THAT WHEREAS the City of Wichita Falls ent?red into certain
written contract with the West Texas Construction Company which was
dated October 18, 1926, for the construction of certain street im-
provements within the following limits, towit: Avenue "K" from the
West Curb Line of Giddings Street to the East Curb of Joline Street,
and,
WHEREAS the said city entered into a certain written contract
with L. E. Whitham & Company which was dated October 25, 1926, for the
construction of said street improvements within the following limits
towit: Bell Street from the South Property line of Avenue "J" to the
North Property line of Avenue "L" and,
WHEREAS, there is a conflict in the two said contracts both of
which include and cover the intersection of Avenue "K" and Bell Street,
and,
WHEREAS it was the intention of the City of Wichita Falls to
award the improvements of said intersection to L. E. Whitham & Company.
NOW THEREFORE be it Resolved by the Board of Aldermen of the City
of Wichita Falls that the intersection of Avenue "K" and Bell Street
be excluded and omitted from the contract of the West Texas Construc-
tion Company and the West Texas Construction Company contract be so
amended and changed so that same shall cover and include the improve-
ments of Avenue "K" from the West curb line of Giddings Street to the
East Property line of Bell Street and from the West property line of
Bell Street to the East curb line of Joline Street.

Moved by Alderman Hunt that the Street Department be auth-
orized to pay approximately v700.00 on repairs to pavement on the Street
i car tracks for a distance of approximately 600 feet on Tenth and Lamar
Streets.
Motion seconded by Alderman King and carried.
Moved by Alderman Carter that R. M. Hurst be appointed clerk
of the Corporation Court to succeed C. B. McConnell, resigned, at a
