I,S. on the above date with the following members present: J. Akin, Mayor, J. Hunt, Q A. W. King, Q Roy E. Carter, Q Aldermen, Oral Jones, Q J. H. Patton, Q G. D. Fairtrace, City Illanager, W. E. ',icBroom, City Clerk, Thelbert i.artin, City attorney. The Minutes of the previous meeting were read and approved. ..:ayor J. W. ORDINANCE NO. 997 AN ORDINANCE REGULATING THE STORAGE OF CALCIUM CARBIDE WITHIN THE CORPORATE LIMITS OF THE CITY OF WICHITA FALLS, TEXAS; REQUIRING A PERI44IT FOR KEEPING IN EXCESS OF ONE HUNDRED POUNDS; PROVIDING SPECIFIC- ALLY FOR THE CONSTRUCTION AIM LOCATION OF STORAGE BUILDINGS; REQUIRING REPORTS TO BE BADE TO THE FIRE MARSHALL, AND PRESCRIBING A PENALTY. .,loved by Alderman King that Ordinance t;o. 997 be passed on its third and final reading and be adopted as read. The returns of the special bond election held on August 26tn were opened and canvassed. Moved by Alderman Carter that the following Resolution be adopted: A RESOLUTION CANgASS ING THE RETURNS AND DECLARING RESULTS OF THE SPECIAL ELECTION HELD ON THE 28TH DAY OF AUGUST, A. D. 1928, TO DETERMINE WHETHER OR NOT THE BOARD OF ALDEILIM OF THE CITY OF WICHITA FALLS SHOULD BE AUTHORIZED TO ISSUE REFUNDING BONDS IN THE SUI,I OF TWO HUNDRED FIFTY THOUSAND DOLLARS (4250,000.00). At a.meeting of the Board of Aldermen of the City of Wichita calls, Texas, held at the regular meeting place thereof, at the Llemor- ial Auditorium on the loth day of September, A. D. 1928, a ;uorum being present, came on to be considered the returns of an election held in said city on the 28th day of August, A. D. 1928, to determine whether or not the Board of Aldermen of the City of 6.ichita Falls, Texas, ;3.11_(1 i� should be authorized to issue bonds of said city in the sum of Two Hundred Fifty Thousand Dollars ($250,000.00), and to levy a tax suf- ficient to pay the interest on said bonds and to create a sinking fund sufficient to redeem them after maturity, maturing serially not to ex- ceed thirty (30) years and bearing interest at the rate of 4b per annum, payable semi-annually, for the purpose of paying off, cancelling, and in lieu of a like amount of legally issued and outstanding interest bearing warrants of said city; and upon consideration of such returns the following resolution was passed: SJHEREAS under and by virtue of an ordinance, duly enacted and approved by the Board of .Aldermen of said city on the 24th day of July, A. D. 1928, an election was held in said city on the 28th day of August, A. D. 1928, for the purpose of determining whether or not the Board of Aldermen of said city should be authorized to issue bonds in the amount of Two Hundred Fifty Thousand Dollars (�250,000.00), maturing serially, not to exceed thirty (30) years and bearing interest at the rate of 4Q/o per annum, payable semi-annually, and to levy a tax sufficient to pay the interest on said bonds, and to create a sinking fund sufficient to redeem them at maturity for the purpose of paying off, cancelling, and in lieu of like amount of legally issued and out- standing interest bearing warrants of said city of „ichita Falls, Texas; and, WHEREAS upon consideration of the returns of said election it appeared that the same was in all respects legally held; that due notice had been given; that returns thereof were legally made; and that there were cast at said election One Thousand Five Hundred Thirty One (1531) votes, of which number Nine Hundred '.'hirty (930) votes were cas$ "for the issuance of bonds," and Six Hundred One (601) votes were cast "against issuance of bonds;" THEREFORE, -be it resolved and declared by the Board of Alder- men of the City of Vichita Falls, Texas, that the proposition to issue said bonds and levy said tax was sustained by a majority of the quali- fied property tax payers voting at said election, and that the Board of Aldermen of the city of Wichita Falls, Texas, is authorized to issue said bonds, and to levy and have assessed and collected said tax. 2ASSED AND APPROVED, this the loth day of September, A. Nays: Hone. iAoved by Alderman Patton that the following plan of selling the refunding bonds in the amount of }�250,000.00 authorized at the election held on August 28th be approved, and the City Clerk be auth- orized to advertise for bids in accordance therewith: The Board of Aldermen of the City of Uichita Falls, Texas, will receive bids for sale of above bonds at an auction sale to be held in Room 300 in the Memorial Auditorium Building in the City of Wichita Falls, Texas, at 8:00 o'clock P. i:. October 8th, 1928. Bidders will be required to deposit a Cashier's check for y5,000.00 payable to the City of Wichita Falls to guarantee performance of contract. The successful bidders will be required to furnish printed bonds and a market attorney's approving opinion, who shall be chosen or approved by the City .Manager of the City of ;,ichita Falls. The buyer will be required to take up from the owners thereof at par all interest bearing time and registered warrants listed in the order of election and exchange same par for par for a like amount of bonds at the office of the Comptroller of the State of Texas in .,ustin, Texas. 5ItL A complete transcript of all proceedings approved by the Attorney General of the State of Texas will be furnished by the City. Motion seconded by alderman Hunt aad carried. ORDINANCE NO. 987 AN ORDINANCE LEVYING, ASSESSING AND FIXING THE RATE OF TAXA- TION IN THE CITY OF WICHITA FALLS, TEXAS, FOR THE YEAR A. D. 1928, LEVYING AN OCCUPATION TAX ON ALL OCCUPATIONS TAXABLE UNDER THE LA19S OF THE STATE OF TEXAS AND THE CHARTER AND ORDINANCES OF SAID CITY.
