The Board of Aldermen of the City of Wichita Falls met in
regular session on the above date with the following members present:

The Minutes of the previous meeting were read and approved.
The following report on gasoline curb pumps operated inside
the fire limits was presented to the Council by the Acting City
Manager:

Gentlemen:
In accordance with your request we have made a survey of
the fire limits district in order to ascertain the number of gasoline
pumps in operation on the curb.
Vie find that there are 35 such pumps now in use, and the
following list gives the location and name of operator of each:

Moved by Alderman Harvey that the following resolution be
adopted.
Motion seconded by Alderman Prothro and carried by the follow-
ing vote:
Yeas: Aldermen Harvey, Prothro, Snoonts,and McCutchen.
Nays: None.
RESOLUTION
VPhereas, a survey has been made by the City Manager and it
appears therefrom that there is now located on the streets of the City
of Wichita Falls within the fire limits, thirty five (35) gasoline
filling station pumps, and
Whereas, the location of such pumps upon the streets is a
nuisance and interferes with the free use of the streets and sidewalks
within the fire limits, and
Whereas, such use of the streets and sidewalks is unlawful.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE
CITY OF WICHITA FALLS, TEXAS:
Section 1. That the City Manager be and is hereby instructed
and authorized to notify each and all of the owners of such gasoline
pumps to remove same from the sidewalks and streets of the City on or
before the 1st day of January, 1932.
Section 2. That the City Attorney be and is hereby instructed
and authorized to take such action as is necessary to have such gasoline
pumps removed from the sidewalks and streets if said owners fail and
refuse to remove same on or before the date above mentioned.
PASSED AND APPROVED this 27th day of July, 1931.
The following report was received from J. T. Montgomery, Chair-
man of the Advisory Committee, on the gas controversy, and action was
deferred pending arrival of City -I.:anager V. R. Smitham:

To the Mayor and Board of Aldermen
Wichita Falls, Texas
Gentlemen:
We, your committee, appointed to make recommendations to the
Board of Aldermen looking to a solution of the rate controversy with the
gas company, do hereby recommend that the Board of Aldermen at this time
through the Engineering and City Clerk's Departments_, with such addition-
al help as may be necessary, ascertain the present fair value of the pros
arty of the Municipal Gas Company used and useful in the distribution of
natural gas in the City of Wichita Falls, Texas; that you determine by
said means or otherwise the net revenue derived from operation of this
plant, that is, the gross revenue from said plant, less actual operating
expenses and deductions for depreciation, and for the purchase price of
gas at the city gate at a fair price considering present conditions, the
source of the supply of gas, and the facilities now present for deliver=
ing such gas to the city gate.
After such information has been acquired, it will then be
possible to determine what rate is necessary to be charged in order
to af2ord the gas company a fair rate of return upon the fair value
of its property used and useful in the distribution of natural gas
in the City of Wichita ,ails.
71hen this information has been furnished us, we will go
into the matter further and make further recommendations to you.

Moved by Alderman hIcCutchen that Acting City Manager '`. E.
McBroom be authorized to approve the contract between the Texas
Company and the Wichita Falls Air Transport Company, providing for
the Texas Company to have the use of a space 50 ft. by 50 ft. for
placing a 550 gallon storage tank at Kell Field. Said tank to cover
a period of twenty months from August 1, 1931, provided, however,
that the contract be first approved by the City Attorney.
Motion seconded by Alderman Harvey and carried.
Moved by Alderman Spoonts that the City Attorney be in-
structed to draft an ordinance setting the time of payment of taxes
as follows:
1931 taxes due and payable October 1, 1931.
First half of 1930 Roll becoming delinquent February 1,
1931, with 10 penalty added to delinquent portion only.
Second half becoming delinquent August 1, 1931, with 10%
penalty added for delinquency.
Delinquent to draw 6% interest from date of delinquency.
Motion seconded by Alderman Prothro and carried.
Moved by alderman Spoonts that the Acting City Manager be
authorized to transfer :_200.00 from Dog Pound Extra Help, Account
No. 25 A--5, to improvement, Account 25 Y-1, for construction of
dog pound and asphyxiation chamber, according to plans and s peci-
fications drawn by the City Engineer.
Motion seconded by Alderman Harvey and carried.

The Board of Aldermen then adjourned.
