly described in the ordinance authorizing the issuance of said warrants, recorded in Book 11 of the Minutes of the Board of Aldermen; (4) The Officials of the City of Wichita Falls are hereby authorized and directed to do any and all things necessary and to sign any and all certificates necessary or proper to show the legality �+ of the issuance and delivery of said warrants.
