Such motion was adopted by unanimous vote of the member of the Board, all members thereof being present and voting in favor of such motion, to -wit: Oral Jones, J. W. Hunt, P. B. Curd and Roy E. Carter voting "YEA", and none voting "NAY". Thereupon, it was moved by Alderman Curd, and seconded by Alderman Carter, that said ordinance be finally passed and adopted, and which motion was adopted by the following vote, to -wit: Oral Jones, J. That the facsimile signatures of the Mayor and the City Clerk may be lithographed upon the interest coupons attached to said bonds and shall have the same effect as if they had been signed by them. That said bonds shall express upon their face the purpose for which they are issued; that they are issued under and in strict con- formity with the Constitution and laws of the State of Texas, particu- larly Section 75, of the Charter of the City of Wichita Falls, and in pursuance of an ordinance of the Board and the form of each of said bonds shall be substantially as follovis: No. UNITED STATES OF AMERICA, jl,000.00 STATE OF TEXAS, COUNTY OF '�ICHITA. CITY OF WICHITA FALLS, a municipal corporation of the State of Texas, acknowledges itself indebted to and, for value received, hereby promises to pay to bearer the sum,of ONE THOUSAND DOLLARS (91,000.00), in lawful money of the United States of America, on the FIFTEENTH DAY OF FEBRUARY, 19 , with interest thereon from the date hereof at the rate of FOUR AND ONE=HALF PER CENT (4 1-2;o) per annum, payable on the 15TH DAY OF AUGUST, 1928, and semi-annually thereafter on the FIFTEENTH DAY OF FEBRUARY and the FIFTEENTH DAY OF AUGUST, in each year, as evidenced by the coupons hereto attached, until the principal sum is paid. BOTH PRINCIPAL AND INTEREST of this bond are hereby made payable at the HANOVER NATIONAL BAND, NE'J YORK, N. Y., upon presenta- tion and surrender of this bond and the coupons hereto attached, as they respectively mature. THIS BOND is one of a series of Sixty-one (61) serial bonds, of like tenor and effect, except as to maturity, dated the FIFTEENTH DAY OF FEBRUARY, 1928, numbered from One (1) to Sixty-one (61), in- clusive, all of said bonds being of the denomination of ONE THOUSAND DOLLARS (w1,000.00) each, aggregating in amount SIXTY-ONE THOUSAND DOLLARS (y61,000.00), and is issued for the purpose of refunding, can- celling, and in lieu of an equal amount of the existing bonded indebt- edness of said City. THIS BOND is issued under and in strict conformity with the Constitution and laws of the State of Texas, and particularly Section 75, of the Charter of the City of k,ichita Falls, Texas, and in pursuance of an ordinance duly adopted by the Board of Aldermen of the City of Wichita malls, Texas, and recorded in the IIinutes of said Board. --� IT IS HEREBY CERTIFIED, RECITED AND REPRESENTED that all acts, conditions and things necessary to be done precedent to aiid in the issuing of these bonds, in order to make them legal, valid and binding obligations of said City, have been done, happened and per- formed in regular and due form, as required by law; that the holder or holders of this bond, or the series of which it is a part, are and shall be subrogated to all the rights and privileges against said City had and possessed by the holders of the original bonds; that the faith credit and resources of said City are hereby irrevocably pledged for the prompt payment of the principal and interest of these bonds at maturity; that due provision has been made for levying and collecting annually by taxation an amount sufficient to pay the interest on these bonds as it falls due, and to provide a sinking' fund for the final redemption of said bonds at maturity; and that the issue of bonds of which this is one, together with all other indebtedness of said City, is within every debt and other limit prescribed by the Charter of said City and the Constitution and laws of said State. BE IT FURTHER ORDAINED BY THE BOARD OF ALDEM EN OF THE CITY OF WICHITA FALLS, TEXAS: That, for the purpose of paying the interest on said bonds and creating a sinking fund sufficient to discharge and redeem them at maturity, a tax of ONE CENTS (.01�) on each One Hundred Dollars, valu- ation of all taxable property in the City of 1kichita Falls, Texas, or such an amount as may at all times be legally necessary, shall be an- nually levied on said property and annually assessed and collected until said bonds and interest are paid; and the said tax of One CENTS (.Old) is here now levied for the current year, and such an amount as may at all times be legally necessary is here now levied for each succeeding current fiscal year while said bonds are outstanding, and such an amount shall be assessed and collected at the time and in the manner prescribed by law for the assessment and collection of other ad valorem taxes in the City of Wichita Falls, Texas, and shall be used and devoted to the purpose herein stated, provided, that to pay the interest on said bonds maturing August 15, 1928, there is hereby ap- propriated the sum of ONE THOUSAND THREE HUNDRED SEVENTY-TWO DOLLARS AND FIFTY CENTS ($1,372.50), out of sums now in the Treasury and to be in the Treasury from taxes collected for the current year, and the City Treasurer is hereby authorized, ordered and directed to place said amount to the credit of this series of bonds, and the said amount shall be applied to the purpose stated and none other. RESOLUTION A RESOLUTION FIXING THE PRICES OF UNSOLD LOTS IN RIVERSIDE CEIuIETERY, AUTHORIZING THE 1,TAYOR TO EXECUTE DEEDS TO SUCH LOTS TO THE PURCHASERS THEREOF UPON RECEIPT OF PRICES-MIEREIIJ FIXED; ALSO RATIFYING AND CONFIRMING ANY AND ALL DEEDS HERETOFORE EXECUTED BY THE MAYOR OF THE CITY OF WICHITA FALLS, CONVEYING LOTS IN SAID CE11ETERY 1'iHICH BELONG TO THE CITY OF WICHITA FALLS, TEXAS. WHEREAS, THE BOARD OF ALDERMAN OF '111E CITY OF WICHITA FALLS deems it advisable at this time to fix the prices to be charged for the unsold lots in Riverside Cemetery; and, WHEREAS, the Mayor of the City of Wichita Falls is the proper person to execute deeds covering such lots to the purchaser thereof, and, WHEREAS, the '4ayor of the City of Wichita Falls has heretofore executed certain deeds and conveyances conveying lots in said cemetery to the purchasers thereof, with the consent of the said Board of Alder- men, but without formal action thereon; therefore, BE IT RESOLVED BY THE BOARD OF i:LDERTAEN OF THE CITY OF ICHITA FALLS, TEXAS: SECTION 1: That the list attached hereto containing a complete statement of all unsold lots in Riverside Cemetery and setting forth the price to be charged therefor, is hereby adopted and made a part hereof, and the prices therein set forth being the reasonable market price of said lots at this time, such prices are hereby established and fixed until such time as the Board of Aldermen shall consider it necessary to change such prices. SECTION 2: That the Mayor of the City of Wichita Falls, Texas, is hereby authorized and it shall be his duty to execute proper deeds and conveyances conveying such lots to the purchasers thereof upon the payment of the prices fixed in said list. SECTION 6: That all deeds and conveyances :ieretofore executed by the llvayor of the City of Wichita Falls conveying lots in said Riverside Cemetery to the purchasers thereof, are hereby ratified and confirmed. 'otion seconded by Alderman Curd and carried. 400 Moved by Alderman Carter that the owners of curb gasoline pumps between the center of Seventh Street and the Center of Tenth Street and the alley between Ljmar and Travis Streets and the Fort ,— Worth & Denver Railway tracks be given thirty days additional time —' for moving said pumps from March 1st and that the City Clerk be in- structed to give them official notice to move their pumps on or be- fore April 1st, 1928.
