Min 04/13/1931922 r�^ Wichita Falls, Texas Memorial Auditorium Building April 13, 1931 The Board of Aldermen of the City of Wichita Falls met in regular session on the above date with the following members present: Walter Nelson, Jr., Mayor J. M. Spoonts, C. E. McCutchen, 7 E. H. Eddleman, ) Aldermen J. N. Prothro, Z G. D. Fairtrace, City Manager W. E. McBroom, City Clerk Thelbert Partin, City Attorney The Minutes of the previous meeting were read and approved. The returns of the general city election held on April 7th were opened and canvassed. Moved by Alderman Eddlema n that the following resolution be adopted. Motion seconded by Alderman Prothro and carried by the following vote: Yeas: Aldermen Eddleman, Prothro, McCutchen and Spoonts. Nays: None. RESOLUTION WHEREAS at a regular meeting of the Board of Aldermen of the City of Wichita Falls held at the regular meeting place in the Council Room of the Yemorial Auditorium Building in said City on the 13th day of April, 1931, at which a quorum was present, came on to be considered the returns of the city election held on April 7th, 1931, for the purpose of electing three aldermen for said City, and, WHEREAS, after canvassing the returns of said election it was found to be duly and legally held in all respects, and there were cast at said election 3451 votes, and that For Alderman Place Number One (1) C. E. McCutchen received . . . . . . . 2042 votes P. B. Cox received . . . . . . . . . . 1496 votes For Alderman Place Number Two (2) J. M. Spoonts received . . . . . . . . 2047 votes Fred L. Corlett received . . . . . . . . 1483 votes And it appearing that C. E. McCutchen received the great- est number of votes at said election for Alderman Place Number One (1), that J. M. Spoonts received the greatest number of votes cast at said election for Alderman Place Number Two (2), and that R. 0. Harvey received the greatest number of votes cast at said election for Alderman Place Number Three (3), THEREFORE. RESOLUTION A RESOLUTION CANVASSING THE RETURNS AND DECLARING RESULTS OF CHARTER AMENIXTENTS ELECTION HELD ON APRIL 7TH, 1931. At a meeting of the Board of Aldermen of the City of Wichita Falls, Texas, held at the regular meeting place thereof in the Memorial Auditorium on the 13th day of April 1931, a quorum being present, came on to be considered the returns of an election held in said city for the purpose of the adoption or rejection of either or both of two proposed amendments to the: City Charter of the City of Wichita Falls, Texas, and upon the consideration of such returns, the following resolution was passed: WHEREAS, under and by virtue of an ordinance duly enacted and approved by the Board of Aldermen of said City on the 2nd day of March, A. D. 1931, and thereafter published, an election was held in said city on the 7th day of April, A. D. 1931, for the purpose of the adoption or rejection of either or both of two proposed amendments to the City Charter of said City, and WHEREAS, upon consideration of the returns of the said election that it appears the sane was in all respects legally held, that due notice had been given, that returns thereof were legally made, and there were cast said said election 3010 votes, of which number there were cast: For Amendment No. 1 . . . . . . . . 2266 votes Against Amendment No. 1 .. . . . . 744 votes Majority for Amendment No.1 . . . . . 1522 votes For amendment No. 2.. . . . . . . . 2399 votes Against Amendment No.2 .. . . . . . 560 votes Majority for Amendment No.2. . . . . 1839 votes And it appearing to the Board of Aldermen that a majority of qualified voters of said City voting at said election voted in favor of the adoption of both Amendments No. 1 and No. 2, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: That the Proposition to adopt the said charter amendments No. 1 and No. 2 was sustained at said election and both said amendments were adopted by a majority of the qualified voters voting thereat, and each of the said amendments thereby became and is now recognized and declared to be a part of the city charter of the City of Wichita Falls, Texas. PASSED AND APPROVED this the 13th day of April 1931. ,92. d Mayor Walter Nelson, Jr. administered the oath of office to the newly elected Aldermen C. E. McCutchen and J. M. Spoonts who resumed their places at the council table. The matter of approval of a cemetery plat in which the Mayor had personal interest was taken up and he requested that some other member of the Board be appointed Mayer Protem to act in his place. Loved by Alderman McCutchen that Alderman Eddleman be ap- pointed to act as Mayor Protem for the consideration of the approval of the cemetery plat as requested by Mayor Nelson. Motion seconded by Alderman Spoonts and carried by the following vote: Yeas: Aldermen McCutchen, Spoonts and Prothro. Nays: None. Moved by Alderman McCutchen that the plat of a subdivision to be used for cemetery purposes described as follows be approved: "Being the north one acre of a certain f our acre tract off the East side of the T. M, Huddle 15 acre tract located in Cherokee County School Land Survey, Wichita County, Texas, said four acre tract being described as follows: Beginning at a point on the east line of the T. M. Huddle 15 a. tract 2605E ft. S. and 4160 ft. E. of the northern N.W. corner Cherokee County School Land Survey, and 8 in. pipe corner post, said beginning point being also in the N. line of Wichita County Highway Right-of-way; Thence N. 996E ft. to the N.E. corner of Huddle 15 a.; Thence W. 174.54 ft. for a N.W. corner this tract; Thence S. parallel with the E. line this tract 1000 ft. to the N. line of said Highway Right-of- way; Thence N. 88-51 E. with said right-of-way line a distance of 174.54 ft. to the place of beginning and containing four acres of land. Motion seconded by Alderman Spoonts and carried by the following vote: Yeas: Aldermen McCutchen, Spoonts and Prothro. Nays: None. Mayor Walter Nelson, Jr. then resumed his position as mayor. Moved by Alderman McCutchen that the application of J. H. Patton representing the property owner of 1401 Bluff Street requesting that Ordinance No. 926 passed by the Board of Aldermen on August 1st, 1927, placing a paving assessment on this property be received, and the City Attorney be instructed to draft an ordinance repealing Ordi- nance No. 926. Motion seconded by Alderman Spoonts and carried. The hearing with reference to the application of 0. M. Pepper for a pemn.it to operate a grocery store at 2135 Avenue K was called, and, after hearing the protests of a number of property owners as set forth in their petition, the following motion was put in order: i Moved by Alderman Eddlemen that 0. M. Pepper be refused a permit to operate a grocery store at House No. 2135 Avenue K. Motion seconded by Alderman Protho and carried. Moved by Alderman Prothro that Ivan Jackson and Mete./`Wig gins be denied a permit to operate a public dance hall at 105 Barwise.&- Motion seconded by Alderman Spoonts and carried. Moved by Alderman Eddleman that the City Attorney be instructed to draft an ordinance providing for the payment of taxes for the year 1930 in three equal installments; the first to be due and payable on May 1st, the second on June 15th, and the third on August 1st, 1931, with penalty for failure to pay the first installment of 4%, the second 3% and the third 3%; 6% interest to be added from date of first delinquency. Motion seconded by Alderman Prothro and carried. Moved by Alderman Prothro that the meeting be adjourned. Motion seconded by Alderman Spoonts and carried. The Board of Aldermen then adjourned.
