Min 12/07/19311'0114 Wichita Falls, Texas Memorial Auditorium Building December 7, 1931 The Board of Aldermen of the City of Wichita Falls met in regular session on the above date with the following members present: Walter Nelson, Jr., Mayor C. E. McCutchen, X J. N. Prothro, E. H. Eddleman, [ Aldermen J. M. Spoonts, Z V. R. Smitham, City Manager W. E. NcBroom, City Clerk Thelbert Martin, City Attorney The Minutes of the previous meeting were read and approved. Moved by Alderman McCutchen that the following resolution be adopted. Motion seconded by Alderman Eddleman and carried by the following vote: Yeas: Aldermen McCutchen, Eddleman, Spoonts, and Prothro. Nays: None. RESOLUTION A RESOLUTION CANVASSING THE RETURNS AND DECLARING RESULTS OF THE SPECIAL ELECTION HELD ON IRE 5TH DAY CF DECEMBER, A. D. 19310 TO DETERMINE WHETHER aR NOT THE CITY OF WICHITA FALLS MAO& OWN AND OPERATE A PLANT, SYSTEM OF PIPE LINES, AND PROPERTIES FOR DISTRIBUT- ING NATURAL GAS TO DOMESTIC AND INDUSTRIAL CONSUMERS IN THE CITY OF WHICHITA FALLS. At a meeting of the Board of Aldermen of the City of Wichita Falls held at the regular meeting place thereof in the Mem- orial Auditorium on the 7th day of December, 1931, a quorum being present, came on to be considered the returns of the election held in said city on the 5th day of Decemb�jer?', 1931, to determine whether or not the City of Wichita Falls sheaMWown and operate a `plant, system of pipe lines, and properties for distributing natural gas to domestic and industrial consumers in the City of Wichita Falls; and upon consideration of such returns, the following resolution was adopted: WHEREAS, under and by virtue of an ordinance duly enacted by the Board of Aldermen of said city on the 2nd day of November, 1931, an election was held in said city on the 5th day of Decenb er, 1931, for the purpose of determining whether or not the City of Wichita Falls sho4k own and operate a system of pipe lines and properties for distributing natural gas to domestic and industrial consumers in said city, and WHEREAS, upon consideration of the returns of said election it appeared that the same was in all respects legally held, that due notice had been given, that returns thereof were legally made, that there were cast at said election 1554 votes, of which number 1492 votes were cast in favor of the proposition and 62 votes were cast against the proposition, THEREFORE, BE IT RESOLVED AND DECLARED BY THE BOARD OF ALDER- MEN OF THE CITY OF WICHITA FALLS: That the proposition favoring the owning and operating of a plant, system of pipe lines, and properties by the City cf Wichita Falls for distributing natural gas to domestic and industrial consumers, provided the cost of said plant, system, and properties is paid out of the revenues derived from the operation of said gas properties and other utilities owned by the City, and such cost in no event to be paid from the proceeds of taxation, was sustained by the majority cf qualified voters, voting at said election. PASSED AND APPROVED this the 7th day of December 1931. ORDINANCE NO.1082 AN ORDINANCE REGULATING WATER SUPPLIES WITHIN THE CITY OF WICHITA FALLS, TEXAS, PROVIDING FOR A PERMIT BEFORE ENGAGING IN THE BUSINESS CF SUPPLYING WATER TO THE CITIZENS OF WICHITA FALLS, PROVIDING FOR THE TESTING OF WATER AND WATER SUPPLIES AIM PRESCRIBING THE PENALTY AND DECLARING AN EMERGENCY. Moved by Alderman Spoonts that Ordinance No. 1082 be passed on its third and final reading and be adopted as read. Motion seconded by Alderman Prothro and carried by the fol- lowing vote: Yeas: Aldermen Spoonts, Prothro, McCutchen, and Eddleman. Nays: None. Moved by Alderman McCutchen that the application of the Wichita Falls Traction Company for an increase in fare from 7� to 10gr for each passenger be received and a public hearing be held in the Council Chamber in the Memorial Auditorium at 7:30 P.M. December 28, 1931, for the purpose of hearing protests. Motion seconded by Alderman Prothro and carried. Moved by Alderman McCutchen that the meeting be adjourned.
