IN THE.CITY OF WICHITA FALLS, TEXAS. - ----

be eliminated upon its third and final reading.

ance of mr. Jones of the Panhandle Refining Company attempt to, settle
existing conditions between the Panhandle Refining Company Band and
local union on account of the Panhandle Refining Company sand furnishing
music for entertainment in the City Parks without charge.

moved by Alderman ratton that the existing water conditions
on North Lamar Street on property owned by Hattie E. Aldrich be referred
to the City manager for investigation.

in granting a permit to install a gasoline filling station on the
corner of Pecan and rove Streets be approved.

Attorney Ihelbert martin on the way of handling errors in paving cer-
tificates against Lot 11, ;dock 19-A, Highland Addition, as assessed
by ordinance Bo. 813, be received ana accepted:
"I herewith beg to report that it is my opinion that the
Board of Aldermen are without authority to pass the proposed ordinance
submitted to the Board by the Attorney for L. E. whitham & Company on
June 18th, 1928.
that the proper and legal way to correct the error in the
certificate in question is by a reassessment as provided in Section
III of the Charter of the City of l"dichita calls, by sirticles 1095,
1097, 1098, 1099 and 110U, Revised Civil Statutes of 'texas, 192b.
The Statutes above referred to have been held constitutional
by the Court of Civil appeals at San Antonio in the case of Booth,
et al. vs. uvalde Rock Asphalt Company, 29b, S. w. 645.
In the case of 'texas Bitulithic Company vs. henry, 197 S. C1.
221, the Court of Civil Appeals at rort worth has held that a reassess-
ment is the proper way in which to correct an error in name and
description of property.
In this case a charter provision of the City of rort Worth,
somewhat similar to our Charter provision, was construed-"

AN ORDINANCE AKENDING ORDINANCE NO. 909, PASSED AND APPROVED
ON APRIL 16TH, 192b, ENTITLED "ORDINANCE PROVIDING FOR A CUSTODIAN FOR
THE t'IUNICIPAL BUILDING AND AUDITORIUM OF THE CITY OF '++ICHITA FALLS,
TEXAS; FIXING A SCHEDULE OF RENTS TO BE CHARGED FOR THE USE OF SUCH
AUDITORIUM, AND AUTHORIZING SUCH CUSTODIAN TO RENT THE AUDITORIUM AM
COLLECT SUCH CHARGES; FURTHER PROVIDING THAT THE AUDITORIUt4 MY BE
RENTED TO CIVIC ORGANIZATIONS AND ENTERPRISES AT REDUCED RATES, ETC."
