Min 01/26/1931816 Wichita Falls, Texas Memorial Auditorium Building January 26th, 1931 The Board of Aldermen of the City of Wichita Falls met in regular session on the above date with the following members present: Walter Nelson, Jr., Mayor C. E. McCutchen, I E. H. Eddleman, X J. M. Spoonts, X Aldermen J. N. Prothro, X R. 0. Harvey, Z G. D. Fairtrace, City Manager W. E. McBroom, City Clerk Thelbert Martin, City Attorney The Minutes of the previous meeting were read and approved. Moved by Alderman Harvey that the public hearing on the application of J. H. Allison for a permit to construct a gasoline filling station on Lots 1 and 2, Block 38, Floral Heights, Addition, be continued until 7 : 30 P. M. February 2nd, 1931, in cr der that the property owners may have an opportunity to file a petition to show whether or not the majority within a radius of 300 ft. are objecting to this permit. Motion seconded by Alderman Prothro and carried. Moved by Alderman Prothro that the local post of the American Legion be granted permission to allow its unemployed members to sell apples on the streets on Saturday, January 31st. Motion seconded by Alderman McCutchen and carried. Moved by Alderman Eddleman that the Board of Aldermen concur with the County Commissioners in the selection and appointment of Mrs Mamie Dale as a member of the Board of Managers of the Wichita General Hospital for the two year term, beginning January 1st, 1931, and end- ing December 31st, 1932. Motion seconded by Alderman P.:cCutchen and carried. Moved by Alderman Eddleman that the City Manager be authorized to sign a pipe line license contract with the Wichita Valley Railway Company covering the construction of a 6 in. water line under the Wichita Valley tracks at Mile Posi 0.58 between Scott and Walnut Streets. Motion seconded by Alderman McCutchen and carried. The return5of the special bond election held on January 20th, 1931, were canvassed and tabulated, after which the following motion was put in order: Moved by Alderman Eddleman that the following resolution be adopted. Motion seconded by Alderman Spoonts and carried by the following vote: Yeas: Aldermen Eddleman, Spoonts, Prothro, Harvey & McCutchen. Nays: None. RESOLUTION A RESOLUTION CANVASSING THE RETURNS AM DECLARING RESULTS OF THE SPECIAL ELECTION HELD ON THE 20TH DAY OF JANUARY A. D., 1931, TO DETERMINE WHETHER OR NOT THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS SHOULD BF AUTHORIZED TO ISSUE WATERWORKS IMPROVEMENT BONDS IN THE SUM OF ONE MILLION (A1,000,000.00) DOLLARS. At a meeting of the Board of Aldermen of the City of Wichita "ails, Texas, held at the regular meeting place thereof at the Memorial Auditorium on the 26th day of January A. D., 1931, a quorum being present, came on to be considered the returns of the election held in said city on the 20th day of January A. D., 1931, to determine whether or not the Board of Aldermen of the City of Wichita Falls, Texas, should be authorized to issue bonds of said city in the sum of One Million ($1,000,000.00) Dollars, and to levy a tax sufficient to pay the interest on said bonds and to create a sinking fund sufficient to redeem them at maturity, maturing serially not to exceed forty (40) years and bearing interest at the rate of 42% per annum, payable semi-annually for the purpose of raising funds to construct improvements and extensions to the present system of water- works; on consideration of such returns, the following resolution was adopted: WHEREAS, under and by virtue of an ordinance duly enacted and. approved by the Board of Aldermen of said city on the 15th day of December A. D., 1930, an election was held in said city on the 20th day of January A. D., 1931, fcm the purpose of determining whether or not the Board of Aldermen of said city should be authorized to issue bonds in the amount of One Million ($1,000,000.00) Dollars, maturing serially, not to exceed forty (40) years, and bearing interest at the rate of 42-� per annum, pay- able semi-annually, and to levy a tax sufficient to pay the interest on said bonds and create a sinking fund sufficient to redeem them at maturity for the purpose of raising funds to construct improvements and extensions to the present system of waterworks to provide an adequate and available water supply and plant for said City of Wichita Falls, Texas, and, WHEREAS, upon consideration of the returns of said election it appeared that the same was in all respects legally held; that due notice had been given; that returns thereof were legally made; that there were cast at said election 3044 votes, of which number 1592 votes were cast "For the issuance of bonds", and 1452 were cast "Against the issuance of bonds"; THEREFORE, BE IT RESOLVED AND DECLARED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: , , That the proposition to issue said bonds and levy said tax was sustained by the majority of the qualified tax payers voting at said election, and, That the Board of Aldemen of the City of Wichita Falls, Texas, is authorized to issue said bonds, and to levy and have assessed and col- lected said tax. D. , 1931. 8 1, Moved by Alderman Eddleman that the following advertisement be placed in the Wichita Falls Record News calling for bids to be re- ceived on Feb�uar y 24th, 1931, for the construction of a new filtra- tion plantO"numping station in accordance with plans and specifications approved by the City Manager. Motion seconded by Alderman 1.cCutchen and carried. NOTICE TO BIDDERS Sealed bids will be received at the office of the City Clerk of Wichita Falls, Texas, up to ten (10:00) o'clock A.M., February 24th, 1931, and then publicly opened, for furnishing all tools, equipment, labor and materials and constructing a water filtration plant and pumping station; and furnishing and installing filter equipment for the City of Wichita Falls, Texas, in accordance with plans, profiles, and specifications on file in the office of the City Clerk. Complete plans and bound copies of the specifications, form of proposal, form of bond and contract may be seen and examined in the office of the City Clerk, or in the offices of the Consulting Engineers, Black & Veatch, Mutual Building, Kansas City, Missouri, or Montgomery & Ward, Wichita Falls, Texas. Contractors desiring plans and specifica- tions for their own use in preparing bids may obtain them from the Engineers by making a deposit of fifty (m50.00) dollars for the general contract and twenty five (,!25.00) dollars f(r filter equipment; thirty- five ($$35.00) dollars of the former and fifteen ($15.00) dollars of the latter will be refunded to unsuccessful bidders upon the return of the plans and specifications in good condition within then days after the opening of bids, the balance being retained to cover the cost of printing, mailing, etc. Extra copies of the specifications may be obtained at the price of one ($1.00) dollar each, and extra blue prints of any sheet or sheets of the plans at the price of twenty five cents each, none of which amounts will be refunded. When filed with the Clerk, bids shall be enclosed in a sealed envelope addressed to the City Clerk, and shall be accompanied by a certified check on a Wichita Falls, Texas, bank, or by a Cashier's check on any bank, in the amount of twenty thousand ($20,000.00) dollars, for the general contract and fifteen hundred ($1,500.00) dollars for the filter equipment contract, made payable to the City Treasurer of Wichita Falls, Texas. All checks will be left in the hands of the City Clerk, subject to the conditions specified in the annexed proposal, as a guarantee of good faith on the pert of the bidder. Checks of unsuccessful bidders will be returned when their bids are rejected; checks of successful bidders will be returned w he n the required bonds have been furnished and the signed contract has been filed with and approved by the City. All bidders must examine for themselves the location of the proposed work, satisfy themselves concerning the nature of the exca- vations to be made, and determine any unusual conditions or hazards to be met in performing this contract. Bidders are requested to be present at the time bids are opened. Each bidder will state in the proposal the time in which this work will be completed, if awarded to him. It is desired that this work be completed as soon as possible, and time will be taken into account in making the award. The date of completion named in the proposal will be the completion date of the contract. The City will expect the contractor to exert every effort to use local labor on the work. S10J All b ids will be compared on the basis of the Engineers' pre- liminary schedule of quantities. The City reserves the right, before awarding a contract, to make any investigation deemed necessary of a bidder's competency, financially or otherwise, and to reject any or all bids. The successful bidder will be required to furnish a surety bond in the amount of one hundred percent (100%) of the amount of the bid, signed by a surety or guaranty company authorized to do business in the State of Texas, and acceptable to the City as surety, which bond shall guarantee faithful compliance with the terms of the specifications and contract, and the payment of all labor and material bills, form for which bond is attached hereto. Payment for all work executed under this contract will be made in cash from the proceeds of the sale of bonds of the City of Wichita Falls. None of the instructions to bidders, bond forms, bidding form, preliminary schedule of quantities, specifications or contract shall be detached from the bound copy before filing with the City, and questions pertaining to the plans, specifications or contract shall be submitted to the Engineers prior to filing bids.
