in regular session on the above date with the following members

The t.inutes of the previous meeting were read and approved.
ORDINANCE NO.1073
AN ORDINANCE PROVIDING FOR A CUSTODIAN FOR THE M1110RIAL
AUDITORIUM AND BUILDING BELONGING TO THE CITY OF WICHITA FALLS,
TEXAS, FIXING A SCHEDULE OF RENTS TO BE CHARGED FOR TIM USE OF SUCH
AUDITORIUM, AND AUTHORIZING SUCH CUSTODIAN To RENT THE AUDITORIUM
AND COLLECT SUCH CHARGES, REPEATING ALL ORDINANCES IN CONFLICT
HEREWITH AND DECLARING AN EMERGENCY.
Moved by Alderman Eddleman that Ordinance No. 1073 be
passed on its second reading.
Motion seconded by Alderman Prothro and carried by the
following vote:
Yeas: Aldermen Eddleman, Prothro, Spoonts, Harvey, and
McCutchen.
Nays: None.
Moved by Alderman Eddleman that the City Attorney be in-
structed to prepare an ordinance amending Ordinance No. 958, which
will reduce the age limit of minors driving automobiles from 16 to
14 years.
Motion seconded by Alderman Prothro and carried.
Moved byAlderman Eddleman that the following resolution
be adopted.
Motion seconded by Alderman Spoonts and carried by the
following vote:
Yeas: Aldermen Eddleman, Spoonts, McCutchen, Prothro,
and Harvey.
Nays: None.
RESOLUT ION
WHEREAS, the franchise granted by the City of Wichita Falls on
September 3, 1908, under which franchise, the Municipal Gas Company is
now operating a distribution system within the corporate limits of the
City of Wichita Falls, Texas, expires on the 3rd day of September, A. D.
1933; and,
WHEREAS, the said Municipal Gas Company will have no authority
to use the streets, alleys and public places in the said City after
September 3, 1933; and,
WHEREAS, it is the desire of the Board of Aldermen and Mayor of
the City of Wichita Falls to grant a franchise to some individual,
association, partnership, or corporation to own, construct, maintain,
and operate a gas distributing system for a period of years and at a
reasonable rate to be charged such domestic customers.
THEREFORE, BE IT RESCUED BY THE BOARD OF AIDERMEN OF THE CITY
OF WICHITA FALLS , TEXAS -
SECTION 1. That the City Manager be, and he is hereby author-
ized and instructed to negotiate with persons, associations, partnerships,
and corporations and to interest such persons, associations, partnerships,
and corporations, if possible, in owning, maintaining, constructing, and
operating a distributing system for natural gas in said City and to make
recommendations to this body, looking to the consumation of such contract
and franchise.
SECTION 2. That the City Manager is hereby instructed to offer
a franchise for a reasonable length of time to such person, association,
partnership or corporation as may offer the highest cash price for such
franchise and in addition thereto shall agree and contract to furnish
natural gas at forty five cents (450) or less per one thousand (1000)
cubic feet to domestic users within ,the city limits of the City of Wichita
Falls for a period of at least five (5) years from the time it acquires,
constructs, and erects and completes a distribution system for natural
gas in such City.

The Board of Aldermen then adjourned.
